minimize potential future impacts.
We will discuss this in the process of executing the two requested agreements. I assume these agreements are required prior to permit issue?

Dear Mr. Chu,
The correct action on this matter would have been to present it to the construction review team. However, ERWSD will grant the approval for this easement encroachment, provided an
easement encroachment agreement is met and recorded with Eagle County as well as a excess fill agreement. That being said we would ask that you seriously consider revising the current
plan to something that would be less intrusive. If a problem where to arise with the sanitary sewer in this easement, ERWSD would not be responsible for fixing, repairing, or replacing
any of the improvements that fall within our easement and all costs would be burden property owner, which includes the whole patio/table /fire pit/etc.

We are going into DRB on Dec 21 and looking to get approval before then.
