Dimond, Town Planner Community Development Mark Donaldson/VMDA Hans Oberlohr, Owner Representative Patricia Franke, Owner September 21, 201 1 Among the outstanding items for completion currently noted in the Town files, we submit this Application and supporting data to request modifications to the asphalt and arass landscape areas from the DRB Action Form of 8/13/2010. Specifically we request the changes noted as a"clouded revision" on Sheet AS1.1 dated September 21, 201 1(attached) as a departure from the original Sheet AS 1.1 dated August 12, 2010 (also attached). We met with Chad Salli, P.E. Project Engineer and Leonard Sandoval, Development Project Coordinator with Public Works, inasmuch as this work is largely in the Town Right-Of-Way. The result of that meeting was reaching agreement with them for Public Works to support our now requested Change in Approved Plans. The north road cut is beina eliminated and treated to conform to Town road improvements in this location. The proposed north edge of asphalt was spray painted white by Mr. Salli to memorialize the discussion and to specifically memorialize the specific Right-Of-Way adjustment. With regard to the Variances granted for garage in Front Yard Setback and to exceed allowable Site Coverage, we submit the following: 1. The granting of Variances for this undersized lot was determined not to be the granting of a special privilege. 2. These variances were logically approved to `level the field' when considering a standard 2 car garage and some excess of site coverage. 3. The garage does not exceed 600 square feet and is deemed normal and reasonable within this Zone District. 4. The modifications proposed herein, when considering the Lot Area actually reduces the site coverage by about 255 square feet (a little over 2% of the Lot Area). 5. The 2�d, north road cut is being eliminated as originally contemplated in the Variance Public Hearing and the modifications proposed herein appear to be acceptable to Public Works. We therefore further submit that no material change in the granting of the Variances is being requested with the modifications and that the Variances should remain unaffected. Rachel, upon your complete review of subject file and our proposal, please advise us if you feel differently about our request. If so, we can submit to proceed through the Variance process and Public Hearing for review and consideration. Thank you.
