May 30, 2006 Mr. Tom Kassmel Department of Public Works&Transportation 1309 Elkhom Drive Vail, CO 81657 RE: Vail's Front Door—Eacavation Permit Dear Tom, Pursuant to our conversation earlier today, Hyder Construdion Inc. hereby recognizes that until such time that executed tie back agreements between Vail Resorts Development Company and the South Lodge Tower and Vail Resorts Development Company and The Lodge at Vail, no work related to demolitioq excavation and shoring adjacent to these properties will take place. According to Vail Resorts Development Company the aforementioned agreements are imminent. Hyder Construction will submit these agreements to the Town of Vail for approval prior to commencing work related to the excavation adjacent to these two properties. Additiona.11y, in response to the Site Staging&Access Plan dated,May 22, 2006, Hyder Construction will maintain access to the previously designated delivery zone adjacent to Chair One until such time as either the improvements north of the Chute are completed and The Chute open to through tr�c or Vail Road is open to cocrtinuous tr�c.
