RE: Long Term Leasing of Parking and Improvements
Dear Mr. Cohn,
This letter is being provided in response to conversations the Community Development Department has had recently with representatives of Solaris and the potential buyer of two condominium
units within Solaris. It came to our attention that a contract to purchase two units at Solaris was being negotiated with the additional provisions to enclose several parking spaces
within the subterranean parking structure. The enclosure of several parking spaces within the parking structure with the intent of separating and privatizing a portion of the parking
area was brought to our attention as there were questions about the compliance of this proposal with the Town Zoning Code and the adopted Special Development District (SDD) No. 39, Crossroads.
George Ruther, Community Development Director, and Martin Haeberle, Chief Building Official walked the area proposed for enclosure to create a separated parking garage to ascertain the
specifics of the proposal. It is our finding that the four parking spaces proposed to be leased for a period of 10 years from the established private parking club would be in compliance
with the Vail Town Code and the adopted SDD so long as certain provisions are met. Those provisions are that the spaces are leased and ownership is not conveyed in any manner other
than a lease and are not transferable to others by the lessee. The garage enclosing the four parking spaces must be utilized for the sole purpose of parking cars and not cause a change
in use from the current Group S2 Occupancy as defined by Section 311.3 of the 2009 Edition of the IBC, as adopted by Title 10 of the Vail Town Code. All required building permits shall
be obtained prior to the start of any improvements. Furthermore, the design of the parking garage enclosure cannot cause a net decrease in available parking due to impacts to any of
the minimal standards for parking dimension and turning radius.
