Re: the easement agreement, I have made changes and sent them to Art
Abplanalp for his review and counsel. Obviously we cannot do anything
with the agreement until we have seen the exhibits.
If we had the fire exit promised, we would shovel it. Gravel, which was
supposed to be only a stop-gap, is very difficult to shovel. I believe
Mike McGee wants to see a viable exit. You have had a full year to
address the pathway from the north exit.
The fencing Jim Heid installed did not have to be there and should come
out. What was needed was a barrier between our property and the
construction zone, and that is now leaning into the path and needs to be
moved to an upright position.
As this has material effect on our property and our operations, I wish
to be included, along with Tom Saalfed, in any discussions with Mike
McGee, not just told the outcome of your negotiations.

I was wondering if you have been able to review the easement
document that TJ's lawyer sent to you?. We would like to try and get
the language squared away as soon as possible. You said you might get
to it this past weekend. any progress?
Also, Mike McGee sent me a note that he had talked with you
about the north exit from the 1st floor being cleared of snow. I
realize that the sidewalk is not poured yet as I was hoping that Layton
would have been on site by now and would have been able to complete that
work. As it is, they are now just getting on site.
If the sidewalk were poured, how would you have handled the snow
removal? Because the sidewalk is not concrete but stone, I realize it
might cost more to handle the removal. We would be willing to pay the
additional cost of removal over the cost to remove the snow from a
concrete sidewalk.
Do you think this would be something that we can work out?
I believe that the stakes and fencing could be removed as the
grass that borders the walk path is in place. I will talk with McGee
about this before we finalize how to handle the snow removal.
