Gentlemen:
This letter is to address criteria a. and b. as set forth in the Submittal Requirements for a
Major Amendment to Special Development District (SDD) No. 36. It is our
understanding that these two criteria are to be used in evaluating the merits of the
requested Major Amendment to Special Development District No. 36.
a. Describe the nature of the project to include information on proposed uses,
densities, nature of the development proposed, contemplated ownership patterns
and phasing plans.
This is a request for a Major Amendment to Special Development District No. 36
pursuant to Section 12-9A-10, Vail Town Code, to allow for the development of a
mixed-use hotel and multiple-family condominium units. The key components of
the mixed use hotel are as follows:
• 76,978 sq. ft. - accommodation units (118 keys)
• 10,202 sq. ft. - Type III employee housing units (34 units)
• 7,695 sq. ft. - restaurant / retail space
• 11,726 sq. ft. - conference / meeting rooms
• 14,416 sq. ft. - spa / health club facilities
The multiple-family condominiums units in the Special Development District
(SDD) consist of 40 units totaling 101,013 sq. ft. Accordingly, the uses within the

Special Development District (SDD) include hotel, commercial, recreation,
multiple-family residential and such other ancillary uses customarily included
within a five star resort hotel project and condominium development. The
contemplated ownership of the condominium units portion of the project will be
by forty separate owners, each of which will wholly own its individual unit within
the development together with use rights of certain common areas. The hotel
portion of the project is anticipated to be wholly owned by applicant and/or a
related third party entity. It is currently anticipated that the entire project will be
constructed in one phase and completed within approximately two years from
commencement of construction.
b. A statement outlining how and where the proposed development deviates from the
development standards prescribed in the property's underlying zone district.
This request for a major amendment to a Special Development District (SDD)
deviates from the development standards in Height, Site Coverage (below grade),
Site Coverage (above grade), and Density. Each of these deviations is described
and discussed below:
1. Height. The maximum height of the building is 89 feet, which is 41 feet
higher than the 48 feet allowable under the proposed High Density
Multiple-Family (DMF) zone district regulations. However, the primary
roof ridge runs parallel to South Frontage Road where more height is
encouraged and that ridge is proposed to have a maximum height of 77.5
feet. The building "steps" down from South Frontage Road to West
Meadow Drive where the height is in compliance with the height
requirements of the High Density Multiple-Family (HDMF) zone district
(i.e., 48 feet).
2. Site Coverage (below grade). Site coverage below grade exceeds the
maximum allowable by the High Density Multiple-Family (HDMF) zone
district. The below grade site coverage in the High Density Multiple-
Family (HDMF) zone district allows for 55% site coverage (65,332 sq.
ft.). As proposed, the below grade site coverage is 71% (84,402 sq. ft), a
deviation of 16% (19,070 sq. ft.) below grade.
3. Site Coverage (above grade). Site coverage above grade exceeds the
maximum allowable by the High Density Multiple-Family (HDMF) zone
district. The above grade site coverage in the High Density Multiple-
Family (HDMF) zone district allows for 55% site coverage (65,332 sq. ft.)
and, as proposed, the above grade site coverage is approximately 58%
(69,346 sq. ft), a deviation of 3% (4,014 sq. ft.).

4. Density. Density exceeds allowable gross residential floor area ("GRFA")
for the High Density Multiple-Family(HDMF) zone district but does not
exceed the total density for dwelling units permitted by right. The
maximum density permitted by right in the High Density Multiple-Family
(HDMF) zone district is 60 sq. ft. of GFRA for each 100 sq. ft. of
buildable site area (71,261 sq. ft.); with total density not exceeding 25
dwelling units pre acre of buildable site area (68 dwelling units). The
GRFA as proposed totals 177,991 sq. ft. with total density of 16.2
dwelling units per acre of buildable site area for a total of 40 dwelling
units. Accordingly, the density as proposed exceeds the allowable GRFA
by 106,730 sq. ft., however, the total density is 8.8 dwelling units per acre
of buildable site area below the maximum permitted (28 dwelling units
below the maximum permitted).

