I am forwarding a copy of this correspondence to Bill Anderson, General Manager of Lion Square Lodge, to ensure that the home owner association is aware of your concerns. I encourage you to contact Mr. Anderson and your home owner association directly to better understand the details of the Lion Square Lodge East redevelopment proposal and the impacts of this proposal to your property. I have discussed the 2011 proposed Lion Square Lodge East redevelopment project in-person and by phone with your associate Carol Hymers (my apologies for any misspelling), but must not have effectively answered your questions through her. The issues of parking, proximity of additions to the ski yard, and employee housing mitigation were all addressed in the Town of Vail’s review of the proposed Lion Square Lodge East redevelopment applications. In July 2011, the Lion Square Lodge East represented by Bill Anderson, General Manager of Lion Square Lodge, and architect Chip Melick, Melick Associates Inc., submitted a Major Exterior Alteration Application and an Application for Design Review – Additions for review by the Town of Vail. These applications proposed additions to the existing Lion Square Lodge East and a re-skin of the exterior building materials. This 2011 proposal is similar to a 2006 approved redevelopment project that the Lion Square Lodge East chose not to construct. The Major Exterior Alteration Application was approved by the Planning and Environmental Commission at its August 22, 2011, public hearing and the Application for Design Review – Additions was approved by the Design Review Board at its September 7, 2011, public hearing. The Lion Square Lodge East has not yet submitted any building permit applications, and the Town of Vail has not issued any building permits, for this project. On July 24 and August 14, 2006, the Planning and Environmental Commission held public hearings on similar applications to renovate the Lion Square Lodge East building. The 2006 redevelopment proposal included a joint application submitted by Lion Square Lodge and Vail Resorts for an: “amendment to Chapter 5, Detailed Plan Recommendations, Lionshead Redevelopment Master Plan, to further identify opportunities for the future redevelopment of the Lion Square Lodge, located at 660 West Lionshead Place/Lot 1, Vail Lionshead Filing 1, Addition 1, and setting forth details in regard thereto.” These amendments to the Lionshead Redevelopment Master Plan included allowances for the existing Lion Square Lodge East building to expand within the 10 foot side setback area adjacent to Vail Resort’s ski yard property. On August 14, 2006, the Planning and Environmental Commission forwarded the Vail Town Council a recommendation of approval for the master plan amendments. The Vail Town Council held a public hearing on these Lionhead Redevelopment Master Plan amendments, including the allowances for additions to the Lion Square Lodge East building in the east side setback area, on August 15, 2006. The Vail Town Council approved these master plan amendments through the adoption of Resolution No. 17, Series of 2006, (see attached). Similar to the 2006 approved redevelopment proposal; in 2011, Lion Square Lodge East proposed additions to the existing building in the setback area adjacent to Vail Resort’s ski yard property. At its August 22, 2011, public hearing, the Planning and Environmental Commission found that the Lion Square Lodge East redevelopment proposal is consistent with the recommendations of the Lionshead Redevelopment Master Plan. Similar to the 2006 approved redevelopment proposal; Lion Square Lodge East is again coordinating the proposed redevelopment with their adjacent property owner Vail Resorts. Attached is a copy of an August 19, 2011, letter signed by Frederick A Oltho, President, Lion Square Condominium Association, and Chris Jarnot, SVP and COO of Vail Mountain, The Vail Corporation, providing the Town of Vail notice that Lion Square Lodge East and Vail Resorts: “are working together in order to address certain matters arising in connection with the proposed renovation project for LSL. Specifically. certain LSL landscaping improvements are being proposed to be installed on the Ski Yard and certain building elements are being proposed for construction within setback areas on the LSL land which impacts the LSL property and the Ski Yard.” A copy of the executed, final agreements between Lion Square Lodge East and The Vail Corporation must be submitted to the Town of Vail by Lion Square Lodge East with their building permit application. Again, Lion Square Lodge East has not submitted any building permit applications for this redevelopment project at this time. The Lion Square Lodge East is located in the Lionshead Mixed Use 1 Zone District and pursuant to Section 12-7H-16, Parking and Loading, Vail Town Code, the parking requirements for the proposed redevelopment of this building are established in Chapter 12-10, Off Street Parking and Loading, Vail Town Code. Lion Square Lodge East is located within the “commercial core areas” designation of this chapter and pursuant to Section 12-10-10, Parking Requirement Schedule, Vail Town Code, the Lion Square Lodge East is required “1.4 spaces per dwelling unit.” The residential parking requirements for Lion Square Lodge East are based upon the number of dwelling units and not the square footage of residential floor area. Pursuant to Section 12-10-4, Additions or Changes, Vail Town Code: “For additions or enlargements of any existing building or change of use that would increase the total number of parking spaces required, the additional parking shall be required only for such addition, enlargement or change and not for the entire building or use.” The 2011 Lion Square Lodge East redevelopment proposal does not increase the number of dwelling units on the site. With no proposed increase in the number of dwelling units, there is no Vail Town Code requirement for new parking spaces to be constructed with the Lion Square Lodge East redevelopment project. While the Vail Town Code does not require additional parking for the proposed additions to the Lion Square Lodge East building, it does not preclude Lion Square Lodge East from submitting development applications to construct new parking spaces. Based upon your statement that “We have parking issues every day during the ski season, and we have had those problems for more than 20 years”, I encourage you to express your concerns to the home owner association and request that the association amend their development applications to include additional new parking. On May 20, 2008, the Vail Town Council adopted Ordinance No. 1, Series of 2008, establishing employee housing mitigation requirements for new construction and redevelopment construction through Commercial Linkage and Inclusionary Zoning . Pursuant to Chapter 12-24, Inclusionary Zoning, Vail Town Code, the Lion Square Lodge East must “mitigate its direct and secondary impacts on the town by providing employee housing mitigation at a rate of 10% of the total new GRFA” (gross residential floor area). At its August 22, 2011 public hearing, the Planning and Environmental Commission imposed a condition of approval upon the Lion Square Lodge East redevelopment project: “Prior to requesting a temporary or final certificate of occupancy for this proposal, the applicant shall mitigate 1,365 sq. ft. of employee housing floor area in accordance with the requirements of the Chapter 12-24, Inclusionary Zoning, Vail Town Code.” Again, the Lion Square Lodge East has not yet submitted any building permit applications, and the Town of Vail has not issued any building permits, for this project; so the required employee housing mitigation has not yet been provided by the applicant. The provisions of Chapter 12-24, Inclusionary Zoning, Vail Town Code, do not preclude Lion Square Lodge East from proposing employee housing mitigation beyond the minimum standards of the Vail Town Code. If you believe Lion Square Lodge East should be providing additional employee housing mitigation, I encourage you to express your concerns to the home owner association and request that the association amend their development applications to include additional mitigation.
