Hi MaJ and George:
I am wriMng to confirm our understanding of some issues as they relate to
the Strata Project. As you may recall the Strata (then Fogata) project
(major exterior alteraMon and CUP) was originally approved by the PEC on
10/22/2007. That approval is valid for two years unless an administraMve
extension is granted or a building permit is issued or another PEC approval
is granted.
Subsequent to that approval an amendment to the major exterior
alteraMon/CUP was approved by the PEC on 6/6/2008 and again valid for a
period of two years effecMvely extending the approval to 6/6/2010. A DRB

approval was also granted on 6/6/2008 (valid for one year).
The Strata project was found to be exempt from the Use Tax Ordinance (2-8-3
(A)) since the project received an approval prior to January 1, 2008.
It is our understanding that if this project construcMon is commenced or a
building permit issued by 6/6/2010 then the project will remain exempt from
the use tax even if another DRB extension is necessary.
Can you please confirm this understanding?
