(Initia/ he e) State of Colorado Asbestos Testing & Abatement Requirements Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex- posure to harmful asbestos. It is your responsibility to be in compliance with the State. Please contact the State directly for their requirements at the contact info listed below. When is asbestos testing required? ANY building projects disturbing more than these threshold levels of building materials require asbestos testing: One- and Two-Family Dwellings: 32 square feet All Others (commercial spaces, hotel rooms, etc): 160 square feet Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including multi-family/condominium units, and fractional fee units. Asbestos testing results must be provided with your application for a building permit. Tests which identify POSITIVE results at more than 1% require abatement by a State-certified abatement contractor. The clearance letter must be submitted to the Town of Vail before the building permit will be issued. Project Checklist My project falls into the category checked below: /- Will not disturb more than the threshold limits identified above. Tested negative, or at 1% or below (1 copies of test results included) Tested positive at more than 1%, requires abatement (1 copies of test results included) Tips & Facts: • Even recent construction projects may include asbestos-containing materials, so buildings of age require testing. • The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit Court of Appeals vacated much of the so-called "Asbestos Ban and PhaseouY' rule and remanded it to the EPA. Thus, much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce of many asbestos-containing product categories was set aside and did not take effect." - CDPHE Asbestos test results and abatement permit applications should be submitted to: Town of Vail, Community Development, 75 S Frontage Rd, Vail, CO3 81657. (D9g performed a limited asbestos inspection and performed asbestos buik-snpling within the commeraai unit lor, ated at 196 Gore Creek Drive, lit 164, VI, Colorado, in order to identify potentially hazardous friabte d non-frile asbestos- oontning materis (ACM). 7he unit will undergo some minor remodeling as it is oonverted into a liquor store. The Colorado Department of Public Health and Environment's (CDPHE) Regulation 8, Part B defines an asbesto.oontaining matrial (A as a material oontai ni ng more than 1% asbestos. Mr. Shurtliff oolleded a tot of eight (8) asbestos butk-sarnples from the following loctions within the unit: Drywal I Texture Type 1- Troweled Texture • Northeast Room - North Wt • Main Room - North Wall • Main Rom - East Wall Drywal I Texture Type 2- 9nooth Texture • Bathroom - North Walt • Bathroom - Ft Wall • Bathroom - East Wal I Cay Floor Tile • Main Room Under Crpet (.rpet Mastic • Main Room Under Crpet A!I eight (8) bulk-samples were alyzed by a National Voluntary Labortory Aoaedita#ion Pogram (NVLAP aoaedited lab in Denver, Colorado. AII eit (8) bulk-samples reported as nonedetec for os - (seeAppendix 8 for labaratoryrepor-t). 2 acr avERVi Ew 1. i ntroduction A limited asbestos inspedion and bulk-sanpling for ACM was oonducted within the ommeraal unit located at 196 Oore C7eek Drive, Unit 164, VI, Colorado, by Mr. Shurtliff on May 31, 2011 at the request of MRT Wines, Inc. Mr. 9urtliff is a Gblorado State Crtified Building Inspector; having A Aoaeditation #15413 (see qppr►dix A for oertificate). The purpose of the inspecion was to identify, sample d s potentially hazardous friable d non-friable ACM within portions of the unit that may be impaded by renovation adivities. II. rudural Design The strudure is a wood-frned, singlelevel, commeraal unit. III. SamplingandAnalytical Procedures The inspection, assment and sarnpling were oonduded by EPA and AHF2A aoaedited Building tnspedor quified by experienoe, education and trning in the reognition of potenti ACM d approved bulk-sarnpling techniques. The asbestos bulk-sarrtpling was eonducted on suspect ACAA with a limited number of bulk-sarnples being clleded within the unit. The inspedion, assessrnent d snpling were performed in a000rdoe with Environmentad Protection Agency/AHERA reoommended prooedures. These prooedures call for the visu inspection of the ar of oonoern and the oollection and anysis of reprtative bulk-samples of susped material. Some minor destructive sampling was oonduded. WIs, oolumns d perimeter pipe chases were not broken into in order to locteand qutify suspect ACM. It should benoted that additional ACM might be located in these d other inaooessible aras. Random bulk-samples, representative of the suspect asbestos-oontning building materials (ACSM) of each homogeneous area (HA), were oolleded a000rding to the guidelines published as Environmental Protedion Agency (Epq) Fin faule: Title II of the Toxic SLbstoes tbntrol Act (T9CA),15119 Sctions 2641 through 2654 and in oomplianoe with 40 CFR, Part 763. Representative sarnpling is bsed on the following criteria: 1. Thedistribution of thesusped material throughout theHA. 