Drawer 5400 Aron, Colorado 81620 RE: Un- Approved Sanitary Scwcr — Vail Mountain View Condos Dear Mr. Cuthberthson, As you know there is an wt- approved sanitary sewer pipe located at the base of a boulder retaining wall along the bike path on the south side of the above project. WVC Company {WVC} wants to clearly state that we are not responsible for this issue and that this issue is derived from a design flaw. WVC has had two meetings with the Town of Vail (TOV) in which this particular issue has come up. Approximately two weeks ago, at our first meeting with TOV, WVC expressed our position regarding the damaged tripe and convent for a viable repair_ The TQV shared the same concern and further advised that the repair must be completed prior to Memorial Day. On the 23` of April representatives froin WVC, TOV, Vail fire Department, Eagle River Water & Sanitation (ERWS), R.A. Nelson and a Representntivu for the Project Owner met to review and discus this matter in greater detail. I have been advised that although a necessary repair was not agreed upon the overwhelming opinion as to why the pipe failed was detemined. Representatives fmm ERWS, Cindy Schmidt and Danny Doig, along with Leomird Sandoval agree that as this pipe does not have the minimum four feet of cover required by ERWS and has been damaged by the several thousand pound boulder located directly above the pike_ Moreover, attendces, of the meeting, along with WVC, believe that a poor design lead to the damage and u Itimately the Engineer of Record must provide direction in order to remedy this issue. As you are aware WVC does not carry any design responsibilities within our contract agreement with R.A. Nelson. The pipe was installed per the projecl plans and spcciftcations. Therefore, WVC fulfilled all requirements of the contract agreement_ At this time WVC feels the Engineer of Record should review the current conclition of the pipe and provide direction on how to resolve the issue while meeting all local requirements.
