street, not involving any new street or road or the extension of Municipal facilities and not adversely affecting the devel-

PLANNING AND ENVIRONMENTAL COMMISSION
PROCESS
Pre - application Meeting
A pre- application meeting with Town of Vail Staff is not required; however, highly recommended. The purpose of a pre -
application meeting is to identify any critical issues pertaining to the proposal and to determine the appropriate develop-
ment review process for an application. Town of Vail Planning Staff reserves Thursday afternoons for pre - application
meetings. Please call the Development Review Coordinator at 970 - 479 -2128 to schedule a meeting for Thursday after-
noon.
Deadlines and Meeting Dates The Planning and Environmental Commission meets on the 2nd and 4th Mondays of
each month beginning at 1:00 pm. Complete applications are due in the Office of Community Development no later than
12:00 noon on the submittal deadlines below:

Submittal
Submit all required information under the submittal requirements section of this application by the deadlines stated above.
Incomplete applications will not be processed. Upon receipt of a complete application, the Community Development De-
partment shall review the submitted materials for general compliance with the appropriate requirements of the zoning
code. If the application is not in compliance with zoning code requirements, the application and submittal materials shall
be returned to the applicant with a written explanation of non - compliance.
Recording
Following the review and approval of the plat, the applicant shall produce 1 mylar of the plat for signatures and recording.
The applicant shall collect all signatures except the Town Administrator and the County Recorder, and submit the signed
mylar to the Community Development Department, 75 South Frontage Road, Vail, CO. The Town Clerk shall RECORD
THE mylar with any additional declarations or covenants submitted. The mylar shall be accompanied by the recording
fees:
0 For mylar: $11 for first page, $10 for ea additional page
For other declarations. covenants etc: $6 for first page, $5 for ea additional page
Mylar format shall be in India ink, 24 inches x 36 inches, scale of 100 feet = 1 inch or larger, margins of 1 1 12 inches — 2
inches, and shall match the approved paper copy of the plat.

