Confirming our conversation, we own Lot 2 of the Pinecreek at Vail subdivision, commonly known as 2675-2 Kinnikinnick Road, Vail, Colorado. We are requesting that you grant approval for the building permit filed by Plath Construction to repair the small flat roof over the entryway to our house. In support of our request, we confirm the following: 1. Our home is separately deeded as lot 2 and is a fully detached single-family home, 2. The five owners of lots in Pinecreek subdivision each own their separate properties and are fully responsible for all interior and exterior maintenance. The only commonly owned property is the easement for the common driveway, which is plowed by a service and the plowing cost is split five ways. 3. There is no condominium association or homeowner's association applicable to Pinecreek and each owner is free to maintain its property without the need to obtain the consent of or to provide notice to any other homeowner. In that regard, in the 16 years that we have lived at our Vail home we have never been consulted by nor have we provided consent to any other homeowner for any of the numerous repairs that have been made to these properties. There are no covenants, restrictions or limitations applicable to our use and quiet enjoyment of our homes that run to any other Pinecreek property owner, individually or collectively. Please process the application at your earliest convenience, as the defective roof is causing damage to the plaster ceiling and the wood floor in the entryway to our property.
