Amendment to the 2002 N.E.C. Town of Vail Ordinance 4, Series of 2005 .
❑ Overhead services are not ailowed in the Town of Vail.
❑ Underground services sha// be in conduit (PVC) from the uti/ity transformer to the electric meter, main
disconnect switch, and to the first electrical distribution circuil breaker panel.
❑ The main disconnect switch shall be readi/yaccessib/e,and located next to the meter on the exterior wall of
the structure. All underground conduits are required to be inspected before back-filling the trench.
❑ In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are exempt.
❑ NM Cable (Romex) can be used on/y in sing/e and mu/ti-fami/y dwe//ings net exceeding 3 stories
Type NM cannot be used in any bui/ding mixed with Type A,B,E,F,H,I,M&S occupancies
❑ A/uminum conduct�orssmaller than size #8 are not permitted with the Town of Vail.

❑ All installations of exterior hot tubs or spa's require a DRB approval from planning.This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
❑ If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30"above grade, you must also obtain a building permit.
❑ If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platForm,
a structural engineer must review the existing condition and verify that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
❑ If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.
o If this permit is for a commercial space, two (2) sets of stamped drawings are required. E/ect�ica/
one-/ine and pane/schedu/es are�equired if/oad is added or dist�ibution is a/te�ed,

When applications for signs are submitted, the following
information is required:
1 . A completed sign/awning application (attached) .
2 . A site plan showing the exact location where the sign
is to be located.
3 . A photograph if possible and building elevation showing
the location of the proposed sign.
4 . A scaled drawing which details the design of the sign,
as follows :
(a) Colored exactly as sign will be.
(b) A list of materials to be used in sign (metal,
wood, canvas , paint, etc. )
(c) Photograph of sign if available.
(d) Specific lettering style and size.
5 . If an awning is proposed, submit drawings showing
exactly how and where the awning is attached to the
building and how the awning is to be constructed.
6 . Description of lighting that will be used in
conjunction with the sign or awning. If proposing an
awning, lighting is not allowed to shine through the
entire awning which calls undue attention to the
business . Lighting may spotlight only the actual sign
lettering on the awning.
RECOMMENDATIONS OR POINTERS
1 . Check sign code - verify site, height etc.
2 . Be specific. Vagueness on design, size, construction may
delay the approval of your sign.
3 . Measure frontage of business .
APPLICATION FEE WILL BE REQUIRED AT THE TIME OF APPLICATION
SUBMITTAL.
If this application requires a separate review by any local ,
State or Federal agency other than the Town of Vail, the
application fee shall be increased by $200 . 00 . Examples of such
review, may include, but are not limited to : Colorado Department
of Highway Access Permits , Army Corps of Engineers 404, etc .
The applicant shall be responsible for paying any publishing fees
which are in excess of 50� of the application fee . If, at the
applicant ' s request, any matter is postponed for hearing, causing
the matter to be re-published, then, the entire fee for such re-
publication shall be paid by the applicant .
Applications deemed by the Community Development Department to
have significant design, land use or other issues which may have
a significant impact on the community may require review by
consultants other that town staff . Should a determination be
made by the town staff that an outside consultant is needed to
review any application, Community Development may hire an outside
consultant, it shall estimate the amount of money necessary to
pay him or her and this amount shall be forwarded to the Town by
the applicant at the time he files his application with the
Community Development Department . Upon completion of the review
of the application by the consultant, any of the funds forwarded
by the applicant for payment of the consultant which have not
been paid to the consultant shall be returned to the applicant .
Expenses incurred by the Town in excess of the amount forwarded �
by the applicant shall be paid to the Town by the applicant
within 30 days of notification by the Town.

