RE: Permit Application - Fast Track Ramshorn Lodge
Weeks Remodel
We propose to combine unit 7 and unit 3 vertically via a set of stairs. This will be a complete
interior demo and rebuild which will require some structural re-do. Mark Mueller will supply
these structural drawings in approximately 8 days.
Although I am submitting a limited plan I expect our structural, electrical, mechanical and
architecturals will be complete and submitted prior to the end of our demolition phase. The
demolition phase will take two weeks to complete, I would like to begin about June 20
depending on your lead time for permit.
I have enclosed existing plan views, new plan views, exterior elevations, and condominium
approval for your review. The exterior alterations have been given staff approval by Town of
Vail Planners. Jim Curnutte is the Planner of record.

Dear John:
At the request of the Town of Vail Building Department, this office
has conducted a visual inspection of the final framing for the
above referenced project. This letter if to confirm our
involvement during the construction process and the preparation of
the structural drawings and specifications dated 22 June 1994 and
revised 19 July 1994. The following items are to be noted:
a) SHEAR WALLS-Complete the interior shear walls after finishing
all electrical, plumbing and insulation systems within the
walls.
b) INSPECTION REQUESTS-Address all items referenced on "Inspection
Requests" as prepared by the Town of Vail Building Department.
It should be understood that this of f ice was not present at the
site continuously during the construction process and
conseque:itially, unable to verify that every single construction
process wa� completed correctly. However, due to the frequency of
the �ite inspections and the constant coordination with the

Dear Mr Perkins:
The Town of Vail Community Development Department has received your application for the
proposed minor, exterior alteration of the Ramshorn Condominium, Suites 3 & 7, (ocated at
416 Vail Valley Drive.
Upon review of your application, the planning staff grants approval of the proposed minor,
exterior alteration to Suites 3 & 7, of the Ramshorn Condominiums as submitted on April 18,
1994. The approval granted by the planning staff is contingent upon the following conditions
of approval:
A. That the applicant or applicant's representative receive 100 percent approval
for the minor, exterior alteration, as proposed, from the Ramshorn
Condominium Association; and
B. A letter from the Ramshorn Condominium Association be submitted to the Town
of Vail Community Development Department verifying their approval of the
proposed request prior to the issuance of a building permit; and
C. That this planning staff approval is granted only for the proposed minor,exterior
alterations as submitted to the Community Development Department on April
18, 1994.

Dear Mr. Perkins:
David and Tracey Weeks, the owners of Ramshorn Units #3 and #7, are requesting some
changes to the exterior of the Ramshorn Building in an effort to remodel and connect
their two units.
Enclosed are enlarged photographs of the existing building with the changes that we
are proposing, as well as a letter from the structural engineer explaining his
confidence in the structural stability of the building as a result of these changes.
The attorney for the Ramshorn Homeowners Association has drafted a letter stating the
Board of Directors' positive recommendation for these changes as well as the
conditions of their approval.

In an effort to help you understand the changes we are proposing to the exterior of
the Ramshorn Building, the following is further explanation. Each numerical category
relates to the numerical legend on the architectural drawing.
#�1 The decks on the third floor south elevation are larger than the existing second
floor decks which are directly beneath. We will make these the 2nd floor the same
size as the 3rd floor.
#2 We will enlarge windows on the second floor south elevation to match the third
floor window size and configuration.
#3 At the south elevation, 1 st floor, we will replace an existing window on the west
side with a sliding glass door to match the east side existing sliding glass door.
#4 At the south elevation, 2nd floor, we will replace an existing door with plate
glass in order to place a built-in grill on the deck.
#5 At the east elevation, 2nd floor, we will add a window between two existing
windows to allow naturallight in the kitchen.
#6 At the east elevation, 2nd floor, we will add a window between the new #5 window
and the existing window to provide natural light at an interior desk area.
#7 We will move #7 window to the north 2'9".
#8 We will increase the #8 window to match the size of the existing #7 window and
move it south 6".

