Asbestos Testing &Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. It is your responsibility to be in compliance with the State. Please contact the State directly
for their requirements at the contact info listed below.
When is asbestos testinq required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 32 square feet
All Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including
multi-family/condominium units, and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified abatement contractor. The
clearance letter must be submitted to the Town of Vail before the building permit will be issued.

• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce ,
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE I

Subject: Limited Scope Asbestos Building inspection
Dear Mr. Meyer:
CB Environmental, LLC (CBE) was retained by Mr. Meyer to inspect ceiling and wall surfacing
that is planned for a renovation at the building unit C-4 at 2733 Kinnikinnick Road, Vail,
Colorado. The inspection included bulk sampling of suspect asbestos-containing material
(ACM) observed on the popcorn ceiling, textured ceiling, and wall surfacing including joint
compound, and submittal of samples for asbestos content laboratory analysis. The purpose of
this inspection was to sample suspect ACM that would be disturbed by renovation activities
and to have laboratory analysis identify whether the suspect material(s) contained asbestos. If
asbestos-containing, the material(s) would then be removed properly prior to removing the
existing wall.
Information researched by CBE on the Summit County Assessors website indicated that the
building unit was constructed in 1980. Asbestos-containing building materials are more likely
to be present in buildings constructed prior to 1979; therefore, the subject building has a low
probability to contain ACMs. ACM is defined, by regulation, to be materials that contain
greater than 1% asbestos.
Observations and Suspect Asbestos-Containing Materials at the Site
The survey was conducted on April 21, 2011, by Colorado Department of Public Health and
Environment (CDPHE) and Asbestos Hazard Emergency Response Act (AHERA) certified
inspector Mr. Mike Lococo (Ce�tification Number 13438).
The building unit C-4 is planned for renovations disturbing the ceilings and walls. Some minor
destructive sampling was conducted on the ceiling and wall surfacing including joint
compound. The ceiling and walls were already damaged in some areas but the limited scope
inspection did not require full sampling due to job specifications.
Three (3) suspect materials were sampled as follows: popcorn ceiling, textured ceiling, and
wall surfacing including joint compound where the drywall was to be cut. CBE did not observe
any other suspect ACM in the area of pianned renovations. I
Samples were submitted to Reservoirs Environmental, Inc., laboratory on Apri� 21, 2011, for
Polarized Light Microscopy (PLM) analysis to identify asbestos content. The samples were
requested on an immediate turnaround time for results.
Laboratory results
Laboratory results received on April 22, 2011, document that all nine (9) samples submitted
were non-detect (ND) for asbestos.
Please find attached the Reservoirs Environmental laboratory report of PLM results.
Conciusions:
CBE observed three types of suspect ACM that would be disturbed during the planned
renovations. Six (6) ceiling surfacing and three (3) wall surfacing samples including joint
compound were sampled in Unit C-4 of the building located at 2733 Kinnikinnick Road, Vail,
Coforado.
Based on the site observations and bulk sample PLM laboratory anatysis results, zero
materials sampled contains asbestos; therefore, renovations of the ceilings and wafis can
occur without requiring asbestos abatement.
