For what it is worth, if the Council asks why I voted against the EHU exchange, here are my reasons:
1. The Applicants' unit is not a "non-performing" unit. The modified exchange ordinance was intended to get non-performing EHU's off the books.
2. The Applicant's unit has a garage. This is a desirable asset in the world of EHU's.
3. We were not just addressing the exchange of one EHU but possibly all 6- all with garages.
4. I was not against the revisions to the SDD, only that the motion that we made did not address the loss of the garages. Simply sayiong that the new ehu has to meet the TOV's parking
requirements is not equivalent to having a garage.
I also felt that Dominic's testimony was misleading when he argued that the ordinance was modified because no one wanted to exchange a unit. As we both know, the exchange ordinance
was modified to take out the requirement that the TOV be given title to the deed restricted ehu- a huge dis-incentive to the desired result.
I understand that it is desirable to get a 2x larger ehu in exchange for the ones in the SDD. But I felt that allowing the Applicant to exchange a "performing" ehu with a garage for
one that doesn't have one is not in the Town's best interest. Ride the bus or not, many employees in this valley do have cars and getting them off the street is good for the TOV as
well.