Ladies and Gentlemen: �
The Board of Directors of the Ramshorn Condominium Association
has received a request from Singletree Properties, Inc. , the owner
of Condominium Units C-4 and C-5 (commonly referred to. as Suite 3)
and Condominium Units C-9 and C-10 (commonly referred to as Suite
7 ) , asking that the • Board of Directors approve a proposed
remodeling of the four condominium units in such a manner that all
four units are incorporated into a single suite.
The proposal involves both the penetration of the general
common elements (the ceiling/floor structure between the units) and
the relocation of several windows which are located in the general
common element which is .the exterior wall of the Building. The
proposal is more specifically described in the material which is
enclosed, which has generally been prepared by the owner's
architect. The Declaration of the Ramshorn Condominium authorizes
the joinder of condominium units, which would seem to address the
ceiling/floor penetration, but prohibits any activities which would
� adversely affect the structural integrity of the structure. While
the authority to join units partly addresses the question of
penetrating the ceiling/floor, it does not relate to the relocation
of windows in the units . The Declaration authorizes the remodeling
of windows by owners, but not their relocation within the general
� common element which is the exterior wall of the Building.
Because the Condominium Declaration does not specifically
permit or prohibit the proposal, your Board of Directors has
decided that it is necessary to present the question of authorizing
the remodelling to all members of the Association. The Board of
Directors has decided to recommend the approval of the proposal,
provided that the conditions set forth below are complied with.
However, because the activities are not specifically �l�thorized by
the Declaration, and the Board of Directors has no au �rity to act
contrary to the Declaration, the Board has decided t ° �t unAnimous
consent of the owners is necessary. If approved b�� ".he Board of

Directors after the consent of the owners, the approval would be
conditioned upon the following:
1 . The Owner of the condominiums, its principals, and the
architect would be required to indemnify the Association and the
owners of all other condominiums against any claims arising from
the construction and renovation, and would be required to guarantee
that the structural integrity of the general common elements would
not be adversely affected by the construction or the project in its
entirety.
2 . The general common elements, including but not limited to
the Building, will be inspected before construction begins and
within thirty days after the completion of construction but, in any
event before the issuance of a Certificate of Occupancy (temporary
or permanent) , the general common elements, including but not
limited to the Building, grounds and landscaping, will be returned
to their condition prior to the commencement of construction, with
the exception of the modifications authorized under the program,
except as mutually agreed with the Board of Directors .
3 . All out-of-pocket expenses of the Association will be
reimbursed to the Association prior to the commencement of
construction (as to expenses billed prior to the commencement of
construction or prior to the issuance of any Certificate of
Occupancy (temporary or permanent) . Any out-of-pocket expenses not
paid by the Owner in accordance with the foregoing shall be paid
within ten days of demand, and, if unpaid, shall be a lien against
the condominium units which are being remodeled.
The purpose of this letter is to request your response to the
proposal, and this Board asks that you review the enclosed material
and return the enclosed response to this letter, indicating your
approval or disapproval of the project. The Board hopes to have
the responses of all owners by the 15th of April, and, therefore,
your early response to this inquiry would be appreciated.

PRECISE NATURE OF THE VARIANCE REQUESTED
The applicant requests to make his project LESS NON-CONFORMING than it cur-
rently is, by relocating an existing pool equipment building, and construc-
ting a new transparent sun room.
The existing pool equipment building protrudes eighteen feet into a twenty
foot setback area. A new pool equipment building would be constructed to-
tally within the allowable building area, totally out of the setback area.
The new pool equipment building would be approximately twenty-seven percent
smaller than the existing one, and would be tucked under an existing deck
in an existing recess in the building.
By comparison, the proposed transparent sun room would protrude only thir-
teen feet at its furthest corner into the setback (compared to the eighteen
feet of the existing pool equipment building) . The sun room would be at-
tached to the existing main building, rather than be detached, as the ex-
isting pool equipment building is.
The regulation involved is Section 18.22.060, Public Accomodations Dis- �
trict - Setbacks, of the Town of Vail Zoning Ordinance.
RELATIONSHIP TO OTHER USES AND STRUCTURES IN THE VICINITY
This proposal could only be welcomed by the users of this area. The changes
will .
1. Facilitate snow removal on Gore Creek Road, by reducing the existing en-
croachment into the setback by nearly thirty percent.
2. Replace an aging, utilitarian structure with a new, transparent struc-
ture which will be integrated into the existing main building.
3. Facilitate the proposed pedestrian/bicycle path which will link the vil-
lage with Gold Peak.

