General Information: This application is required for all proposals involving the �ddif��jr ����fd��, in-
cluding net floor area and/or gross residential floor area (GRFA). This also includes proposals for resiaential
250 additions' and `interior conversions'. Applicable Vail Town Code sections can be found at
www.vailqov.com under Vail Information — Town Code Online. All projects requiring design review must re-
ceive approval prior to submitting a building permit application. An application for Design Review cannot be
accepted until all required information is received by the Community Development Department, as outlined in
the submittal requirements. The project may also need to be reviewed by the Town Council and/or the Plan-
ning and Environmental Commission. Design review approval expires one year from the date of approval,
unless a building permit is issued and construction commences.

THE UNDERSIGNED, being all of the Directors of the 770 Potato Patch Condominium
Associadon Ina (the "Association'�, a Colorado non-profit cc�wration, hereby adopt the
following Resolution:
WHEREAS the Owner of Unit 17, (the "Applicant"), has submittcd plans and received
previous appmval for such plans (see atteched plans which wae previously approvod by the
Association) to the Association. The Owner of Unit 17 has not takcn ac6on on the approval and
now seelcs aP6rniation and/� reapproval of the proposal such that management can provide an
approval ldter for the Town of Vail Design Revicw Boerd, a roquiren�ern to obtaining a building
pecmit c�ceteia. Throughout this resolution when "Applicaat" or "OwneP' is rcferenced such
applies to predecessor unit owne�s.
RESOLVED, that the Direetors of the Associarion hereby approve the request, as filed
with the Association and attached, subject to the conditions stated herein:
1. Recitals noted above are hereby incorporated.
2. The Association may set rules and standards, outlined by policy and/or within govaning
documents, either now or in the future, related to any approved alterations by unit owners
and their pradecessor unit ownets.
3. Any and all costs including, but not limited to, the cost of the work and cleaning up during or
after the work shall be at the ea�p�se of the Applicant and his sole responsibility
4. Any legal responsibility regardin8 az►Y raquired disclosturs to people and/or �tities is the
sole responsibility of the Applicant, including but n� limited to future purchasers.
5. The Association shall be held harmless, to the greatest extmt allowed by law, related to this
approval and the Owner shall ind�nify the Association to the greatest �tmt legally
aUowable related to this approval.
6. All rights and obligations between the Applicant and the Association, as set out in the
Condominium Declaration and othex governing documents wiW respoct to this approval and
the work contemplated tttexeby, remain in full force and effect as may be amended and/or
restated from rime to time.
7. The applicant, at his expense, furnish the Association with a professional eogincer's
statement assuring that the expansion does not compromise the strucwral int�egrity or future
mainteaance of the bathroom and utility structure below the requestefl acpansion.
8. A final review/approval requirement of impacted landscaping, pazbcularly in regard to the
south dedc addirion over the batLrooms.
9. Applicant, at his expense, shall assume responaibility for the future maintenance of all added
exterior surfaces, including, but not limited to walis, roofs, windows, doors and decks.
10. Applicant, at his expense, shall assume responsibility for the updating of the Condomini�
Map as it regards Unit 17 in the manner consist�t with the govaning docs of the
Association as may be amended from time to time.
11. The final design must have all materials, colors and finishes matching existing, and the
proposed deck railing must maintain design details consistent with existing ar match railing
desi� rec�tly installed on unit 7 or 11.
12. The Board is in the process of adopting niles and regulaN�s for the Association. Of coutse,
any niles and regulations (or other law ar Association governing docimments) reltvant to the
wnstruction project should be adhcaed to. 'Ihe Associati� will draft final rules which will
inctude a Construction Compliance Deposit in arde,r to kcep pressure on owners and
contractors to comply with the Association rules such as parking etcetera.
13. The improvemenu must be compl�ed no Iater than 24 months &om the date of the Approval.
14. Applicant will put a new Grace Ice and Shield on the roof above the common pool bathrooms
prior to adding his unit on top and will invoice the Association for reimbiasement Such bid
for the work shall be presented to the Board in advance for approval.
15. Applicant will be respons�'ble and assessed any expeases associated with this approval and
approval process subject to the curtent associsdon policies which may be sex forth in the
Association govaning documents. 'Ihis includes any eagineering fces, mauagement fces
etcetera necessary to approve and follow the expansion through completion and inctudes any
post compledon follow-up if deemod necessary by the Board. The intention is that no
expenses for approving this expansion shall be absorbed by the Association unless

specifically outlined as the r+esponsibility of the Association in the Association governing
documents (as may be amended from time to time). For example, profesaionals (architeds,
engineas, att�neys) management exp�ses related to the expension approval and expansion
and that any such expenses deemed necessary by the Board will be passal on and assessed to
the unit owna relatad to that uniY s expansion approvat and expension/conshuction.
The above conditions may be more reshictive and imposing than will actually occur but these
conditions were cut and pasted from previous condidons for approval when Phil Woodward
originally rooeived appmval on the expansion proposal as wdl as adding some c�nditions of
more re�t expansion approvais. This is bcing done in an effort to s� the proc�s of
reapproving and/or af6rming. Tt�e Association will impoae any burdeas or responsibilities in
relation to this expansion in a mannea consistent with any otha similarly approved expansions
and consistent with the Aasociation Governing Documents and polices.

residentiaf additions may ar�fy be �anstrueted through the "25fl Ordinance" or "Interior Canv�rsion" addi#inna[
gross residential Flovr area {GR�A) prouis+ons of the Town Gode.
The pre�iou� approval far this prflpo��d addition w�s issued orr ]une 28, 2D04. �n July 2D, �Oa�, the Tawn of
Vail adopted �rdinance No. �.6, Series vf 2004, whieh amended to the Town's GRFR regulations. An eiement of
this vrdinance �hanged the rn�thodofagy for calculating GR�A, Prer�iausly GRFA was measure� from the inside
face of th� exterior walls and with the amendr►3en�s of Clydinance No. 16, GRFA is naw measured to the o�at�ide
face of �he exterior walls. As a result t�f these changes, the proposed a�dditior� is nvw calculated at
appraxirnaTely 27D sq.ft. �f GRFA which exceeds the maxirnum "250" alfvwed by t�e T�own Code.
