Vail Village Inn - Phase V: Request for Change to Approved Plan
Thank you for taking the time to speak with me yesterday. The Phase V HOA Board has decided to apply for a change to
the approved plan, as we had discussed. I have instructed our roofer, Turner Morris, to come by first thing this morning
(as soon as possible, anyway) to fill in whatever application paperwork is required to request a change to the approved
plan for our building's roofing color and to provide the fee. I am sorry that I won't be able to attend the meeting next
week, but I will be traveling at that time. However, I'd like to state that there has been considerable push back by the
Phase V owners and provide you, the Staff and the DRB members their thoughts and rationale for why we feel our
original color choice should be honored and approved. We only seek to change this narrow portion of the plan and are
working diligently with Turner Morris to resolve the snow retention and sidewalls issues.
As you may recall, the original color choice was a darker brown color named Mountain Blend. The DRB, however,
approved a lighter color called Autumn Blend under the theory, as I understand it, that as part of the former Vail Village
Inn complex, all buildings in the complex should appear the same and Campo di Fiori's roof is Autumn Blend. After
seeing a sample of Autumn Blend, several owners expressed a strong preference in favor of the darker Mountain Blend
color and against the Autumn Blend selction, and for the following reasons, Phase V requests the approved plan be
granted a change.
First, we selected our original color choice from the Town of Vail's own approved colors list. Indeed, why bother having
an approved list if color selections from it are being rejected?
Second, we did not pick the color randomly. It better matches what is on the building today: a dark brown roof. It also
better matches other adjacent properties (Sonnenalp, Sebastian, Phase III and 9 Vail Road for example).
Third, the owners of Phase V will have to live with the color for the next roughly 50 years. I don't know where each DRB
member lives, but if it were in this building, as long as they wanted a color from the pre-approved list, I would hope that
they would expect their choice be honored.
Third, this is not a question of safety. It is, rather, one of aesthetics. There is no basis for the DRB to substitute its own
aesthetic opinion for ours. Indeed, we feel our judgment is more carefully thought-through and considered, as we will
have to live with it for a long time and will be writing a sizable check for it. DRB members may never once even look at
our roof color after it's up, yet we will see it every day.
Fourth, the DRB apparently demands that we conform our color to that of the Campo di Fiori building. While we are a
part of the same original property, each building on the property has gone in different directions from that point. Phase
III, Phase IV (d/b/a The Sebastian Hotel) and Phase V are the larger properties, and a smaller property's color choices
shouldn't be dictating to the larger properties. Indeed, on the former Vail Village Inn complex (all phases), there are so
many different roofs and exterior finishes now, it defies credibility to say there is or remains an overall "plan". Further,
from a process standpoint, if Phase V was, in the DRB's mind, subject to Campo di Fiori's roofing color palette choice, we
strongly feel it was necessary for Phase V to have been informed by proper notice and given an opportunity to provide
our opinions and make comments at the time Campo's application was under consideration. As we received no notice,
there was no due process. Moreover, we feel that because no notice was given and no discussion was had with our
input with respect to binding Phase V's roofing color choice by another's choice, the DRB's decision to bind us to
Campo's color choice is not proper or effective.
Fifth, due to the fact that the Sebastian hotel was not required to conform to a similar color choice (or, perhaps, more
accurately, Campo's later-approved color choice actually doesn't conform and represents the deviation from other
existing Vail Village Inn complex properties...including Phases III and V...and the freshly-constructed Sebastian) would
indicate that the DRB is seeking to enforce an unknown and confused "plan" against us, yet isn't enforcing it against
others in the complex. Indeed, as further evidence, I submit that the building that houses Annie's (Phase III) is now
painted a tan color, while other original buildings remain white. And, the Sebastian remains an oddity either way in this
regard, as they've had entirely different finishes approved. To suggest then, that there is an overall plan for the Vail
Village Inn complex seems false, and to hold us to one is unfair and unjust when other buildings on the property have
been approved to do, apparently, as they like even though their choices deviate from the original color scheme.
Sixth, while we concede that Campo di Fiori is a part of the former Village Inn Plaza property, since the individual
buildings were sold and turned over to their owners, they have been self- and separately-governed, maintained and
operated. So, for the DRB to create an implied aesthetic "relationship" between Campo de Fiori and Phase V now is
inappropriate and based on nothing more than the DRB's desire for uniformity. There may have been one at one time,
but today, no such relationship exists other than by perceived proximity and a historical name.
Seventh, regarding uniformity, if the DRB wishes for us to be more "uniform" in our color choice with other properties, it
is far more appropriate for our property to be similar to the immediately-adjacent properties: The Sebastian Hotel, The
Sonnenalp Hotel and the Masters Gallery/Grappa/Osaki's building. All three of which have a darker shade more
comparable to the color we originally selected. If, however, in the alternative, the DRB is arguing that it actually wants
color contrast as opposed to uniformity, then it was still up to the DRB to inform us at the time the other properties
chose their roofing color options that their choice would impact our choice. Again, the DRB was deficient in this
regard. Further, if the DRB wishes for contrast, presumably it has a"plan" and isn't just making decisions on an ad hoc
basis. If there is a relevant, applicable plan, we are unaware of it, and thus, assuming we have selected our color choice
from the pre-approved list, there is no basis upon which to refuse it.
Eighth, there is a consistently darker color choice on newer buildings in Vail Village. This includes the Solaris, Sebastian
and Four Seasons properties. So, for the DRB to depart from this represents an aesthetic choice that is inconsistent with
what has recently been approved.
For all these reasons, we request that our original color choice be approved and the plan changed. We and our roofer,
Turner Morris, are prepared to move forward as soon as approval is granted on May 18th.
