Minor Exterior Alteration
General Information: This application is required for all proposals involving minor changes to buildings and site improve-
ments, such as roofing, painting, window additions, landscaping, fences, retaining walls, etc. Applicable Vail Town
Code sections can be found at www.vailgov.com under Vail Information — Town Code Online. All projects requiring de-
sign review must receive approval prior to submitting a building permit application. An application for Design Review
cannot be accepted until all required information is received by the Community Development Department, as outlined in
the submittal requirements. The project may also need to be reviewed by the Town Council and /or the Planning and
Environmental Commission. Design review approval expires one year from the date of approval, unless a building per-
mit is issued and construction commences.

Dear Lupine Partnership representative,
My name is Warren Campbell and I am the Chief of Planning for the Town of Vail. I am
sending you this correspondence as I have been made aware that recently some
willows on your property were removed without appropriate Design Review approval, in
accordance with Section 12- 11 -3A, Design Approval, Vail Town Code, which states the
following:
"A. Scope: No person shall commence removal of vegetation site preparation,
building construction or demolition dumping of material upon a site, sign erection,
exterior alteration or enlargement of an existing structure, paving, fencing or other
improvements of open space within the corporate limits of the town unless design
approval has been granted as prescribed in this chapter. The addition of plant
materials to existing landscaping, gardening and landscape maintenance shall be
exempt from this provision. "
I have the understanding that the willows may have been removed to address the
removal of a fence which was entangled within the plants. Removal of the vegetation
requires the submittal, review, and approval of a Design Review application prior to the
commencement of any work.
I would ask that you please call me within 5 business days of the receipt of this letter in
order for us to discuss the reason for the removal of the willows, and what your thoughts
are with regard to the space moving forward. The Town of Vail will be looking to
reestablish vegetation on this portion of your lot to help ensure the water quality and
health of Gore Creek

As a follow up to our conversation please find attached a site plan for the property, the letter sent to
Mr. Jester, and a site plan from the original approval of the landscaping plan.
Please identify what and why you performed the work you already have and what you intend to replace
it with. You can write all this on the site plan and submit with the cover of the application. The
application does require the owner or authorized agent to sign the application (could be you) and the
joint property owner to sign (co -owner of the duplex) Mr. Henry Pratt, who works in the Glen Lyon
Office Building. He can be reached at 970 - 476 -1147 (work) or 970 - 476 -1531 (home). He can sign the
application or send me or you an email stating he is comfortable with the proposed plan.
The Town will be most interested in allow the area to return to a natural state including natural grasses
and willows.

John,
I have no issues with your removing the old fence and cutting back the willows. I am also glad that you decided to reseed
with native grasses instead of going with sod.
For what it is worth, and with the exception of the small sodded yard I put in the back for my kids to use, I have always
tried to keep the landscaping as close as possible to what existed before the lot was developed- low native grasses and
wildflowers. The front of the Jesters has a fantastic crop of lupine and snow -in- summer that I hope will continue to flourish
and spread (mine got wiped out by whatever those millions of little green bugs are that devour the lupine flowers and seed
pods every year).
As for giving you an advance approval of whatever the DRB requires, I don't see much point. I would please ask that Staff
pass along the DRB comments to me and I will give them my opinion if they really need it.

Dear Henry,
As you know, we have been hired by Beth Jester to remove a section of the chain link fence that had been overgrown by
willows over the last many years. The fence had become crushed by the willows' growth and needed to be removed.
During the course of removing this fence, we had to prune some of the willows down so that we could free the chain link
fence. Once the willows were pruned, we reseeded with native grass seed mix to match the grass in the front.
The design Review Board contacted Royale Jester about a permit for the work, and I am completing that for them. I need
an email from you that approves of this work, and any remedy that they may impose other than our plans. Will you please
respond to this email so that I can forward it to the Design Review Board for our submittal?
