Asbestos Testing & Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. It is your responsibility to be in compliance with the State. Please contact the State directly
for their requirements at the contact info listed below.
When is asbestos testinci required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two - Family Dwellings: 32 square feet
All Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single - family dwelling: any dwelling unit that is used primarily for a single family, including
multi - family /condominium units, and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State - certified abatement contractor. The
air clearance letter or form must be submitted to the Town of Vail before the building permit will be issued.

Tips & Facts:
• Even recent construction projects may include asbestos - containing materials, so buildings of gny age require testing.
• The "1989 Ban" on asbestos - containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so- called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos - containing product categories was set aside and did not take effect." - CDPHE

Colorado State Regulation 8 requires a State certified Asbestos Building Inspector to
inspect and sample for suspect asbestos containing materials (ACM) prior to the
disturbance, removal or demolition of more than 32 square feet of surfacing materials
(e.g., drywall and associated textures, acoustic sprays and joint compounds), 50 feet of
asbestos covered/insulated pipe or materials which would fill a 55 gallon drum. The
regulations require a minimum of 3 samples per homogenous suspect material for up to
1,000 square feet of surface, and more samples beyond 1,000 square feet, etc.. In order
for the contractor to proceed with restoration, renovation or demolition the suspect
materials have to be sampled and analyzed by a NVLAP accredited laboratory by
polarized light microscopy PLM methods.
The Client needs to remove and renovate code violation installations in the garage and
crawlspace. In order to perform this work an asbestos building inspection was necessary
prior to any removal of suspect ACM.
An inspection was conducted by Jim Baker of HealthSafe Inspections, Inc. during the
afternoon of Thursday, August 25, 2011. Suspect materials which would be disturbed
during the demolition in the garage and the remodel/renovation in the crawlspace were
sampled. The materials covering more than 32 square feet but less than 1,000 square feet
of homogenous surfacing material were identified requiring a minimum of 3 samples in
the garage and 6 samples in the crawlspace and hatch closet due to two different dates of
installations with two different textures and suspect joint compounds totaling 9 all
together. There was no vinyl flooring, caulking, adhesives or other suspect building
materials which would be disturbed.

The bulk samples were analyzed by PLM by a NVLAP accredited laboratory in
accordance with Colorado State Regulation 8 for the presence of asbestos mineral fibers.
All 9 randomly distributed samples from the garage and crawlspace were:

All drywall and applied textures and joint compounds in the garage installation and
crawlspace hatch closet and substructure area can be removed and disposed of in any
landfill as normal construction debris. No asbestos abatement is necessary.

and Environmental matrices by the National Voluntary Laboratory Accreditation Program ( NVLAP), Lab
Code 101896 -0 for Transmission Electron Microscopy (TEM) and Polarized Light Microscopy (PLM)
analysis and the American Industrial Hygiene Association (AIHA), Lab ID 101533 - Accreditation Certificate
#480 for Phase Contrast Microscopy (PCM) analysis. This laboratory is currently proficient in both
Proficiency Testing and PAT programs respectively.
Reservoirs Environmental, Inc. has analyzed the following samples for asbestos content as per your
request. The analysis has been completed in general accordance with the appropriate methodology as
