'n^ ► ,-,, � . , , LAND T [ TLE GUARANTEE COMPANY DISCLOSIIRE STATEMENT Required by C.R.S. 10-11-122 A) The subject real property may be located in a special taxing district. B) A Certificate of Taxes Due listing each taxing jurisdiction may be obtained from the County Treasurer's authorized agent. C) The ioformation regarding special districts and the boundaries of such districts may be obtained from the Board of County Commissioners, the County Clerk and Recorder, or the County Assessor. Effective September 1, 1997, CRS 30-10-406 requires that all documents received for recording or filing in the clerk and recorder's office shall contain a top margin of at least one inch and a left, right and bottom margin of at lease one half of an inch. The clerk and recorder may refuse to record or file any document that does not conform, except that, the requirement for the top margin shall not apply to documents using forms on which space is provided for recording or filing information at the top margin of the document. Note: Colorado Division of Insurance Regulations 3-5-1, Paragraph C of Article VII requires that "Every title entity shall be responsible for all matters which appear of record prior to the time of recording whenever the title entity conducts the closing and is responsible for recording or filing of legal documents resulting from the transaction which was closed". Provided that Land Title Guarantee Company conducts the closing of the insured transaction and is responsible for recording the legal documents from the transaction, exception number 5 will not appear on the Owner's Title Policy and the Lenders Policy when issued. Note: Affirmative mechanic's lien protection for the Owner may be available(typically by deletion of Exception no. 4 of Schedule B, Section 2 of the Commitment from the Owner's Policy to be issued)upon compliance with the following conditions: A. The land described in Schedule A of this commitment must be a single family residence which includes a condominium or townhouse unit. B. No labor or materials have been furnished by mechanics or material-men for purposes of construction on the land described in Schedule A of this Commitment within the past 6 months. C. The Company must receive an appropriate affidavit indemnifying the Company against un-filed mechanic's and material-men's liens. D. The Company must receive payment of the appropriate premium. E. If there has been construction, improvements or major repairs undertaken on the property to be purchased within six months prior to the Date of the Commitment, the requirements to obtain coverage for unrecorded liens will include: disclosure of certain construction information; financial information as to the seller, the builder and or the contractor; payment of the appropriate premium fully ezecuted Indemnity Agreements satisfactory to the company, and, any additional requirements as may be necessary after an exaniination of the aforesaid information by the Company. No coverage will be given under any circumstances for labor or material for which the insured has contracted for or agreed to pay. The following were the Board's comments and concerns: - The Board likes the overall approach and design of the proposal. - If phased, some element of the front design needs to be extended to all four sides of the building. A reasonable schedule or timeline should be submitted. - The applicant should consider keeping the wood siding on the upper portion of the sides and rear of the building. This project is tentatively scheduled for final review by the DRB at their January 17,2001 meeting. In order to remain on this schedule,a complete and final DRB submittal for this project must be submitted to my attention at the Community Development Department no later than noon on Tuesday January 2, 2001. If you are unable to submit a complete and final application by January 2,2001,this project will be rescheduled. The bellyband will br�k these tw�o areas. The aggregate is rather small and will be pair�ted to match the stucxo cdor. It will offer a slight variance from the�texture while not noticeable from a distance it could be a nive variation. We have also added a stone cap to the swimmir�g pool wall,which is in front of the south�st watl tha�t the boand felt was too tadt. With the bellyband the heavy wood windo�w trim amd the stone capped swimming pool watl f fed this will br�eak up this flat surfaoe suffiaerrtly.(I will do a quick sketch of this prior to the November meeting to shaw this better. The Concrete Roof Beams will be painted to match the fascia wood color, while the concrete soffit will remain white. 3. The windaw frames will be pairrted an accerrt oolor,"Tropic NighY'instead of the white oolor originally spec'd. The Wood window trim will remain stained with the Olympic stain#910. 4. There are iv�ro bellybands, one at the first floor level and the other at the third floor level. Each is 12 inches broad. The bellyband will be white where the stucco fields above and below it are white. The bellyband will be"Tan�er Tan"when the stu000 abrnre or below it is`Townhouse Tan". 5. DESCRIPTION OF THE REGIUEST The applicant, Villa Cortina Condominium Association, represented by Rick Haltermann, Managing Agent, is requesting a variance from Title 12, Chapter 14-2A. Villa Cortina Condominium Association is proposing to install a heating system for its parking lot and to resurface the area with stamped concrete. A boiler is proposed to be installed in the side yard setback, on the north edge of the building, between the Villa Cortina building and the main Vail Fire Station. The proposed boiler is 5' x 7' x 4' and will be hidden from view by the buildings on either side. A surface parking area exists to the northwest of the site. The parking area is located at a higher elevation and the boiler will be out of the direct line of sight. The applicant is willing to screen the unit if the PEC or the DRB requests additional landscaping. There will be no change to the parking lot size or to the number of parking spaces. The zoning on the property is High Density Multiple Family District (HDMF)which requires 20' setbacks on all lot lines. The proposed boilers will encroach a maximum of 13' into the setback. The north edge of the Villa Cortina Building already extends into the sideyard setback. II. CRITERIA AND FINDINGS FOR A VARIANCE RE(�UEST Upon review of Section 12-17-6, Variance Criteria and Findings, of the Town of Vail Municipal Code, the Community Development Department recommends approval of the requested side setback variance. The recommendation for approval is based on the following factors: A. Consideration of Factors: 1. The relationship of the requested variance to other existing or potential uses and structures in the vicinity. The proposed encroachment into the setback for the snowmelt boiler will have minimal impacts on existing or potential uses and structures in the area. The degree to which relief from the strict and literal interpretation and ! enforcement of a specified regulation is necessary to achieve compatibility ' and uniformity of treatment among sites in the vicinity or to attain the objectives of this title without grant of special privilege. The Villa Cortina Condominiums currently loses 4-5 parking spaces in the winter due to the pileup of snow during snow plowing. No other reasonable location for the boiler exists on site. The proposed location is well hidden by the buildings. The impacts are minimal as the project is not visible to pedestrians or adjacent property owners. Placing the boiler between buildings achieves other objectives of the Zoning Regulations by providing screening and restricting the boiler to an unobtrusive site. 3. The effect of the requested variance on light and air, distribution of population, transportation and traffic facilities, public facilities and utilities, and public safety. The location of the boiler will have no effect on any of these criteria. B. The Planning and Environmental Commission shall make the following findings before granting a variance: 1. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same district. 2. That the granting of the variance will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. 3. That the variance is warranted for one or more of the following reasons: a. The strict literal interpretation or enforcement of the specified regulation would result in practical difficulry or unnecessary physical hardship inconsistent with the objectives of this Title. b. There are exceptions or extraordinary circumstances or conditions applicable to the same site of the variance that do not apply generally to other properties in the same zone. c. In order to accomplish this, a boiler (5 'x7 'x4 ' ) will need to be installed, outside, on the north side of the build- ing. This would require a variance of Chapter 14 of the Town of Vail Zoning Requlations . The location of the boiler would place it between the Villa Cortina and the Fire Station. This location is well shielded from public view. Currently, the Fire Station has a fan running full time into this area with noise levels exceeding those an- ticipated from the boiler (the boiler would operate only when needed) . Several years ago, the First Bank of Vail installed a similar boiler on the west side of their property.
