Asbestos Testing &Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. It is your responsibility to be in compliance with the State. Please contact the State directly
for their requirements at the contact info listed below.
When is asbestos testing required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 32 square feet
All Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including
multi-family/condominium units, and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified abatement contractor. The
clearance letter must be submitted to the Town of Vail before the building permit will be issued.

Tips& Facts:
• Even recent construction projects may include asbestos-containing materials, so buildings of�age require testing.
• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

COLORADO ASBESTOS REGULATIONS SUMMARY:
Colorado State Regulation 8 requires a State certified Asbestos Building Inspector to
inspect and sample for suspect asbestos containing materials(ACM) prior to the
disturbance, removal or demolition of more than 32 square feet of surfacing materials
(e.g., drywa(I and associated textures, acoustic sprays and joint compounds). 50 feet of
asbestos covered/insu(ated pipe or materials which would fill a 55 gaflon drum. The
regulations require a minimum of 3 samples per homogenous suspect material for up to
1,000 square feet of surface, and more samples beyond 1,000 square feet, etc.. In order
for the contractor to proceed with restoration, renovation or demolition the suspect
materials have to be sampled and analyzed by a NVLAP accredited laboratory by
polarized light microscopy PLM methods.

CLIENT BACKGROUND:
The client is planning to do remodel work in units 9 and 12 in the Lodge at Lions Head, '
Vail, Colorada '
VISUAL INSPECTION & FINDINGS:
An inspection «�as conducted by Jim Qaker of HealthSafe Inspections, Inc. on Thursday,
August 1 l, 20l 1 in the afternoon. Suspect materials�vhich would be disturbed during the
restoration/demolition/remodcUrcnovation �vere sampled. The materials covering more
than 32 square feet but less than I,000 square feet of homogenous surfacing material
were identified requiring a minimum of 3 samples each. There was no vinyl flooring,
caulking, adhesives or other suspect building materials which �vould be disturbed in units
9 and 12 other than drywall texture and joint compound. '
In Unit#9 the ceiling and �valls are all homogenous terture. The exception is wall-
papered bathrooms, but containing same date installation of drywall and taped joints with
homogenous joint compound. "t'he plan is to do minor remodel in the kitchen,taking out
the non-loadbearing partition between the kitchen and living room. There will also be
remodel work in three bedroom bathrooiz�s. A total of 5 samples ��ere taken in unit#9.
In Unit#l2 all ceiling and �vall surfaces were original, the same homogenous texture and
paint color throughout the unit in all rooms. A master bedroom bathroorn is planning to
be remodeled along with rivo other bedroom bathrooms. A total of 3 samples were taken
in unit#12.
LABORATORY DATA: '
The bulk samples were analyzed by PLM by a NVLAP accredited laboratory in
accordance �vith Colorado State Regulation 8 for the presence of'asbestos mineral fibers.
A11 5 samples in Unit#9 and all 3 samples in Unit#12 were:

HEALTHSAFE RECOMMENDATIONS:
All drywal) materials mentioned above, including those covered �vith wallpaper in Unit
#9 can be removed as non-ACM and disposed of in any landfill as normal construction
debris.

COLORADO ASBESTOS REGULATIONS SUMMARY: �
Colorado State Regulation 8 requires a State certified Asbestos Building lnspector to
inspect and sample for suspect asbestos containing materials (ACM) prior to the
disturbance, removal or demolition of more than 32 square feet of surfacing materials
(e.g.,drywall and associated textures, acoustic sprays and joint compounds), �0 feet of
asbestos covered/insulated pipe or materials which would fill a 55 gallon drwn. The
regulations require a minimucn of 3 samples per homogenous suspect material for up to
1,000 square feet of surface, and more samples beyond 1,000 square feet, etc.. In order
for the contractor to proceed with restoration, renovation or demolition the suspect
materials have to be sampled and analyzed by a NVLAP accredited laboratory by
polarized light microscopy PLM methods.

CLIENT BACKGROUND:
The client is planning to do remodel work in units 9 and 12 in the Lodge at Lions Head,
Vaii,Colorado.
VISUAL INSPECTION & FINDINGS:
An inspection was conducted by Jim Baker of HealthSafe Inspections, [nc. on Thursday, '
August I 1, 201 1 in the atternoon. Suspect materials which ���ould be disturbed during the
restoration/demolition/remodcUrenovation were sampled. "I'he materials covering more
than 32 square feet but less than I,OUO square feet of homogenous surfacing material
were identified requiring a minimum of 3 samples each. There was no vinyl flooring,
caulking, adhesives or other suspect building materials which would bc disturbed in units
9 and 12 other than drywall texture and joint compound.
In Unit#9 the ceiling and walls are all homogenous te�ture. The exception is wall-
papered bathrooms, but containing same date installation of drywall and taped joints�vith
homogcnous joint compound. '1'he plan is to do minor remodel in the kitchen,taking out
the non-loadbearing partition between the kitchen and living room. There will also be
remodel work in three bedroom bathrooms. A total of 5 samples �vere taken in unit#9.
In Unit#12 all ceiling and wall surfaces were original, the same homogenous texture and
paint color throughout the unit in all rooms. A ntaster bedroom bathroom is planning to
be remodeled along with two other bedroom bathrooms. A total of 3 samples were taken
in unit#12.
LABORATORY DATA:
' The bulk samples were analyzed by PLM by a NVLAP accredited laboratory in
accordance with Colorado State Regulation 8 for the presence of asbestos mineral fibers.
All 5 samples in Unit#9 and all 3 samples in Unit#12 �vere:

HEALTHSAFG RECOMMENDATIONS:
All drywall materials mentioned above, including those covered with wallpaper in Unit
#9 can be removed as non-ACM and disposed of in any landfill as normaf construction
