As you may recall the Strata (then Fogata) project (major exterior alteraMon and CUP) was originally approved by the PEC on 10/22/2007. That approval is valid for two years unless an administraMve extension is granted or a building permit is issued or another PEC approval is granted. Subsequent to that approval an amendment to the major exterior alteraMon/CUP was approved by the PEC on 6/6/2008 and again valid for a period of two years effecMvely extending the approval to 6/6/2010. A DRB Page 2 of 2 approval was also granted on 6/6/2008 (valid for one year). The Strata project was found to be exempt from the Use Tax Ordinance (2-8-3 (A)) since the project received an approval prior to January 1, 2008. It is our understanding that if this project construcMon is commenced or a building permit issued by 6/6/2010 then the project will remain exempt from the use tax even if another DRB extension is necessary.
