Subject: Crossroads Development Preliminary Site Plan
Dear Greg:
Thank you for the opportunity to review the preliminary proposed site plan for the
redevelopment of the Crossroads property in Vail. The Eagle River Water & Sanitation
District (District) would like to express concern over the proposal related to
encroachment of the development structure into the public right -of -way. The District is
in the process of replacing water and sewer mains throughout Vail and our experience has
indicated that Vail rights -of -way are, in many areas, constrained by structures and private
improvements. These encroachments limit workable area in the public way and
significantly increase construction costs for rehabilitation and repair of utilities.
Constrained rights -of -way may limit the ability of the District to adhere to Public Health
Department requirements for separation of water and sanitary systems without mitigation.
It is the opinion of the District that encroachments into the public rights -of -way
throughout Vail increase costs to the taxpayers for public and utility services. The
District would respectfully encourage the Town to require that rights -of -way be kept
clear of structures and available for public uses.
