I’m not sure it possible for the Town of Vail to make this process any more difficult! I’m sorry that you are busy and can’t afford the time to “re-review” documents. As to guarantees – are you kidding me! What guarantee can you give me! This is a G&E permit – nothing more nothing less – I simply want to dig a hole and if we have a problem later and can not continue the bond requirement will pay to fill the hole back in?? I’m I missing something. I have gotten G&E permits from numerous other Colorado jurisdictions without 1/50th of the amount of information the Town has to date. I just can’t understand -- needless to say I am completely frustrated and becoming very angry. I guess you feel the same way?! We have ALWAYS been told that we could submit for the G&E without the agreements but that the permit would not issue until we had the agreements. Why has the Town, once again, changed it collective mind? As to the TWO agreements in question: The 9 Vail Road Easement Agreement has been agreed to in principal and we are simply waiting for the legal description of the easement area as well as the depiction of the easement area to be finalized and then it will be signed and filed by the parties, The CDOT lease has been in the works for over 1 year and we began paying rent on the dirt in May 2006. I think everyone understand that CDOT has approved the soil nails and CDOT is simply working through its process with the Federal Highway Administration. We do not believe that the design will change or we would not be submitting the same for approval. I will call to discuss this further but I think I should wait a bit given my current state of mind. There is one element of concern contained in the previous email. That concern is: It appears the G & E submital will not be complete. It will be missing the easement and adjacent property owner agreements for both 9 Vail Road and CDOT Right of Way issues. The issue at hand is: Will Four Seasons design be impacted if neither of these agreements are recorded/obtained? The Town and it's agents will be reviewing plans that may be changed and will need to re-review the project over again. I know that Public Works may have suggested that this information can be submitted prior to the release of the G & E permit. I stated in the last meeting, held three weeks ago, that we need a complete submital for this phase of the project. That complete submital does include all adjacent property approvals. What guarantee will we obtain that the design will not change? None of us are afforded the time to revise and re-review documents. This has been an on-going issue since this project's inception and shall be put to rest with documentation that the approvals are in place. In discussion with all others involved in this process (Town of Vail Public Works, Fire & Planning), the G & E (Grading & Excavation) will be rejected and no review will occur until the agreements are submitted to us as a complete package to review. I would like to inform you that we should be making a final submittal for the G&E application by the end of this week. I or Mark Reed with Layton Construction Co. will submit 7 sets as discussed with Matt Royer. Included in the submittal should be a final book containing the G&E permit submittal and a submittal from Hill Glazier Architects containing the responses to the CIA letter dated Oct.23, 2007 and a final Life Safety Report. Two items will be missing from this submittal. The first is the final recorded construction easement from 9 Vail Rd. Condominiums, which is in process, and the CDOT lease for the wells and soil nail installation into S. Frontage Road. It is our understanding that we can make the submittal without these two documents and the final review process started understanding that the G&E permit would not be issued until these two documents are finally submitted.
