2. If the propased Insured has ar acquired actual knowledge of any defect, lien, encumbrance, adverse cl�im or ather
matter affecting the estate or interest or mortgage thereon covered by this Ct�mmitment other than thase shown in
5cheduie B hereaf, and shall fail to disclose such knowledge to the Comp�ny in writing, the Ccrmpany shala be relieved
from liabilit}+ for any loss or damage resulting f�om any act of reli�ncs hereon ta the extent the Company is prejudiced
by failure to so �isclose such knowledge. If the proposed Insured shall disclose such knowledge to the Campany, or if
the Company othetwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other
matter, the Company at its option may amend Schedule B of this Cammitment accordingiy, but such amendment shali
not relieve the Cr�mpany fram liability previc�usly incurred pursuant ta paragraph 3 of these Conditions.
3. �iabilityr of the Company under this Cammitment shall be only ta the named proposed Insured and such parties
included under the definition af Insured in the form af policy or palicies cammitted for and only for actual loss incurred in
reliance hereon in undertaking in good faith (a) to ccamply with the requirements hereof, ar {b} to �iminate exceptic�ns
shawn in Schedule B, or (c) to acquire or create the estate or interest or mo�kgage thereon cc�vered by this
Commitment. In no event shall such liability exceed the amraunt stated in Schedule A for ths policy or paEicies
committed for and such liabiiity is subject to the insuring provisic,ns and Conditions and the Exciusions from Goverage

The Town Staff does not want any applicant to "do a bunch of additional work if it ends up being redundant and
unnecessary." However, the information submitted with every design review application must be sufficient enough to
demonstrate compliance with the standards and guidelines of the Vail Town Code. Attached for reference is an
Application for Design Review Addition — Residential or Commercial form.
Since our last discussion, I have continued to research the Town's archives on your behalf. Please find attached the
Ridge at Vail plat, the Aspen Grove Townhomes plat, the April 23, 1992 Aspen Groves Townhomes zone check sheet, the
May 22, 1992 Aspen Grove Townhomes building permit plans with revised zone check calculation notes, and an August
4, 2000 letter concerning the Dauskurdas addition at the Aspen Grove Townhomes. Please note that some calculations
on the May 22, 1992 approved building permit plans are not the same as those on the April 23, 1992 zone check sheet.
I received your voicemail message asking if the Design Review Board will be reviewing the Feistmann addition
application (DRB110173) at its June 15t" public hearing. The Feistmann application will not be reviewed by the DRB on
June 15t". The submittal deadline for tomorrow's meeting was May 23, 2011. As identified in my June 3rd email:
"The Town of Vail has received the design review application for a 250 Addition to the Friedman Residence at
1455-A Ridge Lane (Aspen Grove TownhomesJ. As we discussed Dave, this application as submitted is
incomplete. The following items must be submitted to complete this Addition design review application:
• Home owner's association approval letter (if Marc Garrett is not authorized to sign for 1480-A and 1480-
8J
• Title report schedules A& e
• Utility approvals and verification forms
• Stamped topographic survey
• Landscape plan
• Exterior lighting plan and fixture cut sheets
• Site developmentstandards calculations (GRFA, site coverage, landscaping area, parking, etc.) and red-
lined plans showing how the standards were calculated.
• Exterior building materials list
"...Please be aware that this proposal can not be scheduled for a Design Review eoard hearing date until a
complete application has been submitted."
As stated on the Application for Design Review Additions — Residential and Commercial:
"Submit all required information under the submittal requirements section of this application by the deadlines
stated above. Incomplete applications will not be processed."
Thank you for submitting the Joint Property Owner Letter from the home owners association signed by Mr. Balloun with
your June 8t" email.
As identified in the June 8t" email, it appears that you were misinformed by our office that a title report is not required
to be submitted with a 250 Addition application. The Town of Vail requires title reports for addition applications,
including 250 Additions. However, due to this miscommunication we will not require one to be submitted with this
proposal.
The June 8t" email we received stated that "it was our understanding that the utility verification sign off sheet is required
for new construction and not for additions." The utility approval & verification form is required for both new
construction and additions, thus the form is included in the Application for Design Review Addition — Residential or
Commercial form. At times Staff has waived this requirement for minor additions constructed within an existing building
footprint. Staff does not typically waive this requirement for additions constructed outside the existing building
footprint such as the proposed Feistmann addition. On more than one occasion there have been conflicts between
proposed additions and utilities, since some existing utilities in Vail are not located within a platted easement. Utility
locates are not a substitute for completing and submitting the required utility approval & verification form.
Included in the attached Aspen Grove building permit plans are ILC's (improvement location certificates) from the
original 1992-1993 construction. Since these plans are nearly 20 years old, they may not accurately reflect the
conditions of the Aspen Grove Townhouse as they exist today. Either submit a new survey for the subject properties or
field verify the archived surveys and submit a written statement stamped with your architects seal attesting to their
accu racy.
As stated in the Application for Design Review Additions — Residential or Commercial form the allowable, existing ,
proposed, and total Gross Residential Floor Area (GRFA) and site development calculations (landscaping, site coverage,
building height, setbacks, parking spaces, etc.) must be submitted.
There has been no re-calculation of the GRFA existing on the subject properties since the July 20, 2004 amendments to
the GRFA regulations; so the GRFA calculations on the attached 1992 zone check sheet and building permit plans are no
longer accurate or valid. Updated GRFA calculations for all four units of the Aspen Grove Townhomes must be
submitted demonstrating that the proposed Feistmann addition is in compliance with the GRFA limits prescribed by the
Vail Town Code. The attached building permit plans may be helpful to you in completing these calculations. As we have
discussed, the four units of Aspen Grove Townhouses are one development site for zoning purposes. The subject
development site is zoned Residential Cluster District; however, the Vail Ridge plat limits the combined GRFA of the four
Aspen Grove Townhouse units to a total of 6,600 sq.ft. While dwelling units in the Residential Cluster District
constructed prior to November 30, 1995 are eligible to utilize the Additional GRFA (250 Ordinance) provisions of the Vail
Town Code, an application for a 250 Addition can not be processed without the submittal of accurate GRFA calculations
demonstrating that all the allowable GRFA has already been constructed. As noted in my June 3rd email:
"Pursuant to Section 12-15-5-C-6, Applicability, Vail Town Code, 'nor shall any application be made for additional
GRFA until such time as all the allowable GRFA has been constructed on the property.' Therefore, GRFA
calculations for all four townhouse units must be submitted demonstrating that the 6,600 square feet of
allowable GRFA has already been constructed before a request for a 250 Addition can be processed. Please be
aware that on July 6, 2010 the Vail Town Council denied an ordinance to repeal this requirement of the Vail Town
Code."
The May 22, 1992 approved building permit plans include landscaping area calculations of 21,734 sq.ft. (min 21,690
sq.ft.). This landscape area calculation indicate that only 44 sq.ft. of landscaping area (which includes "hardscape" such
a decks and patios) can be removed, so the Feistmann addition removing 250 sq.ft. of landscaping does not comply with
the standards of the Vail Town Code. However, there is a note on the May 22nd landscaping calculations that states "a
few extra spaces undidged, minimum requirement met, number & size matches DRB" which implies 21,734 may not
include every sq.ft. of landscaping. Updated landscaping area calculations, reflecting today's conditions and
demonstrating compliance with the Vail Town Code, must be submitted to complete this application.
It is unclear from the submitted application if the proposed Feistmann addition includes the installation of any new
exterior lights. If new lights are proposed, fixture counts and fixture cut-sheets must be submitted. If the Fiestmann
addition does indeed utilize the "250 Ordinance" additional GRFA provisions, any existing non-conforming exterior lights
must be replaced with new full cut-off style fixtures and fixture counts and fixture cut-sheets must be submitted.
Included in the Application for Design Review Additions — Residential and Commercial is the Proposed Materials
form. Please complete and submit this form. If new materials and colors are to match the existing building, please note
that on this form.
Similar to the issues identified in the attached August 4, 2000 letter to Galen Aasland, any proposed addition to the
Fiestmann Residence must comply with the parking requirements of the Vail Town Code. Therefore, GRFA calculations
and parking space number calculations must be submitted to verify that the proposed addition complies. If the
proposed addition increases the required number of required parking spaces, a revised site plan must be submitted
showing the locations of said new spaces.
Once again, please submit the additional information and plan revisions necessary to address these items and
demonstrate that the proposed Feistmann addition complies with the requirements of the Vail Town Code. Please be
aware that this application can not be processed until the application is complete.

