TEMPORARY RESTRAINING ORDER
THIS MATTER, coming to the Court's attention pursuant to the Plaintiff's Verified
Motion for Issuance of Temporary Restraining Order and/or Preliminary Injunction and Verified
Complaint, and the Court having reviewed the same and it appearing to the Court that, unless a
Temporary Restraining Order issues, Plaintiff will suffer immediate and irreparable injury in that
the Defendants may cause harm to the property in violation of applicable law and the Association's
governing documents.
IT IS ORDERED that, pending further hearing and Order of this Court, TNG Holdings,
LLC, Arthrex, Inc. and J.L. Viele Construction, Inc., together with their employees and agents, are
RESTRAINED AND ENJOINED FROM CONSTRUCTING OR OPERATING A
SURGICAL SHILLS TRAINING FACILITY OR LABORATORY in Unit C-10 of the Vail
Gateway Plaza Condominium.
This TEMPORARY RESTRAINING ORDER is issued upon notice to the Defendants,
through their registered agents, Tom Greenauer, David Bumpous and David D. Viele, and their
attorney, Robert L. Sperberg.
IT IS FURTHER ORDERED:
a. Plaintiff's Motion for Issuance of a Preliminary Injunction is scheduled for a hearing
before this Court on the day of 1 201_at
b. Plaintiff shall, as a condition of issuance of the Temporary Restraining Order, post