4. In general , greatly improve the appearance and function of this area. �
This area deserves the best design efforts, as literally every user of �,
Gold Peak travels by here, either on foot, by bus, or car.

The meeting was called to order by Diana Donovan in the absence of the
chairman, Duane Piper.
1 . Approval of minutes of May 12, 1986. A question was raised concerning a
request of Hopkins and Donovan for future parking studies. It was
determined that that had not been part of the motion for approval .
Hobbs moved and Schultz seconded to approve the minutes. The vote was 5-0 in
favor.
2. A request for side setbacks and a front setback variance in order to
build a residence on Lot 7, Vail Village lOth Filing. Applicants: John
Mueller and Frank Wyman
Kristan Pritz gave the staff presentation and explained the results of the
studies by Arthur Mears, P.E. and Jack Haney, P.E. who were designing an
avalanche mitigation structure for the residence. Haney stated that the design
for the mitigation structure would be in accordance with the report by Mears.
Staff felt the visual impact would be minimal and there definitely was
justifiable reason to allow relief from the strict 20 foot setback requirement.
Kurt Segerberg represented the client and explained that at first the design of
the house was wedge-shaped, but because of trying to save the large evergreens,
the design was changed. Osterfoss asked if any of the major trees would have
to be moved, and Segerberg replied that a large stand of aspens may be
impacted, but that they would try to protect those aspen as much as possible by
using manual labor rather than heavy equipment to construct the avalanche fences.
The fence was to be constructed of 2 x 8's of natural colors supported by
bracing every ten feet. There was a possibility that the fence would be bermed
to lessen the visual impact. Osterfoss wondered if there would be any damage
to adjacent properties as a result of the mitigation fences and was told that
because the ends of the fences are are brought out and upward, they would catch
much debris. Haney's letter to Segerberg stated, "These structures will be
designed to provide shedding of an avalanche event as well as to reasonably
contain flow within the subject property lines."
Hobbs moved and Hopkins seconded to approve the variance requests. The vote
was 5-0 in favor.

3. A re uest for a setback variance in order to ild a sun room and deck
at Unit 2 of the Ramshorn Lod e on Lot A ock 3 Vail Villa e 5th
Filin . A licants: Harold and Marsh 1 Cohn
Kristan Pritz showed site plans and elevat'orZs and ained that the Cohns had
received approval for a deck, spa, and landscaping. The sun room would be
constructed on the deck. She added that the PEC in October, 1985 had approved
a setback variance of 13 feet to allow a sun room on Unit 3 and to relocate an
existing pool equipment room. The existing lodge encroaches into the setback
area in several places ranging from 3 to 13 feet. The Ramshorn is well under
their allowable GRFA.
Dave Peel represented the Cohns and explained that the glazing of the sun room
would match the larger sun room approved for Unit 3. Pritz pointed out that
some landscaping had been removed in the latest drawing (which had been shown
on the previously approved drawings) and the staff felt the need for
landscaping as it had been approved. Donovan felt the need for bushes in front
of the fence. She also felt the board should relate to the Ramshorn the need
for a master plan on the Ramshorn.
Marshall Cohn, one of the owners, replied that the board should not feel a need
to be concerned, because the landscaping would be done as approved. Peel added
that the owners of the Ramshorn, the Gartons, had agreed to match Cohn's
sunroom when they proceeded with the unit 3 sunroom.
Hobbs moved and Schultz seconded to approve the variance request. The vote was
5-0 in favor.
4. A request for rear and front setback variances in order to construct a
trash enclosure, dining terrace, new entry/lobby and second floor dininA
deck at the Kiandra Lodge. Applicant: Sonnenalp Properties, Inc.
Kristan Pritz showed site plans and floor plans and explained the requested variances.
She stated that originally the staff had looked at the property as though it were one
lot, but technically two lots exist. Vail Associates owns part of Lot K and the
Sonnenalp owns part of Lot L. The staff was informed by the Sonnenalp attorney that
legally the two properties could not be treated as one lot due to the ownership
situation, even though the two properties function as one project.
The trash area would be reorganized and decrease the present encroachment. The
dining terrace on the east would replace four parking spaces. The staff felt
that it was positive to get rid of the sea of asphalt and replace it with an
outside dining deck. The proposed lobby and entry vestibule do not encroach
into any setback area, but the columns that support the new entry encroach into
the setback by 5 feet with a roof overhang of 11 feet. The staff felt the
column would not impact traffic entering or exiting the site, and the
appearance would be greatly improved as well as providing adequate lobby area
and a protected drop-off and loading lane for guests. The second floor dining
deck is over an existing ground floor patio which already encroaches into the
same area as the deck. The staff recommended approval of these variances.
Pritz added that the staff would like to see some screening around the utility
box that is located on Meadow Road and would like to see the planter remain
that now exists near the present dining terrace.