The Town Code provisions granting the 425 sq.ft. GRFA bonuses (2 units x 425 = 900) referenced on the 1992 zone check
were eliminated with by 2004 GRFA amendments, so you are correct in disregarding those numbers. Assuming that the
7,197 sq.ft. was calculated using today's adopted GRFA calculation methodology, then we can proceed with utilizing the
250 Ordinance.

Regarding the TOTAL project GRFA for Aspen Grove Townhomes, Lot 2, 2�d Amendment to The Ridge at Vail, we have
calculated the current GRFA for all 4 units per the 2004 Ordinance 14. The current total is 7,197 SF for the entire project.
Per the original plat, Lot 2 is limited to 6,600 SF of GRFA. Also, per the April 23, 1992, project zone district worksheet,
900 SF of one-time credit was added to make a grand allowable total of 7,500 SF.
Disregarding the 900 SF 1992 credit, our current total of 7,197 SF exceeds the 6,600 SF per plat. We assume we are
safe to proceed with our original 250 SF addition.
Could you please reply by the end of the work day today, Friday, 6-17-11, since we are planning on working on this over
this coming weekend.

Hi, again.
Forgot to mention in the earlier email that the "globe" you see hanging down in the fixture in the photo is one of those
over-sized round light bulbs. By simply putting in a more standard size bulb, the bulb itself doesn't hang down below the
bottom of the fixture. Checked it out at Vail Lights and it's a Kichler "Seaside" in either an Old Brick or Olde Bronze finish.
On Feistmann's, we should simply be able to get 3 new matching fixtures (the new one by the addition roof deck door and
the two old ones by the entry and the garage) and change out the bulbs in the 2 existing ones at the deck and patio.
Hopefully that will put the final bullet into the mouse that roared! Ha!

The Town of Vail has received the design review application for a 250 Addition to the Friedman Residence at 1455-A
Ridge Lane (Aspen Grove Townhomes). As we discussed Dave, this application as submitted is incomplete. The following
items must be submitted to complete this Addition design review application:
• Home owner's association approval letter (if Marc Garrett is not authorized to sign for 1480-A and 1480-B)
• Title report schedules A& B
• Utility approvals and verification forms
• Stamped topographic survey
• Landscape plan
• Exterior lighting plan and fixture cut sheets
• Site development standards calculations (GRFA, site coverage, landscaping area, parking, etc.) and red-lined
plans showing how the standards were calculated.

The Aspen Grove Townhomes are a single development site (Lot 2, Ridge at Vail) zoned Residential Cluster District. The
provisions of the Residential Cluster District apply to the Aspen Grove Townhomes as a single entity. All proposed plans
