The DRB found that the proposed tree removal does not comply with the requirements of Section 14-10-3-C,Vail Town Code: "Removal of trees,shrubs, and other native vegetation shall be limited to removal of those essential for development of the site, those identified as diseased or those essential for creating defensible space. Mitigation may be required for tree removal." This decision by the Design Review Board may be appealed to the Vail Town Council pursuant to the procedures outlined in Section 12-3-3,Appeals,Vail Town Code, and the submittal of an Appeals Form. Appeals Forms are available at our office or online at: http://www.vail�ov.com/docs/dl forms/appeals.pdf Please be aware that the Vail Town Council only has the authority to determine if the "standards and conditions imposed by the requirements of this title(the Vail Town Code) have or have not been met"by the Design Review Board's decision. The Vail Town Council does not have the authority to change or waive the standards prescribed by Section 14- 10-3-C,Vail Town Code, through an appeal.
