In the meetings we had with staff prior to the submittal, there seemed to be a general support for the idea of allowing a property owner to ask the question and have a process to review the proposal. We are kind of in the dark right now as to what the staff is thinking. It sounded as though you are working on a letter but perhaps it would be quicker or easier to have a conversation. We are available to meet at almost any time tomorrow or Thursday if that would work for you. Another approach that we have discussed in lieu of this text amendment is to look at the interpretation of what floor in the Treetops building this office use actually occupies. In doing the research for this proposal it became more obvious to us that the temporary office use on the north side of the building might actually be on the second floor. The grade differential is about 8 feet from the grade of the adjacent street and side walk and if you look at the side elevation and the south elevation of the building, this office space is located on the third floor of the building. Even with the redevelopment of the streetscape in this area is not going to change that grade separation (I counted 12 steps from the sidewalk to the front door or approximately 8'). What is also interesting is that there are other office spaces on what I believe has been interpreted as garden level (Vail 21 Building) that have about the same grade differential (8'). So interpreting this space as second floor seems somewhat consistent with other areas in Lionshead. We realize that having to change the interpretation by staff is not a comfortable thing to do or in the staff's mind a perhaps not a credible interpretation and that is why we went the code amendment route. However, I would like to throw that out there because I think it could have merit. We could also go out and take a look at this together. Let me know if we can meet. Dominic F.
