Dear Gary,
Beginning on January 19� 1989, a re�riode�ing pro ject
has been takin� place in Vill? Cortina unit #34�0 under the
supervision of Robert Boymer of Boymer Con struc,S o;i. Please
let this letter serve as a form�l complaint concerning Ivir.
Boymer' s qualificatioi�s to �old � Town of Vail Contractors
License . Since the beginning of construction, NIr. Boymer
and his crew have shown little regard f or the respect of
Association propert,y and the safety of its occupants.
Specifically, the access door to the north stairwell of
the building was broken durin� construction and was repair-
ed (unsatisfactorily) only after repeated conversations
with Mr. Boymer. Nr. Boymer has had virtually no con�r�l
over his employees and subcontractors concerning building
access and parkin�. Smoke detectors were never properly
covered durin� construction causing three false alarms and
a "red tag'� warriin� from the Fire NTarshall in the event of
one more alarm. Even the very rr�ethods of fire safety that
were discussed by Nlike T�IcGhee were discarded as soon as IvZr.
P�IcGhee left the building. . .i.e . stairwell doors propped
open and the failure to take down the plastic covers on the
smoke detectors (now required by Mr. McGhee ) at the end of
construction every day. Mr. McGhee has reccomended that
seven smoke detectors be replaced since the pnotoelectric
cells in each one have been contaminated with lacquer.
Finally, after several complaints concerning noise from the
renters in the unit below, 1�1r. Boymer agreed to restrict
the hours of construction from 8 A .M. to 4 P.P�I. The next
day Mr. Boymer's crew was working well past 5 P.M. The r.en�-
e.rs have since been moved to another unit and the loss of
income to the homeowner of the first rental unit will be
backchar�ed.
Basically� Mr. Boymer's arrogant attitude toward the
Villa Cortina Condominium Association along with his inent

handling of every problem I have discussed with him has
prompted me to write this letter. I have dealt W1tI'1
many contrac�ors in town as a building manager and find
in comparison that Mr. Boymer's standar�,s are almost rion-
existan-t. Flease feel free to give me a call about this
matter and I would be curious to know the outcome, if any,
of this complaint.

Dear Rick�
I wanted to follow up on our phone conversation of
several weeks a�o concernin� Condominium Association
approval for building permits. As you already know, I
feel that the Town should not 'r.ave abandoned a policy
that was firmly established through precedent due to a
tec!�n�e�.lity. As of today, here is a list of how the
rer,iodelin� of #340 has affected the Condominium associa-
tion.
1) Building water has had to be shut off :four times
to accomodate the plumber.
2) Unrelated to the snut off s, Mr. Boymer and his
crew have caused three leaks into the rental unit
below.
3) There have been three false fire alarms due to
dust and the ST�1"ay 21{r of lacquer. Mike NIcGhee of
the Fire Department has promised to reg -�a� the
construction in the event of one more alarm.

Dear Rick,
I wanted to follow up on our phone conversation of
several weeks a�o concernin� Condominium Association
approval for buildin� permits. As you already know, I
feel that the Town should not have abandoned a policy
that was firmly established throu�h precedent due to a
techn�l+�ality. As of today, here is a list of how t}ie
reraoc?Plin� of .#340 has affected the Condominium Associa-
tion.
1) Building water has had to be shut off four times
to accomodate the plumber.
2) Unrelated to the shut off s� Mr. Boymer and his
crew have caused three leaks into the rental unit
below.
3) There have been three false fire alarms due to
dust and the spray� of lacquer. Mike McGhee of
the Fire Department has promised to reg tag the
construction in the event of one more alarm.
4) Related to number 3, approximately six smoke/fire
detectors will have to be replaced due to the

Dear Rick,
The Community Development Department recently discussed some of
the issues that came to light during the Villa Cortina, unit 340
remodel request. As a staff, we are in agreement with you that
the town should have a written policy requiring Condominium
Association approval, if applicable, for any work to be done in
a condominium unit that would require a building permit from the
Town of Vail. It is our intention to add this requirement as a
Town of Vail addendum during the adoption of the 1988 Uniform
Building Code. This adoption process is done by ordinance by
the Town Council. I am sure that this proposed addendum will be
discussed by the Council at this time. If you wish to appear
before the Council and support the staff in adding this
requirement, I will be glad to notify you of the meeting times. `
We appreciate your support in this issue and will look towards
seeing that a similar situation to what has just transpired will
not occur again in the future.
