Asbestos Testing & Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. It is your responsibility to be in compliance with the State. Please contact the State directly
for their requirements at the contact info listed below.
When is asbestos testing required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 32 square feet
All Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including
multi-family/condominium units, and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified abatement contractor. The
clearance letter must be submitted to the Town of Vail before the building permit will be issued.

• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and PhaseouY' rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

oh May 31, 2011, Mr. Steve Shurttiff with D6 Consulting, Inc. (D9g performed a limited asbestos
inspection and performed asbestos buik-s�npling within the commeraai unit lor,ated at 196 Gore Creek
Drive, l�it 164, V�I, Colorado, in order to identify potentially hazardous friabte �d non-fri�le asbestos-
oont�ning materi�s (ACM). 7he unit will undergo some minor remodeling as it is oonverted into a liquor
store.
The Colorado Department of Public Health and Environment's (CDPHE) Regulation 8, Part B defines an
asbesto.�oontaining mat�rial (A� as a material oontai ni ng more than 1% asbes�tos.
Mr. Shurtliff oolleded a tot� of eight (8) asbestos butk-sarnples from the following loc�tions within the
unit:

1. i ntroduction
A limited asbestos inspedion and bulk-sa�npling for ACM was oonducted within the o�mmeraal unit
located at 196 Oore C7eek Drive, Unit 164, V�I, Colorado, by Mr. Shurtliff on May 31, 2011 at the request
of MRT Wines, Inc. Mr. 9�urtliff is a Gblorado State C�rtified Building Inspector; having �A
Aoaeditation #15413 (s�ee qpp�r►dix A for oertificate). The purpose of the inspec�ion was to identify,
sample �d �s potentially hazardous friable �d non-friable ACM within portions of the unit that may
be impaded by renovation adivities.
II. �rudural Design
The strudure is a wood-fr�ned, single�level, commeraal unit.
III. SamplingandAnalytical Procedures
The inspection, a�ssment and sarnpling were oonduded by � EPA and AHF�2A aoaedited Building
tnspedor qu�ified by experienoe, education and tr�ning in the re�ognition of potenti� ACM �d
approved bulk-sarnpling techniques. The asbestos bulk-sarrtpling was eonducted on suspect ACAA with a
limited number of bulk-sarnples being c�lleded within the unit.
The inspedion, assessrnent �d s�npling were performed in a000rd�oe with Environmentad Protection
Agency/AHERA reoommended prooedures. These prooedures call for the visu� inspection of the ar� of
oonoern and the oollection and an�ysis of repr�tative bulk-samples of susped material.
Some minor destructive sampling was oonduded. W�Is, oolumns �d perimeter pipe chases were not
broken into in order to loc�teand qu�tify suspect ACM. It should benoted that additional ACM might be
located in these �d other inaooessible ar�as.
Random bulk-samples, representative of the suspect asbestos�-oont�ning building materials (ACSM) of
each homogeneous area (HA), were oolleded a000rding to the guidelines published as Environmental
Protedion Agency (Epq) Fin� faule: Title II of the Toxic SLbst�oes tbntrol Act (T9CA),15119� S�ctions
2641 through 2654 and in oomplianoe with 40 CFR, Part 763. Representative sarnpling is b�sed on the
following criteria:
1. Thedistribution of thesusped material throughout theHA.
2. The suspect material's physical characteristics and �pliqtpon,
3. R�dom sampling patterns determined for each HA
SLsped materi�s sampled a�d an�yzsd should be oonsidered to be representative of materials in �ach
HA if they exhibit simil� physical characteristics and the application of the sampled material c�n be
oa�related to the application of un-sarnpled materi�. Bulk-samples oollec�ed were ��yzed utilizing the
EPA's Method for the D�eterminatir�n nf ���;„ R•,�;n �ilding Ma[plC7%J (EPA 600/ R/ 116, ,�tly, 1993)
and the McCrone Research Institute's The A��os Partide Atlat as methods referenoes. Analysis of the
bulk-samples was performed on the "date reported," as listed in the bulk-sample an�ysis report.

IV. Noteson Report Format
SUspect materials alike in appearanoe and application were sampled as HAs. SLspect materiais were
divided into three dassifications:
1. 3rrfaangMaterial: sprayed or troweled onto strudur� building member.
2. Thermal �rstan Insulation (T9): any type of pipe, boiler, tank, or duct insulation.
3. Misr,�llaneous Material: other susped materials, floor tile, sheet vinyU lino{eum, oeiling tiles,
insulation, �d finishing materi�s.
Cbndition assess�nents were performed by the aaredited in�or at the time of inspection. Gbndition
assessments �e listed in the following section. Ratings of "good," "damaged," and "si�ificantly
d�naged" are meant to indicate the overall condition of the material.
A material in "good" oondition has no visible damage or deterioration, or showing only very limited
d�nage or deterioration. A material in "damaged" condition has the following characteristics: The
surfaoe is crumbling, blistered, water-stained, gouged, marred or otherwise abraded over less than on�
tenth of the surfaoe if the damage is evenly distributed (one-quarter if the damage is lot�ized).
Accumulation of powder, dust or debris similar in appear�oe to the suspect materi� on surfaoes
ben�th the materi� c�t be used as oonfirmatory evidertoe. A material in "significantly damaged"
oondition has one or more of the following characteristics:
• The surfaoe is cxumbling or blistered over at least one-tenth of the surfaoe if the damage is evenly
distributed (one�quarter ifthedamageisloc�lized).
� ohe-tenth (one�quarter, if localized) of the materi� is hanging from the surfaoe, deteriorated, or
showing adhesive failure.
• Water stains, gouges, or mars are over at least one-tenth of the surfaoe if the damage is evenly
distributed (one-qu�ter if the damage is localized). A�ocumulation of powder, dust or debris
similar in appear�oe to the suspect materi� on surfaoe,s beneath the material pn be used as
oonfirmatory evidenoe.
Response-action reoommenda#ions for �os-oont�ning HAs are listed in the sedion VII.
Recommendations may be for more than one HA, if materi�s are alike. Reoommendations are either
"general" or "immediate." An immediate recommendation indicates the presence of asbestos greater
th� 1% within the bulk-sarnple, or a bulk-sample in the s�ne HA, and should be addressed acoordin�y.
A gener� reoommendation indicates asbestos does not exist gr�ter th� 1% within the bulk-s�nple, or
all bulk-sarnples in the same HA, and no further abatement adivities are required for removal of the
material. Any sample reporting a"TRACE" amount of asbestos must be considered to be positive for
�os greater than 1% unless it is ��yzed by the pa nt-oount method to be less than 1%.
V. Inspedor Comments
No �os-oont�ning material was identified during the bulk-sarnpling oonducted a# 196 Gore O-eelc
Drive, Unit 164, Vail, Colorado. A tot� of ei�t (8) bulk-samples of two (2) types of dryw�l texture, floor
tile and carpet mastic were oolleded with ail eight (8) bufk-samples reporting as non�de#ect for
asbestos.

VI. HomogeneousArea Descriptions

On-site veriflcatian of the exact quantity of material is required ior bidding purpo�es.

VI�. Reooinmendations
GENERAL: The laboratory results of the potential ACM sampled at 196 Gbre C7eek Drive, Unit 164 Vail
Colorado, indicate the bulk-s�nples of drywa�l, floor tile and c�rpc�t mastic oollected from the unit
reported as none-deted for asbestos. No profession� �atement activities a�-e reoommended to remove
theabove-refierenoed materi�.