I. DESCRIPTION OF THE REOUEST
James and Leslie Glendining are requesting a sign variance to allow for a freestanding sign
designating a single business use located within the Mountain Haus. According to Section
16.20.020 of the Town of Vail Municipal Code,the applicants are allowed one 3 square foot sign
on the building wall ar hanging from a structural component of the building. In addition, the
applicant is allowed one Display Box(menu box) and one Daily Special Board by right. The
proposed freestanding sign will be located on Town of Vail property,therefore,requiring a
Revocable Right-of-Way Permit.
II. BACKGROUND
The proposed location of the freestanding sign has been host to previously approved signs. In
July of 1988,the Corona Cafe received approval to erect a sign on the end of the awning. The
sign was allowed to be a maximum of 3 square feet. In November of 1991,the Shogun received
approval to attach a sign to the awning pole. The sign was limited to a maximum size of 3 square
feet and was located directly above a Display Box. Most recently, The Salad Garden obtained
approval, in September of 1993, for a 3 square foot sign on the west awning. Staff, at the time,
approved the sign because it was considered to be a conrinuance of a pre-existing non-conforming
sign.
III. ('RITERIA AND FINDINGS
Upon review of Sections 16.36.050 and 18.62.060, Criteria and Findings, of the Town of Vail
Municipal Code, the Community Development Department recommends approval of the
requested sign variance. The recommendation for approval is based on the following factors:

A. Consideration of factors:
1. There are special circumstances or conditions applying to the land,
buildings,topography,vegetation, sign structures or other matters on
adjacent lots or within the adjacent right-of-way, which would
substantially restrict the effectiveness of the sign in question:
provided, however,that such special circumstances or conditions are
unique to the particular business or enterprise to which the applicant
desires to draw attention, and do not apply generally to all business or
enterprises.
The entrance to this business(The George)is unique because of the
existing landscaping. Many large aspen trees are located on the site, which
would substantially restrict the effectiveness of a wall mounted sign. For
the applicants to utilize the allowed wall sign would require the removal of
the existing aspens. The landscaping located adjacent to the entrance is a
unique situation at the west entrance of the Mountain Haus.
2. That such special circumstances were not created by the applicant or
anyone in privy to the applicant.
The applicant was not responsible for planting the aspens, therefore,the
applicant was not responsible for creating the special circumstances on
this particular property. However,the applicant chose to locate their
business in the Mountain Haus and place themselves in this situation.
3. That granting of the variance will be in general harmony with the
purpose of this title, and will not be materially detrimental to the
persons residing or working in the vicinity,to adjacent property, to
the neighborhood, or to the public welfare in general.
Staff believes the granting of the variance is in harmony with the purpose
of the Chapter 16.20 of the Town of Vail Municipal Code. The applicant
is requesting an alternative to the allowable signs for their business
location. The allowed sign size will remain within the required limits of the
Code.
4. The variance applied for does not depart from the provisions of this
title any more than is required to identify the applicant's business use.
The applicant is not requesting a variation in the amount of sign area
allowed on the site. Although the applicant is requesting a freestanding
sign,the sign area will not exceed the allowable 3 syuare feet. The

applicant is allowed an additiona10.5 square foot of sign area on a Display
Box,however,the applicant has agreed to eliminate the potentia10.5
square foot of signage. This agreement will eliminate the possibility of
having a multitude of signs on the site. Thus,reducing the likelihood of
visually detracting from the location. Overall, staff believes the requested
variance to install a freestanding sign for this business will enha.nce the site.
5. The relationship of the requested variance to other egisting or
potential uses and structures in the vicinity.
Staff believes the requested variance is reasonable and will not have
negatives impacts on other uses or structures in the area. The applicant is
not requesting a variance to the allowed sign area, therefore,the outcome
is not producing an advantage for The George, over other businesses in the
area.
6. The degree to which relief from the strict and literal interpretation
and enforcement of a specified regulation is necessary to achieve
compatibility and uniformity of treatment among sites in the vicinity
or to attain the objectives of this title without grant of special
privilege.
The applicant has requested the minimum amount of relief necessary
from Section 16.20 of the Town of Vail Municipal Code to obtain the
objectives of this title without resulting in a grant of special privilege.
Staff believes the proposed freestanding sign is in compliance with the
intent of Chapter 16.20 and additionally, that there are extraordinary
conditions which exists with this particular location.
7. The effect of the requested variance on light and air, distribution of
population, transportation and traffic facilities,public facilities and
utilities, and public safety.
The proposed freestanding sign will be in the Town of Vail's right-of-way,
however,the sign will not be located within the pedestrian corridor.
Consequently,the variance will not have any impact on the above
concerns.
B. The Planning and Environmental Commission shall make the followin�findin�s
before �ranting a variance:
1. That special circumstances or conditions apply to the land,building,
topography,vegetation, sign structures or other matters on adjacent lots or

