DATE: December 17, 2010 (includes Town revisions) RE: Town Engineer requirements for 45 Forest Road – Vail, CO This letter is provided to confirm and establish our understanding of your Town Engineer requirements for Approval of Building Permit for the above noted project in accordance with our meeting this morning. We are clear on our understanding that no excavation or construction can take place without your review and specific written approval of the upcoming deferred submittals we discussed and that are listed below. As discussed and mutually understood this morning, we believe that this project, in concert with the proper installation of these engineered systems will: 1. Prevent the future failure of an aged retaining wall that is not entirely up to current engineering standards, thereby promoting long term road and utility stability; 2. Will cause parking to no longer exist along Forest Road as has been permitted since construction in the 1960’s; 3. Will facilitate improved snow removal and maintenance operations for this portion of Forest Road. Thank you for reaching this understanding with our design team. Upon our receipt of written notice of Town approval of this building permit, we will then be authorized to proceed toward meeting each condition and advancing the project in the following sequence: 1. Town Engineer & Town Council Approval: In order to gain the Town Engineer’s approval the applicant shall provide the geometric, graphic depiction for and engineers reporting of dimensional limits for permanent shoring and other items proposed to be situated and secured below grade within the Town Right-Of-Way. This work product will include Plan View, Cross-Section and text discussion committing to the depths, penetrations and locations of all such improvements, as well as a discussion on the soil conditions leading to the need for permanent shoring. The licensed firms contributing to these efforts include Coggins and Sons, Inc., Monroe & Newell Engineers, Inc., Alpine Engineering, Inc., Victor Mark Donaldson Architects and facilitated by J L Viele Construction, Inc. After review of said documents the request for encroachment into the Town ROW will be acted upon by Town Council. We further understand that the Town will be considering language for the pertinent Construction License Agreement requisite to governing these permanent improvements in the Town Right-Of-Way. 2. Additional Engineered and Stamped Documentation: Prior to the issuance of the approved building permit the applicant shall provide stamped, engineered construction documents prepared by Licensed Colorado Engineers that appropriately depict and detail the construction elements, placement and specifications for complete systems and including design parameters, safety factors and notations for your review and consideration. We will also circulate these documented Right-Of-Way improvements to each of the six Utility Companies and gain their approval and sign-off and then present to the Town as part of our obligation to assure compliance with associated parties. In concert with the above, assist and coordinate the review and endorsement of the Construction License Agreement noted above between the Town and property Owner. Thanks again to you and your staff for your review and consideration of these procedures to fulfill the initial requirements of the Town for this building permit application.
