Mr. Reed:
Vail Fire Dept received two inquiries from inspectors working for Safebuilt during the weeks of April 14
and 21, and a complaint from Safebuilt (the Town"s contract building inspection company) on April 28,
2008, regarding unsafe conditions at the Four Seasons job site directly across the street from the Fire
Station.
I went on site 04/29/08 and found a single exit from a sub-basement area. The sub-basement is
scheduled to become a parking garage but Layton Construction is installing offices on that level. This
is a violation of IFC Section 1411.1.
During the walk through, we found a 100 Ib propane cylinder inside the building. This is a violation of
IFC 3803.2.1.1.
We found the single exit was not even marked. This is a violation of IFC 1411.2.
The temporary fire protection standpipe was installed contrary to NFPA standards and was structurally
unsafe. This is a violation of IFC 1413.1.
We found unprotected shafts. This is a violation of IFC 507.2.2.
We found natural gas line hung with bailing wire. This is a violation of IFC 1403.1.
We found gas line and electrical lines suspended from temp shoring less than 6 feet above the floor so
as to present a hazard to anyone attempting to flee the area. This is a violation of IFC 1411.2.
The lighting is inadequate. This is a violation of IFC 1411.2.
They emergency evacuation plan is limited to a single individual with an air horn. The site is several
hundred thousand sq ft.. This is a violation of IFC 1408.

I issued orders to abate the hazards by this afternoon or I will issue a "red tag" closing the site.
After discussion with Chief Miller, we intend to issue a Summons and Complaint for one or more of the
following charges as shown in bold:

Upon inspection this afternoon (Tues 4 29 08), I issued a Hazard Tag prohibiting any further work
until the second exit is installed.
Only a few items were addressed during both walk-throughs 04/28/08 were completed. Layton
managed to install three exit signs; that's about it.
Additional issues are pending and will require compliance within days.
If the scaffolding is installed tonight before 7 PM, 04/29/08, we will inspect it on the same day.
Otherwise, we will inspect it on Wed AM 04/30/08, or when it's done.

The foreman from Firetrol came to the Fire Department this morning to advise us Firetrol will not be able to
bring the temporary standpipe into compliance with minimum standards as prescribed by NFPA 14 until next
week.
Under the Town of Vail Municipal Code, 10-1-2 B, International Fire Code, Chapter 1, per the statements the
Fire Department made on 04/30/08 when we released the initial Hazard Tag issued 04/29/08 under IFC Article 1,
Section 110, the standpipe was to have been installed by 4 PM OS/02/08. A stamped plan was required.
Based on information from Firetrol, it is apparent compliance with the order to install the standpipe will not be
met.
Under the Town of Vail Municipal Code, 10-1-2 B, International Fire Code, Chapter 1, Section 110.1.1, Unsafe
Conditions, the first and second levels are hereby ordered to be vacated and usage is prohibited under IFC
Section 109.3.1, Abatement; 110.2, Evacuation; 110.3, Summary Abatement; 111.1 Order; and 111.2, Issuance.
The office shall be vacated by 4 PM. OS/02/2008. No materials or storage shall be added to either Level 1 or 2.
Access to level 1 and Level 2 shall be signed to prevent access.

Security personnel may access Levels 1 and 2 for patrol duty only.
Leve13 is not restricted beyond normal code requirements. Provide a clear and unobstructed path to exitways.
This order shall remain in effect until such time as compliance with the violations listed above have been abated
and the site has been inspected and approved by the Vail Fire Department.
