Re; Potato Patch Club unif 36
Nicloas and Virgenie Ganivet of Denver are under contract with Sam and Nancy Guren to
purchase their Condominium 36 in Potato Patch.This contract is contingent on the Ganivets
being able to add an exterior window on the east side of the town home to allow legal egress
from the adjacent room.This window will conform to all rules and regulations of the
Association and the Town of Vail.
Architects, Bill Pierce and Associates, have drawn the proposed window ( see attached). John
Stevens, President of the Potato Patch Board has given Board permission to allow this window
once the proper fee is paid to Potato Patch and a limited warranty is signed by the Ganivets
who agree to all terms and conditions. See attached email.
Since the new owners will not be able to sign until their closing October 14, 2011,they are
asking for preliminary approval for this window based on the Town of Vail requirements,the
application signed by the present owner, Guren, and this approval email from the president of
Potato Patch.

I was able to get board approval for the additional window.This approval is subject to the same terms and condi�idns
pointed out in the email below, except that the$500 coordination fee is to be paid to PPC rather than to Vail Home
Rentals.Also note that the actual installation of the window must meet the requirements of our engineer and will be
subject to the inspection and approval by our engineer. Upon payment of the fees and signing of the maintenance
agreement/warranty I would be happy to sign whatever form is required by the Town of Vail. We should have that
maintenance/warranty agreement available in the next week or so.

I have read the following on the July 27, 2011 Potato Patch Club HOA minutes:
Patricia Rowe, owner of Unit#16, has requested board approval to add a window and skylight to her
unit. Conditions were placed on the remodel by the board. The guidelines can be found in the Minutes
from the board meeting dated January 20, 2010. Some of the guidelines were a limited warranty, a
payment of$2,500 to the association for future maintenance and a$500 payment to Vail Home Rentals
for coordination of work by outside contractors (site maintenance, parlcing, etc.)
The project was unanimously approved by the board subject to the owner executing all appropriate
documents to be provided by Tom Bieging and payment of the oversight fee and the $2,500 future
maintenance. When completed,these documents will be recorded with the Clerk and Recorder at the
County of Eagle, State of Colorado.
So it seems that there is another process than going in front of all the owners to get these approved.
