Asbestos Testing &Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. It is your responsibility to be in compliance with the State. Pfease contact the State directly
for their requirements at the contact info listed below.
When is asbestos testinq required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 32 square feet
All Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including
multi-family/condominium units, and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified abatement contractor. The
clearance letter must be submitted to the Town of Vail before the building permit will be issued.

Tips& Facts:
• Even recent construction projects may include asbestos-containing materials, so buildings of a�age require testing.
• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

While I was at the library, I looked at the book drop closet area, and the wood framing in the wall cavity
adjacent to the window in the front hallway (where drywall had been removed). Since these areas are impacted
by a window leak, and not the "flood", they won't be addressed in my report. Regardless, the conditions in
these two areas would not have a significant impact on indoor air quality within the building. Opening the main
doors will entrain more mold spores into the building (from the normal outside air) than would be generated by
any mold growth on these building materials inside.
The drywall in the book drop closet area is primarily water stained, and not visibly impacted by mold growth on
the interior surface. There may be some mold growth on the back side of the drywall, but the total area of
impacted drywall is less than 10 square feet, and the drywall should not need special handling/treatment during
demolition activities. The wood framing in the wall cavity adjacent to the window appears to be impacted by a
limited amount of"wood rot". The mold that causes this wood rot is a normal part of our environment, and is
present to a much greater extent in the forested areas surrounding the library. The area of framing impacted by
this fungus in the library is less than 1 square foot, and the wood should not need special handling/treatment
during demolition activities.
As an aside, there is no such thing as "harmful" or"non-harmful"mold... mold has the potential to cause an
allergy response (like hay-fever/seasonal allergies) in individuals who are allergic to mold. Your subcontractor
should be fine, but if the contractor has a worker who is sensitive to dust(or has a known allergy to mold), they
can utilize a dust mask during demolition to minimize their exposure to any airborne dust/mold spores. Because
there are mold spores in all settled dust, and on all surfaces, elevated levels of mold spores are generated by
demolition activities in general—regardless of whether the material has ever been impacted by a water
loss/intrusion.
During our visit, I communicated the findings from the window arealbook drop to the Town of Vail
representative that was with us (John Gallegos). I don't know if he planned to address these areas prior to
demolition/renovation of the facility. It may be worth contacting him to find out.

I spoke to David about the asbestos tests and then the air quality testing that was done and he would like a copy of the
final report to be sent to him for inclusion in the VPL Demo Permit.
Lori, did the person who was testing address the mold by the book drop?Will her air quality report include anything on
that area? David wants to know if that mold is non- harmful before demolition.

BACKGROUND:
The Town of Vail requested an asbestos inspection of this building. Roofing materials
were not seen, but inspection was limited due to snow. If suspect roofing material
such as tar paper is found during remodel, contact Quentin at 970-390-0087.
This inspection includes only suspect materials that are visible to the inspector. If other
suspect materials become visible during demolition, they must be sampled before they
are disturbed. Examples of suspect materials include but are not limited to: linoleum,
floor tile, ceiling tile, mastic, sheetrock,joint compound, roofing materials, etc. There are
over 3000 known asbestos containing materials.
SAMPLING PLAN:
Colorado State Requirements - For each homogenous area of less than 1000 square
feet, a minimum of three samples must be collected in random areas. For each

homogenous area of 1000— 5000 square feet, a minimum of five samples must be
collected in random areas. Areas of 5001 square feet or greater require a minimum of 7
samples. These laws are defined by the EPA (AHERA) and Colorado State Regulation 8.
Determination of homogenous sampling areas—Homogenous Areas are determined by
type of suspect material, texture, color and location.
Determination of random sampling areas—The samples were collected in a random
manner.
