The unit was fonnerly occupied by a tenant known as Mountain Dog which ran a retail storc. The owner of Unit 3 is Staufer Commercial, LLC (Staufer) The Villa�e Inn Plaza-Phase V Condominiums are ooverned by the Declaration recorded in Book 478, Page 378 ofthe Eagle County records. The Association is the Association named in that Declaration. Pursuan[ to the Declaration, the Association is responsible to administer, conserve, manage, maintain, repair and replace the common elements. Unit owners may alter or improve their units but in doina so, the owner may not impair, impede or interfere with the �eneral common elements, the structural soundness of the building or any easement whether for the Associ�tion or any other unit owncr. The Association has not been informed oftl�e spccific intended use of Unit 3 other than as a deli associated with the operations of the La Bottega restaurant in the same building. Recently, La Bottcga commeneed remodeling of Unit 3. 'I�he Association's properry manager questioned the contractor abou[ what was involved in the remodel and learned that the remodel included new cooking and related I'acilities (vent, �rease trap lines. etc.), access to and use of the gcneral common element spaces and changes to the general common element electrical servicc panel for the building. Staufer was kind cnough to provide thc Association's property manager with hard copies of the plans which confirmed thc scope of work as involving the use and access to general common clements. Plcase be advised that the Associalion has not aiven its consent or approval to Uic remodeling now being conducted by La BolLega. La 6ottega has not discussed the remodel with the Association nor sought its approval of or consent to the remodelina work or the use of or potential alterations to the general conunon elements. A[ this time, the Association does nor have sufficient information regarding thc remodel to be ablc to evaluate il'it will hinder, impair or impedc the gener�l common clements. Por lhis reason, the Association would prefer that work avoid lhe general common clements until sufficient infonnation is known that will allow the Association to make an informed decision.
