Asbestos Testing &Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. It is your responsibility to be in compliance with the State. Please contact the State directly
for their requirements at the contact info listed below.
When is asbestos testing reQUired?
ANY building projects disturbing more than these threshold levels of buiiding materials require asbestos testing:
One- and Two-Family Dwellings: 32 square feet
All Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including
multi-family/condominium units, and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified abatement contractor. The
clearance letter must be submitted to the Town of Vail before the building permit will be issued.

Tips& Facts:
• Even recent construction projects may include asbestos-containing materials, so buildings of�age require testing.
• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

� Colorado State Regulation 8 requires a State certified Asbestos Building Inspector to �
inspect and sample for suspect asbestos containing materials(ACM) prior to the i
; disturbance, remova( or demolition of more than 32 square feet of surfacing materials
; (e.g.,drywall and associated textures, acoustic sprays and joint compounds), 50 feet of
� asbestos covered/insulated pipe or materials which would fill a 55 gallon drum. The
; regulations require a minimum of 3 samples per homogenous suspect material for up to
�' 1,000 square feet of surface, and more samples beyond 1,000 square feet, etc.. In order
for the contractor to proceed with restoration, renovation or demolition the suspect
'' materials have to be sampled and analyzed by a NVLAP accredited laboratory by
� polarized light microscopy PLM methods.

CLIENT BACKGROUND:
The client is planning to do remodel work in units 9 and 12 in the Lodge at Lions Head,
Vail,Colorado. '
VISUAL INSPECTION & FINDINGS:
An inspection was conducted by Jim F3aker of HealthSafe Inspections, Inc. on Thursday,
August 11, 2011 in the atternoon. Suspect materials which would be disturbed during the
restoration/demolition/remodcl/renovatian �ti�ere sampled. The materials covering more
than 32 square feet but less than I,000 square feet of homogenous surfacing material
were identified requiring a minimum of 3 samples each. There �aas no vinyl flooring,
caulking, adhesives or other suspect building materials which would be disturbed in units ,
9 and l2 other than drywall texture and joint compound. '
In Unit#9 the ceiling and �valls are all homogenous texture. The exception is�vall-
papered bathrooms, but containing same date installation of dry�vall and taped joints�vith
homogenous joint compound. 'The plan is to do minor remodel in the kitchen, taking out
the non-loadbearing partition between the kitchen and living room. There will also be �
remodel work in three bedroom bathrooms. A total of 5 samples were taken in unit#9.
In Unit #12 all ceiling and wall surfaces were original, the same homogenous texture and
paint color throughout the unit in all rooms. A rnaster bedroom bathroom is planning to
be remodeled along with rivo other bedroom bathrooms. A total of 3 samples were taken
in unit#12.
LABORATORY DATA:
The bulk samples were analyzed by PI.,M by a NVLAP accredited laboratory in
accordance with Colorado State Regulation 8 for the presence of asbestos mineral fibers. '
All 5 samples in Unit#9 and all 3 samples in Unit#12 were: '

HEALTHSAFE RECOMMENDATIONS: '
All drywall materials mentioned above, including those covered with wallpaper in Unit
#9 can be removed as non-ACM and disposed of in any landfill as normal construction
debris.

a Colorado State Regulation 8 requires a State certified Asbestos Building Inspector to
+ inspect and sample for suspect asbestos containing materials (ACM) prior to the
� disturbance, removal or de►nolition of more than 32 square feet of surfacing materials
(e.g., drywall and associated textures,acoustic sprays and joint compounds), �0 feet of
� asbestos covered/insulated pipe or materials which would filt a 55 gallon drum. The �
� regulations require a minimum of 3 samples per homogenous suspect material for up to �
� 1,000 square feet of surface, and more samples beyond 1,000 square feet, etc.. [n order �
' for the contractor to proceed �vith restoration, renovation or demolition the suspect E
' materials have to be sampled and analyzed by a NVLAP accredited laboratory by �
� polarized light microscopy PLM methods.

CLIENT BACKGR4UND:
The client is planning to do remodel work in units 9 and 12 in the Lodge at Lions Head,
Vail,Colorado.

VISUAL INSPECTION & FINDINGS:
An inspection was conducted by Jim Baker of HealthSafe Inspections, [nc. on Thursday,
August 1 l, 201 1 in the atternoon. Suspect materials which �a�ould be disturbed during the
restoration/demolition/remodel/rcnovation were sampled. The materials covering more
than 32 square feet but less than 1,000 square feet of homogenous surfacing material
were identified requiring a minimum of 3 samples each. There �vas no viny�l flooring,
caulking, adhesives or other suspect building materials which �vould be disturbed in units
9 and 12 other than drywall texture and joint compound.
In Unit#9 the ceiling and walls are all homogenous te�ture. The exception is wall-
papered bathroams, but containing same date installation of drywall and taped joints with
homogenous joint compound. The plan is to do minor remodel in the kitchen,taking out
the non-loadbearing partition between the kitchen and living room. There will also be
remodel ���ork in three bedroom bathrooms. A total of 5 samples were taken in unit#9.
(n Unit#t2 all ceiling and �vall surfaces were original,the same homogenous texture and
paint color throughout the unit in all rooms. A master bedroom bathroom is planning to I
be remodeled along with two other bedroom bathrooms. A total of 3 sacnples werc taken
in unit#12.
LABORATORY DATA: '
The bulk samples were analyzed by PLM by a NVLAP accredited laboratory in
accordance with Colorado State Regulation 8 for the presence of asbestos mineral fibers.
