The Grant of Easement created hereby shall remain in e for a period of five (5) years from the date hereof, and shall thereupon cease unless prior to such time Grantee has con- structed in reliance hereon balconies over the property herein described. Once so constructed and as so constructed, the owner of such balconies shall have a perpetual easement across the real estate herein described for such overhang or occupation, the con- tinuance, repair and maintenance thereof. Said easement shall cease upon the demolition or destruction of said balcony unless such destruction results from fire or other casualty and the owner forthwith restores the same. 4. The initiation of construction, erection and maintenance of balconies by the Grantee upon the property described in Exhibit A and encroaching upon said portion of the Grantors' property hereinabove described shall constitute conclusive evidence of the reliance of such Grantee on the terms, provisions, covenants, agreements and declaration of Grantors herein contained. 5. Grantors shall fully use and enjoy the above described premises except as to the rights herein granted, and Grantee agrees to hold and save Grantors harmless from any and all damage arising from its use of the easement herein: granted, and agrees to pay any damage or damages which may arise to the property, adjoining property or rights of Grantors through Grantee's use, occupation and possession of the rights herein granted.