Dear Sir/Madam,
Thank you for considering this particular application in regard to signage
at The George, 292 East Meadow Drive, Vail Colorado. We appreciate that
the codes have been set, but we believe that our situation warrants special
consideration.
The layolrt of the Bridge Street entrance to the Mountain Haus ineans that
any sign attached to the building is completely obscured by the trees and
bushes in the garden. The awning is owned by the Condominilun Association
and was replaced recently. We have been told tliat the Association will not be
to keen to have it replaced so soon after installation.
This leaves The George with only 1/2 square foot with which to make
custoiners aware of its naine and location. Which puts us at a severe
disadvantage. We are asking for pennission to have a naine sign of no more
than 3 square feet and a menu board in accordance wit11 town code. This
would mean that the square footage of signage would be no more than is
nonnally allowed in code, merely the content of one of the signs would differ.
The signs will be in keeping with overall iinage that Bridge Street projects
and will be attractive and simple. This will not give us any advantage over
any other restuarant in the village, but will simply enable us the same
allowances of every other Bridge Street business owner.

3. That the applicant shall notify the Town Manager, or his duly authorized agent, twenty-
four hours in advance of the time for commencement of construction, in order that
proper inspection may be made by the Town.
4. The applicant agrees to indemnify and hold harmless the Town of Vail, its officers,
employees and agents from and against all liability, claims and demands on account of
injury, loss or damage, including without limitation claims arising from bodily injury,
personal injury, sickness, disease, death, property loss or damage, or any other loss of
any kind whatsoever, which arise out of or are in any manner connected with
applicant's activities pursuant to this permit, if such injury, loss, or damage is caused in
whole or in part by, or is claimed to be caused in whole or in part by, the act, omission,
error, professional error, mistake, negligence or other fault of the applicant, his
contractor or subcontractor or any officer, employee or representative of the applicant,
his contractor or his subcontractor. The applicant agrees to investigate, handle
respond to, and to provide defense for and defend against, any such liability, claims, or
demands at the sole expense of the applicant. The applicant also agrees to bear all
other expenses relating thereto, including court costs and attorney's fees, whether or

may be revoked at any time for any reason deemed sufficient by the Town of Vail.
6. That the applicant will remove, at his expense, the encroachment, obstruction, or
structure within ten days after receiving notice of any revocation of said permit.
7. That the applicant agrees to maintain any landscaping associated with the
encroachment on the right-of-way.
8. That in the event said removal of the encroachmen�, obstruction, or structure is not
accomplished within ten days, the Town is hereby authorized to remove same and
have the right to make an assessment against the property and collect the costs or
removal in the same manner as general taxes are collected.

