Your appeal form states that the action or decision being appealed is proposed use of Unit C-10, Vail Gateway Building, Vail, Colorado. Regretfully, I am writing to inform you that the appeal filed on behalf of the Vail Gateway Plaza Condominium Association, Inc. is untimely, and therefore, shall not be heard by the Planning and Environmental Commission. This is based upon Section 12-3-3.3 of the Zoning Regulations of the Town of Vail, dated records maintained by the Town of Vail Community Development on building permit number B11-0274 (Unit C-10, Vail Gateway, tenant improvement) and legal advice of the Town Attorney. Pursuant to Section 12-3-3.3, Zoning Regulations of the Town of Vail, an appeal of an administrative action or decision must be filed within 20 days of the date that the decision becomes final. In this case, the administrative action or decision occurred on the date that building permit number B11-0274 was approved and signed off for issuance by my Department. The building permit was approved and signed off for issuance on September 21, 2011. Section 12-3-3.3 further states that the action or decision of the administrator shall become final at the first Planning and Environmental Commission ("PEC") meeting after the action or decision is made, unless called up for review by the PEC. The first meeting after the action or decision was made occurred on September 26, 2011. The approved minutes of the PEC meeting on September 26th verify that a request for a call up by the PEC did not occur. According to Town records, your appeal form was filed with the Town of Vail Community Development Department via hand delivery on January 4, 2012. . � - Included with my letter are the appeal documents and materials received by my Department on January 4, 2012.
