Frontage Road Vail, folorado S 1651 Re: Bishop Park Stream Tract Encroachment Dear (ouncil Members, On behalf of the Bishop Park Condominium Association, I am writing to formally request to create a"transition" zone and immortalize a right to encroach into the Stream Tract between the Bishop Park SDD and Gore [reek. In efforts to be completely open and forthcoming, the Bishop Park Condominium Association would like to clarify and aeate a "Memorandum of Understanding" with the Town of Vail that creates a proper and aesthetically pleuing transition zone between their structures and the aeek as they have been requested to stop maintaining the Stream Tract as of spring 201 I. Since Bishop Park is a pre-existing Special Development District and built to 0' setbacks on most of its property lines, to stop maintaining this area to exactly the property boundaries creates a very undesirable, straight line transition and unnaturai condition that seem undesirable for both parties. Per the attached site diagram, the Association would like to install a free-form steel edge that denotes the limits of where they would maintain lawn and manicured landscaping. This natural, freeform line would follow the natural topography and work around existing trees and vegetation features to create a more natural transition between the stream tract and Bishop Park. Again, this is a desirable and natural solution to maintain the Stream Tract as the Tawn desires u well u create a transition that does not mimic a harsh straight line u a property line is likely to create. In efforts to make this a jaint, win/win for the Town and the Association, Bishop Park would install the edging, as well as maintain the lawn to that line, including onto Town owned property. In addition, they would remove all existing irrigation lines within the stream tract u well as plant additional native vegetation such az wildFlowers and natural gruses to restore this area to its native state. � We hope this is an open and upfront way to create a desirable and mutually beneficial solution that enhances both properties and we look forward to discussing this proposal further. � Sincerely, cv K1�W 3 Kyle H.