In consideration of the issuance of a revocable permit for the structure above indicated,
applicant agrees as follows:
1. That the structure herein authorized on a revocable permit basis is restricted
exclusively to the land above described.
2. That the permit is limited specifically to the type of structure described in this
application.
3. That the applicant shall notify the Town Manager, or his duly authorized agent, twenty-
four hours in advance of the time for commencement of construction, in order that
proper inspection may be made by the Town.
4. The applicant agrees to indemnify and hold harmless the Town of Vail, its officers,
employees and agents from and against all liability, claims and demands on account of
injury, loss or damage, including without limitation claims arising from bodily injury,
personal injury, sickness, disease, death, property loss or damage, or any other loss of
any kind whatsoever, which arise out of or are in any manner connected with
applicant's activities pursuant to this permit, if such injury, loss, or damage is caused in
whole or in part by, or is claimed to be caused in whole or in part by, the act, omission,
error, professional error, mista{<e, negligence or other fault of the applicant, his
contractor or subcontractor or any officer, employee or representative of the applicant,
his contractor or his subcontractor. The applicant agrees to investigate, handle
respond to, and to provide defense for and defend against, any such liability, claims, or
demands at the sole expense of the applicant. The applicant also agrees to bear all
other expenses relating thereto, including court costs and attorney's fees, whether or
not any such liability, claims, or demands alleged are groundless, false, or fraudulent.
The applicant agrees to procure and maintain, at its own cost, a policy or policies of
insurance sufficient to ensure against all liability claims, demands and other obligations
assumed by the applicant pursuant to this Paragraph 4. The applicant further agrees
to release the Town of Vail, its officers, agents and employees from any and all
liabiliry, claims, demands, or actions or causes of actions whatsoever arising out of any
damage, loss or injury to the applicant or to the applicant's property caused by the
Town of Vail, its officers, agents and employees while engaged in maintenance or
snow removal activities or any other activities whatsoever on Town of Vail property,
streets, sidewalks, or rights-of-way.

' 5. That the permit may be revoked whenever it is determined that the encroachment,
obstruction, or other structure constitutes a nuisance, destroys or impairs the use of
the right-of-way by the public, constitutes a traffic hazard, or the property upon which
the encroachment, obstruction, or structure exists is required for use by the public; or it
may be revoked at any time for any reason deemed sufficient by the Town of Vail.
6. That the applicant will remove, at his expense, the encroachment, obstruction, or
structure within ten days after receiving notice of any revocation of said permit.
7. That the applicant agrees to maintain any landscaping associated with the
encroachment on the right-of-way.
8. That in the event said removal of the encroachment, obstruction, or structure is not
accomplished within ten days, the Town is hereby authorized to remove same and
have the right to make an assessment against the property and collect the costs or
removal in the same manner as general taxes are collected.
9. That the applicant has read and understands all of the terms and conditions set forth in
this application.

When applications for signs are submitted, the following
information is required:
1 . A completed sign/awning application (attached) .
2 . A site plan showing the exact location where the sign
is to be located.
3 . A photograph if possible and building elevation showing
the location of the proposed sign.
4 . A scaled drawing which details the design of the sign,
as follows :
(a) Colored exactly as sign will be.
(b) A list of materials to be used in sign (metal,
wood, canvas, paint, etc. )
(c) Photograph of sign if available.
(d) Specific lettering style and size.
5 . If an awning is proposed, submit drawings showing
exactly how and where the awning is attached to the
building and how the awning is to be constructed.
6 . Description of lighting that will be used in
conjunction with the sign or awning. If proposing an
awning, lighting is not allowed to shine through the
entire awning which calls undue attention to the
business . Lighting may spotlight only the actual sign
lettering on the awning.
RECOMMENDATIONS OR POINTERS
1 . Check sign code - verify site, height etc.
2 . Be specific. Vagueness on design, size, construction may
delay the approval of your sign.
3 . Measure frontage of business .
APPLICATION FEE WILL BE REQUIRED AT THE TIME OF APPLICATION
SUBMITTAL.
If this application requires a separate review by any local,
State or Federal agency other than the Town of Vail, the
application fee shall be increased by $200 . 00 . Examples of such
review, may include, but are not limited to: Colorado Department
of Highway Access Permits, Army Corps of Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees
which are in excess of 50� of the application fee. If, at the
applicant's request, any matter is postponed for hearing, causing
the matter to be re-published, then, the entire fee for such re-
publication shall be paid by the applicant.
Applications deemed by the Community Development Department to
have significant design, land use or other issues which may have
a significant impact on the community may require review by
consultants other that town staff . Should a determination be
made by the town staff that an outside consultant is needed to
review any application, Community Development may hire an outside
consultant, it shall estimate the amount of money necessary to
pay him or her and this amount shall be forwarded to the Town by
the applicant at the time he files his application with the
Community Development Department. Upon completion of the review
of the application by the consultant, any of the funds forwarded
by the applicant for payment of the consultant which have not
been paid to the consultant shall be returned to the applicant.
Expenses incurred by the Town in excess of the amount forwarded
by the applicant shall be paid to the Town by the applicant
within 30 days of notification by the Town.