Forest Service with respect to this type of application. Viele
and Schultz concurred. Briner had problems with the location �
because even though slight, it would have a visual impact on �
adjacent property. Pylman stated that from a town-wide standpoint,
staff saw this as a benefit. He added that covenants on the land
would preclude this from happening if adjcent property owners �
were to oppose this.
Donovan moved and Viele seconded to approve the request per the �'
staff inemo and with the recommendation that Town Coucil send a �
etter to the Forest Service stating that the revious site was �
pre erre an t eir change in posture was unfortunate. T e vote
was 6-0 in favor of ap roval.

Kristan P itz explained hat encroachments into setbacks were

room. There we no negative impacts on snow removal, a future
sidewalk, or adjacent properties. Jim Morter, architect for the
proposal, stated that the proposal actually has a positive impact
on the area . Donovan commented that the design needs to be
compatible with the existing building. She also recommended th t
the DRB address the condition of the fence. Viele moved arid

Public Service and Mountain Bell to construct the sun room on t e ,)� �

3. Request for exterior alteration of an area under 10QJ square
feet in CCI in order to remodel the existing entries and a d
65 square feet to the Rucksack. Applicant: Ruc sack
Duane Piper stepped down as chairman and Jim Viele assumed the
chair . Tom Braun described the proposal and the criteria for �!
review. He stated that Sub-Area Concept #12 was directly related
to the proposal. This is a mid-block connection to Mill Creek.
It was felt that this addition in and of itself would not create
a great deal of difficulty in establishing this mid-block connec- ;
tion when considering the existing obstacles in place . Braun �'
reviewed the Urban Design Considerations and recommended approval.
Duane Piper, representing the applicant, gave the presentation. He
explained that the proposal would help increase transparency and �
create a more interesting street edge and focus on the entry to
Bridge Street. There was a� motion for approval by Briner ,
seconded by Schultz per the staff inemo. The vote was 5 in favor,
with Piper abstaining.

The minutes of the PEC meeting of September 23 were moved for
approval by Donovan and seconded by Viele. Vote was 6-0 in favor.
1. Request for a conditional use permit in order to construct a
ow power subscription radio transmitter facility on Tract
A, Potato Patch subdivision. Applicant: Stephens Communi-
cations
Rick Pylman gave the staff presentation and stated that the staff
recommended approval . He summarized the review criteria and
reminded the PEC of the zone amendment previously approved that
would allow low power subscription radio transmitters in the
Agricultural and Open Space zone district . The staff found
that the minimal impacts had been mitigated and were insignifi-
cant. Pylman read into the record several letters from property
owners in the Potato Patch subdivision : Two from Luc Meyer
against the proposal, 1 from Georges Boyer against the proposal,
telegram from Dr. Ivan Mindlan supporting the proposal , and phone
calls from JJ Collins , Larry Mullin , and Bob Charles all in
support of the proposal.
Steve Wherry , the applicant, summarized the process he had
followed to date and expressed concern with the Forest Service ' s
attitude of requiring him to relocate his transmitter facility.
He explained that he had tested a number of sites for relocation
and most sites did not work� because of site constraints. Joe
Macy of Vail Associates explained the process/dialogue that
had taken place with the Forest Service .
Briner asked questions concerning the technical aspects of the
signal . Donovan said the Town needs to put pressure on the