Planning and Environmental Commission Meeting Requirements
1. The applicant, or their representative (s), shall be present at the Planning and Environmental Commission_ public
meeting. The item will be postponed if the applicant fails to appear before the Planning and Environmental Commis-
sion, on their scheduled meeting date.
SUBMITTAL REQUIREMENTS
Please submit the following items to proceed.
• Completed application form including owner's signature (cover sheet).
• Application fee
.� ❑ Title report, including Schedules A & B to verify ownership and easements.
• Joint Property Owner Written Approval Letter, if applicable (pg. 2). This form is applicable to all applicants that
share ownership of the subject property. For example, the subject property where construction is occurring is a
duplex, condominium or multi- tenant building. This form shall be completed by the applicant's neighbor/ joint prop-
erty owner. In the case of a multiple - family dwelling or multi- tenant building, the authority of the association shall
complete this form.
❑ Two paper copies of the plat including the following:
• Paper size shall be 24 inches by 36 inches
• Scale of 100 feet = 1 inch or larger
• Margins of 1 1 12 inches — 2 inches
• Accurate dimensions to the nearest one - hundredth (0.01) of a foot for all lines, angles and curves used to
describe boundaries, streets, setbacks, alleys, easements, structures, areas to be reserved or dedicated for
public or common uses and other important features. All curves shall be circular arcs and shall be defined
by the radius, central angle, arc chord distances and bearings. All dimensions, both linear and angular, are
to be determined by an accurate control survey in the field which must balance and close within a limit of
one in ten thousand (10,000).
• North arrow and graphic scale.
• A systematic identification of all existing and proposed buildings, units, lots, blocks, and names for all
streets.
• Names of all adjoining subdivisions with dotted lines of abutting lots. If adjoining land is unplatted, it shall be
shown as such.
• An identification of the streets, alleys, parks, and other public areas or facilities as shown on the plat, and a
dedication thereof to the public use. An identification of the easements as shown on the plat and a grant
thereof to the public use. Areas reserved for future public acquisition shall also be shown on the plat.
• A written survey description of the area including the total acreage to the nearest appropriate significant
figure. The acreage of each lot or parcel shall be shown in this manner as well.
• A description of all survey monuments, both found and set, which mark the boundaries of the subdivision,
and a description of all monuments used in conducting the survey. Monument perimeter per Colorado stat-
utes. Two (2) perimeter monuments shall be established as major control monuments, the materials which
shall be determined by the town engineer.
• A statement by the land surveyor explaining how bearing base was determined.
• The proper plat title format for filing a plat in the town, as outlined in section 13 -11 -1, Plat Title Formats,
Vail Town Code.
• A certificate by the registered land surveyor as outlined in section 13 -11 -4, Surveyor's Certificate, Vail
Town Code as to the accuracy of the survey and plat, and that the survey was performed by him /her in ac-
cordance with Colorado Revised Statutes title 38, article 51.
• A certificate by an attorney admitted to practice in the state, or corporate title insurer, that the owner(s) of
record dedicating to the public the public rights of way, areas or facilities as shown thereon are the owners
thereof in fee simple, free and clear of all liens and encumbrances except as noted (According to Section
13 -11 -5, Title Certificate, Vail Town Code).
• The proper form for approval of the plat by the Town of Vail as per Section(s), as they apply, 13 -11 -7, Town
Council Certificate, 13 -11 -8, Planning and Environmental Commission Certificate, and/ or 13 -11 -9, Admin-
istrator Certificate, Vail Town Code.
• The proper form for filing of the plat with the Eagle County clerk and recorder as per Section 13 -11 -6, Clerk
and Recorder Certificate.
• Certificate of dedication and ownership as per Section(s) 13- 11 -11, Certificate of Ownership, and or Sec-
tion 13 -11 -3, Certificate of Dedication for Mortgage Holder or Deed of Trust Holder, Vail Town Code.
Should the certificate of dedication and ownership provide for a dedication of land or improvement to the
public, all beneficiaries of deeds of trust and mortgage holders on said real property will be required to sign
the certificate of dedication and ownership in addition to the fee simple owner thereof as per Section(s) 13-
11-2, Certificate of Dedication and Ownership, and /or Section 13 -11 -3, Certificate of Dedication for Mort-
gage Holder or Deed of Trust Holder, Vail Town Code.
❑ A certificate by the treasurer of Eagle County that will certify that the entire amount of taxes due and payable upon all
parcels of real estate described on the plat are paid in full, as per Section 13- 11 -10, Certificate of Taxes Paid, Vail Town
Code.
❑ Other data, certificates, affidavits, or documents as may be required by the administrator or planning and environmental
commission or council in the enforcement of these regulations, may include but is not limited to:
• Complete and final environmental impact report if required by the zoning ordinance.
• Complete engineering plans and specifications for all improvements to be installed, including, but not limited to,
water and sewer utilities, streets and related improvements, pedestrian and bicycle paths, bridges and storm
drainage improvements.
• Maps at the same scale as the final plat showing existing topography and proposed grading plan (contour inter-
val requirements same as preliminary plan), a landscape and /or revegetation plan showing locations, type and
sizes of existing and proposed vegetation.
• A map the same scale as the final plat depicting all high and moderate avalanche hazard areas, forty percent
(40 %) and higher slope areas and 100 -year floodplain areas as defined in the hazard ordinance of this codel .
• Copies of any monument records required of the land surveyor in accordance with Colorado Revised Statutes
title 38, article 53.
• Any agreements with utility companies when required.
• Protective covenants in form for recording.
Please note that only complete applications will be accepted. All of the required information must be
submitted in order for the application to be deemed complete.

