employees, agents and tenonts (and the employees and agents of such tenants) of the commercial units designated C-1, C-2,
C-3, C-5. C-6, C-7, and any subsequent resubdivision thereof, (the "C—Units"), a perpetual non—exclusive easement on, across
and through certain portions of Unit C-4 of this condominium mop for the purpose of ingress and egress to those portions of
this condominium map designated LC.E.—C.—Loading Dock ("Loading Dock") and for the transport of freight. supplies, stock a�d
materials between the C—Units and the Loading Dock. Exercise of the easement rights contained herein shall be occomplished in a
reosonoble and pn�dent manner so as not to unreosonably interfere with the activities within Unit C-4.
12. Vail Resorts Development Compa�y hereby creates, grants and conveys to The Vail Corporation, a Colorado caporotio� doing
business as Vail Associate, Inc., its successors and ossigns, o perpetual non—exclusive easement on, oround and through those
portions of the building within this condominium map containing certain water and gos lines, specifically water
lines ond gas lines which supply water and gos to odjacent property, which easement shall be used
for the purpose of mointaining, repairing ond replacing such water and gas lines. Notwithstanding such conveyance of easement,
The Vail Corporation is under no obligation to maintoin, repair ond/or replace such water and gas lines.
13. The total restdential denstty permitted on the lands zoned Ski Base/Recreation District (the "Golden Peak Landa") purouant to
Section 18.39.180 of the Municipal Code for the Town of Voil, Colorado is six multi—family dwelling units. Such six dwelling units
are hereby restricted, limited and assic,�ed to the land contained within this condominium map. No additional density rights for the
Golden Peok Lands are created or permitted by this condominium map. Moreover, for zoning purposes, Porcel 1(of which this
condominium map is a port) and Parcel 2, occording to the map of Golden Peak Ski Base and Recreation District Porcel recorded in
Book 455 at Page 934, ore to be treated as one tot with no more than six dwelling units allowed on the combined area of the
two lots.
14. The grants or re�ervations of easement� �et forth on this plat (collectively, the
"Easements") shall inure only to the benefit of the beneficiaries thereof and their respective
successors ond asslgns (collectively, the "Beneflciaries"). Nothing contained in the
Easements shall confer upon any parson or entity other than the Beneficiaries ony right to
benefit from or enforce the Easements. The Beneficiariea shall have the sole right, power
and authority to amend, supplement or modify the Easements by written instrument
recorded in the records of the Eagle County, Colorado, Clerk and Recorder.
15. Vail Resorts Dev�elopment Company, a Colorodo corporotion, hereby creates, grents and conveys to Va�
Associates, Inc., a Colorado Corporation, a perpetual non—exclusive easement and right—of—way on, over,
and across those portions of this Plat designated "Utility Easement" for the purposes of the following,
and without limitation: (A) using, installing, constructing, maintaining, operating, repairing and
replacing drainage, woter and utility facilities (and appurtenances thereto) of ony kind or
nature whatsoever, including but not limited to. storm drainage facilities, �re hydrants and
reloted fire protection devices, so�itary sewer lines, water lines. underground electric lines,
gas lines, communication lines (telephone, cable television, fiber optic, and other
communication focifities) and (B) drainage of water flowing from other londs, together
with a perpetuol right of ingress ond egress to and from such Easements.
16. For purposes of this General Note 16, the lands shown on sheet 2 of this condominium map as
"Golden Peak Condominiums" and more particularly described in the Certificate of Dedication and Ownership of
this condominium map are called the "Condominium Lands". Except for the Condominium Londs, no portion
of Parcel 1, Golden Peak Ski Base and Recreation District Parcel, accwding to the map recordad in Book 455
ot Page 934 ("Parcel 1") is subjected to or affected by the condominium regime created by the Golden Peak
Condominlum Decloration (see General Note 9) ond this condominium map (token together, the "Golden Peak
Condominiums"). Parcel 1 excepting therefrom the Condominium lands is free and clear of, separate and distnct
from ond in no woy or monner a part of, the Gdden Peak Condominiums.