2. The suspect material's physical characteristics and pliqtpon, 3. Rdom sampling patterns determined for each HA SLsped materis sampled ad anyzsd should be oonsidered to be representative of materials in ach HA if they exhibit simil physical characteristics and the application of the sampled material cn be oarelated to the application of un-sarnpled materi. Bulk-samples oolleced were yzed utilizing the EPA's Method for the Determinatirn nf ;„ R•,;n ilding Ma[plC7%J (EPA 600/ R/ 116, ,tly, 1993) and the McCrone Research Institute's The Aos Partide Atlat as methods referenoes. Analysis of the bulk-samples was performed on the "date reported," as listed in the bulk-sample anysis report. 3 IV. Noteson Report Format SUspect materials alike in appearanoe and application were sampled as HAs. SLspect materiais were divided into three dassifications: 1. 3rrfaangMaterial: sprayed or troweled onto strudur building member. 2. Thermal rstan Insulation (T9): any type of pipe, boiler, tank, or duct insulation. 3. Misr, llaneous Material: other susped materials, floor tile, sheet vinyU lino{eum, oeiling tiles, insulation, d finishing materis. Cbndition assessnents were performed by the aaredited inor at the time of inspection. Gbndition assessments e listed in the following section. Ratings of "good," "damaged," and "siificantly dnaged" are meant to indicate the overall condition of the material. A material in "good" oondition has no visible damage or deterioration, or showing only very limited dnage or deterioration. A material in "damaged" condition has the following characteristics: The surfaoe is crumbling, blistered, water-stained, gouged, marred or otherwise abraded over less than on tenth of the surfaoe if the damage is evenly distributed (one-quarter if the damage is lotized). Accumulation of powder, dust or debris similar in appearoe to the suspect materi on surfaoes benth the materi ct be used as oonfirmatory evidertoe. A material in "significantly damaged" oondition has one or more of the following characteristics: • The surfaoe is cxumbling or blistered over at least one-tenth of the surfaoe if the damage is evenly distributed (onequarter ifthedamageisloclized). ohe-tenth (onequarter, if localized) of the materi is hanging from the surfaoe, deteriorated, or showing adhesive failure. • Water stains, gouges, or mars are over at least one-tenth of the surfaoe if the damage is evenly distributed (one-quter if the damage is localized). Aocumulation of powder, dust or debris similar in appearoe to the suspect materi on surfaoe,s beneath the material pn be used as oonfirmatory evidenoe. Response-action reoommenda#ions for os-oontning HAs are listed in the sedion VII. Recommendations may be for more than one HA, if materis are alike. Reoommendations are either "general" or "immediate." An immediate recommendation indicates the presence of asbestos greater th 1% within the bulk-sarnple, or a bulk-sample in the sne HA, and should be addressed acoordiny. A gener reoommendation indicates asbestos does not exist grter th 1% within the bulk-snple, or all bulk-sarnples in the same HA, and no further abatement adivities are required for removal of the material. Any sample reporting a"TRACE" amount of asbestos must be considered to be positive for os greater than 1% unless it is yzed by the pa nt-oount method to be less than 1%. V. Inspedor Comments No os-oontning material was identified during the bulk-sarnpling oonducted a# 196 Gore O-eelc Drive, Unit 164, Vail, Colorado. A tot of eit (8) bulk-samples of two (2) types of drywl texture, floor tile and carpet mastic were oolleded with ail eight (8) bufk-samples reporting as nonde#ect for asbestos. 4 VI. HomogeneousArea Descriptions The foilowing sedion oont ns sampled HA de.saiptions d sample locations. Pieroent-asbestos ontt for ch sample indicated cn vary depending on sample loctions, homogeneity of the materials, and typeofapplication. NNone-deted. "The quarrtities of materials listed ln this report are general approcimations uaed specifically to determine the number aF bulk-samples of eh material to be cdlected. Theae quartlties should not be used for any other purpose. On-site veriflcatian of the exact quantity of material is required ior bidding purpoes. 5 VI. Reooinmendations GENERAL: The laboratory results of the potential ACM sampled at 196 Gbre C7eek Drive, Unit 164 Vail Colorado, indicate the bulk-snples of drywal, floor tile and crpct mastic oollected from the unit reported as none-deted for asbestos. Trace or "<1" indicetes asbestos was identified in thc sample, but the concentration is less then I%. • All regulated asbestos minerals (i.e. chrysotile, amosite, crocidolite, anthophyllite, tremolite, and actinolite) were sought in every layer of each sample, but only those asbestos minerals detected are listed. Amosite is the common name for the asbestiform variety of the minerals cummingtonite aad gronterite. Crocidolite is the common name used for the asbestiform veriety of the minerel reibekite. ♦ Tile, viayl, foam, plastic, and fine powder saznples may contein asbestos fibers of such smell diameter (< 0.25 microns ia diamcter) that t6ese fibers cannot be detected by PLM. For such samples, more sensitive analytical methods (e.g. TEM, SEM, and XRD) are rocommended if greater certainty about asbostos content is required. Semi-quantitative bulk TEM floor tile enalysis is accepted under the NESHAPS regulatioas. • These results are submitted pursuant to Aerobiology Laboratory Associates, Inc.'s cunent tema and condirions of sale, including the compeny's standard warranty and Iimitation of liability provisions.