Note: Pursuant to CRS 10 -I1 -122, notice is hereby given that:

Note: Effective September 1, 1997, CRS 30 -10 -406 requires that all documents received for recording or filing
in the clerk and recorder's office shall contain a top margin of at least one inch and a left, right and bottom
margin of at least one half of an inch. The clerk and recorder may refuse to record or file any document that
does not conform, except that, the requirement for the top margin shall not apply to documents using forms
on which space is provided for recording or filing information at the top margin of the document.
Note: Colorado Division of Insurance Relations 3 -5 -1, Paragraph C of Article VII requires that "Every
title entity shall be responsible for all mat ers which appear of record prior to the time o recording
whenever the title entity conducts the closin and is responsible for recording or filing of legal
documents resulting from the transaction winch was closed ". Provided that Land Title Guarantee
Company conducts the closing of the insured transaction and is responsible for recordin the
legal documents from the transaction, exception number 5 will not appear on the Owner s Title
Policy and the Lenders Policy when issued.
Note: Affirmative mechanic's lien rotection for the Owner may be available (typicall by deletion
of Exception no. 4 of Schedule B, Section 2 of the Commitment from the Owner s Policy to be
issued) upon compliance with the following conditions:
A) The land described in Schedule A of this commitment must be a single family residence which
includes a condominium or townhouse unit.
B) No labor or materials have been furnished by mechanics or material -men for purposes of
construction on the land described in Schedule A of this Commitment within the past 6 months.
C) The Company must receive an appropriate affidavit indemnifying the Company against un -filed
mechanics and material -men's liens.
D) The Company must receive payment of the appropriate premium.
E) If there has been construction, improvements or mayor repairs undertaken on the property to be purchased
within six months prior to the Date of the Commitment, the requirements to obtain coverage
for unrecorded liens will include: disclosure of certain construction information; financial information
as to the seller, the builder and or the contractor; payment of the appropriate premium fully
executed Indemnity Agreements satisfactory to the company, and, any additional requirements
as may be necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circumstances for labor or material for which the insured
has contracted for or agreed to pay.
Note: Pursuant to CRS 10 -11 -123, notice is hereby given:
This notice applies to owner's policy commitments containing a mineral severance instrument

Commitment for Title Insurance

FIRST AMERICAN TITLE INSURANCE COMPANY, a California corporation ( "Company "), for a valuable consideration, commits to issue its policy or policies of title insurance, as
identified in Schedule A, in favor of the Proposed Insured names in Schedule A, as owner or mortgage of the estate or interest in the land described or referred to in Schedule A,
upon payment of the premiums and charges and compliance with the Requirements; all subject to the provisions of Schedules A and B and to the Conditions of this Commitment.
This Commitment shall be effective only when the identity of the Proposed Insured and the amount of the policy or policies committed for have been inserted in Schedule A
by the Company.
All liability and obligation under this Commitment shall cease and terminate six (6) months after the Effective Date or when the policy or policies committed for shall issue,
whichever first occurs, provided that the failure to issue the policy or policies is not the fault of the Company.
The Company will provide a sample of the policy form upon request.
This Commitment shall not be valid or binding until countersigned by a validating officer or authorized signatory.
IN WITNESS WHEREOF, First American Title Insurance Company has caused its corporate name and seal to be affixed by its duly authorized officers on the date shown in Schedule A.
CONDITIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquired actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting the estate or interest or mortgage thereon
covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved
from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such knowledge. If the proposed
Insured shall disclose such knowledge to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien encumbrance, adverse claim or other
matter, the Company at its option may amend Schedule B of this Commitment accordingly, but such amendment shall not relieve the Company from liability previously incurred
pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included under the definition of the Insured in the form of policy or
policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions
shown in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event shall such liability exceed the amount
stated in Schedule A for the policy or policies committed for and such liability is subject to the insuring provisions and Conditions and Stipulations and the Exclusions
from Coverage of the form of policy or policies committed for in favor of the proposed Insured which are hereby incorporated by reference and are made a part of this
Commitment except as expressly modified herein.
4. This Commitment is a contract to issued one or more title insurance policies and is not an abstract of title or a report of the condition of title. Any action or actions or
rights of action that the proposed Insured may have or may bring against the Company arising out of the status of the title to the estate or interest or the status of
the mortgage thereon covered by this Commitment must be based on and are subject to the provisions of this Commitment.
5. The policy to be issued contains an arbitration clause. All arbitrable matters when the Amount of Insurance is $2,000,000 or less shall be arbitrated at the option of either