Gentlemen:
This letter is to address criteria a. through d. as outlined in the Request for a Change in
District Boundaries (Rezoning) Submittal Requirements. It is our understanding that
these four criteria are to be used in evaluating the merits of the modification of the
existing zoning district for both the Chateau at Vail Hotel and Alpine Standard
Properties.
a. A description of the proposed changes in the district boundaries.
A survey setting forth the boundaries of the proposed district boundaries has been
enclosed for your review. A verbal description of the proposed change in district
boundaries is as follows:
1. The Chateau at Vail Hotel site from the existing and pending Special
Development District (SDD) with underlying zone of Public
Accommodations (PA) to Special Development District (SDD) with
underlying zone of High Density Multiple-Family (HDMF).
2. The Alpine Standard site from the existing Heavy Service District (HS)
and pending Special Development District (SDD) with underlying zone of
Public Accommodations (PA) to Special Development District (SDD)
with underlying zone of High Density Multiple-Family (HDMF).

b. How the proposed change in district boundaries in consistent with the adopted
goals, objectives and policies outlined in the Vail Comprehensive Plan and
compatible with the Town of Vail's development objectives.
1. The proposed change in district boundaries is consistent with the policies
outlines in the Town of Vail Land Use Plan. The Land Use Plan
anticipates activities in this area aimed at multiple family dwellings and at
accommodating the overnight and short-term visitors to the area including
hotels, lodges with other support commercial and business services
oriented towards vehicular access from the interstate highway.
Appropriate activities include hotels, lodging, multiple family dwellings,
and other tourist oriented residential units, ancillary retail and restaurant
uses, pedestrian plazas, and gardens. The proposed change in district
boundaries and those uses by right allowed under the proposed underlying
zoning classification are consistent with the land uses recommended in the
Land Use Plan.
2. The proposed change in district boundaries is consistent with the West
Meadow Streetscape Plan. The new district boundaries and this
development would eliminate two curb cuts on West Meadow Drive and
move all service functions from West Meadow Drive to the Frontage Road
which would encourage pedestrian use of West Meadow Drive.
3. The proposed change in district boundaries is consistent with the proposed
South Frontage Road Access/Improvements Plan. The proposed change in
district boundaries and consequent redevelopment would allow for
improvements to both vehicular and pedestrian networks along the South
Frontage Road that would improve access points, road capacity, sight
distances, pedestrian networks, landscaping, drainage, and road grades that
currently are unattractive, unsafe or simply do not exist.
C. How the proposed change in district boundaries in compatible with and suitable
to adjacent uses and appropriate for the area.
1. To the east, Vail Road with improvements aimed at eliminating a curb cut
between the roundabout and West Meadow Drive will facilitate more
efficient and safe access along Vail Road and it will effectively act as a
transition area between the proposed High Density Multiple-Family
District (HDMA) and the compatible uses across Vail Road of Multiple-
Family, Public Accommodations and Service Districts. The 9 Vail Road
Condominiums Public Accommodations (PA) zone with its permitted and
conditional uses is consistent with the proposed High Density Multiple-
Family District permitted and conditional uses.

2. To the south, West Meadow Drive with improvements aimed at improving
the pedestrian character and use, by the elimination of two curb cuts,
creates an effective buffer between the proposed High Density Multiple-
Family (HDMF) and the primarily residential and Multiple Family uses
across West Meadow Drive.
3. To the west, the Alporn and Scorpio Condominiums uses and zone
districts are the same as the proposed High Density Multiple-Family
(HDMF) District and thus compatible. The planned improvements would
be compatible in height, mass, bulk and density with both the Alporn and
Scorpio Condominiums (at their respective boundaries with the Chateau
property) and the creation of a pedestrian walkway along the western
boundary of the proposed districts would further enhance pedestrian
access and act as an effective transition between the properties.
4. To the north, South Frontage Road with improvements aimed at
improving capacity and access would be more than adequate for ingress
and egress to the site. The proposed district changes, coupled with the
proposed improvements to the roadway, would have little impact on the
town facilities and would improve safety along the Frontage Road.
d. How the proposed change in district boundaries is in the best interest of the
public health, welfare and safety.