In summary, Ordinance No. 6 states that it is unlawful for any
person to litter, track or deposit any soil, rock, sand, debris
or material, including trash dumpsters, portable toilets and
workmen vehicles upon any street, sidewalk, alley or public
place or any portion t.hereof. The right-of-way on all Town of
Vail streets and roads is approximately 5 ft. off pavement.
This ordinance will be strictly enforced by the Town of Vail
Public Works Department. Persons found violating this ordinance
will be given a 24 hour written notice to remove said material.
In the event the person so notified does not comply with the
notice within the 24 hour time specified, the Public Works
Department will remove said material at the expense of person
notified. The provisions of this ordinance shall not be
applicable to construction, maintenance or repair projects of
any street or alley or any utilities in the right-a-way.
To review Ordinance No. 6 in full, please stop by the Town of

Dear Scott,
I have reviewed the plans submitted for a building permit application for The Salad Garden in the
Mountain Haus space formerly occupied by Shogun. My review of the plans has generated the
following comments.
(1) The existing vegetable prep sink must be equipped with a right hand drainboard if left in the
existing location combined with a re�ocation of the ice machine OR the vegetable prep sink
may be relocated and a drainboard attached either left or right.
(2) The pizza prep area in the kitchen needs to have a drop-in cold pan set-up, not to have pizza
toppings iced in a hotel pan for pizza preparation.
(3) There is additional detail required for the dishmachine. If a high temperature machine is to
be installed it must be provided with a Class II or Type II condensation hood. Equipment
specifications are required for either type of machine.
(4) If the existing two compartment sink is to be used to fill mop buckets it must be provided with
a threaded faucet connection and a backflow prevention device. This two compartment
sink must be upgraded to a three compartment sink with fixed drainboards left and right
prior to the opening of the 1994-95 ski season.
(5) The walk-in cooler where the separation panel between the old freezer and cooler has been
removed must be properly finished, sealed and the floor re-tiled.
(6) Blue prints do not indicate an employee locker area in the office, however this must be
designated as personal belongings are not to be stored in service areas, dry storage
rooms or other food preparation areas throughout the establishment.
(7) There is some confusion about the specific equipment being used in the salad bar/food line
areas. Some of the equipment specification sheets indicate ice cooled cold pans which
will not be accepted for this new installation. All cold units must be mechanically cooled.
There is also some question as to the type of sneeze guard application to be used for all

of the buffet/service lines.
It should be noted for future reference that all heating of food products for service is to occur in
the back kitchen on the stove. Products need to be brought to temperature before being placed
in hot holding units for service. Soup warmers and steam tables are not acceptable methods for
heating products to temperature for service.
The lack of complete plans at this point, based on timing constraints on the owner's behalf,
causes this department a certain degree of concern. Approval for this building permit is given
conditionally provided the above noted items are addressed and with the stipulation that any items
in the buffet service area which do not meet code requirements will be corrected prior to the
issuance of a food service license and approval for opening.

In summary, Ordinance No. 6 states that it is unlawful for any
person to litter, track or deposit any soil, rock, sand, debris
or material, including trash dumpsters, portable toilets and
workmen vehicles upon any street, sidewalk, alley or public
place or any portion thereof. The right-of-way on all Town of
Vail streets and roads is approximately 5 ft. off pavement.
This ordinance will be strictly enforced by the Town of Vail
Public Works Department. Persons found violating this ordinance
will be given a 24 hour written notice to remove said material.
In the event the person so notified does not comply with the
notice within the 24 hour time specified, the Public Works
Department will remove said material at the expense of person
notified. The provisions of this ordinance shall not be
applicable to construction, maintenance or repair projects of
any street or alley or any utilities in the right-a-way.
