He petitioned the Board to gain access to additional sqftage of common area (approx. 80 sqft) to the North of the building. It is the understanding of the board that such common area sqftage cannot be deeded or sold but only leased. The board presented the request to the Condo Association Members for an absentee vote in Jan. of 2005; Condo Association Members were asked to voice issues and concerns related to this project simultaneously with their vote. A tally of all vote cast approved the request to lease the space to Staufer Commercial, as landlord of the La Bottega space, by the required margin of 75 %. Stephen Virion was advised of issues and concerns and requests which were conditional to the approval to avail the common area sqftage mentioned above. In a letter of Feb 2005 these demands and concerns were given to Stephen Virion for his review and consent. The project was dormant for several months but in an e-mail of March 6 2006 Mr. Virion addressed the concerns and issues and agreed to most of them, while some concerns were obsoleted through revisions in design of the project. Based on compliance of the list of issues and concerns as addressed in the e- mail of 03/06/2006 the board is prepared to lease the 60 to 80 sqft of common area to Staufer Commercial as landlord and in turn Staufer Commercial can sublease the sqftage to La Bottega to proceed with remodeling. Section 12- 9A -10: Minor modifications consistent with the design criteria outlined in subsection 12 -9A -2 may be approved by the Department of Community Development. Notification of a proposed minor amendment and a report of staff action shall be provided to all property owners within or adjacent to the district that may be affected by the amendment. First and foremost is the improvement of the existing interior dining environment. This will be achieved by updating the interior finishes, furnishings, and remodeling the layout of the interior dining areas. This includes the secondary intent of the renovation of adding dining space by moving into the former flower shop, A Secret Garden, and relocating the existing kitchen. New dining areas will be located in both the former flower shop and the area directly above the flower shop where the current kitchen is located. I am glad I thought to try you again. Yes indeed the application includes the expansion of La Botega into the old Secret Garden space and a relocation of the kitchen to the first floor with seating to replace the existing kitchen area. I have spoken to the architect as I suspect your concern was noise. Have you made any attempt to discuss your concerns with the architect, KH Webb, or Mr. Viron, the owner of La Botega? It is my understanding that they indeed are including sound deadening materials. If La Botega was not required to do an enlarged ADA restroom in conjunction with the expansion and remodel of the restaurant The Town would require no review, other than building permits, as they are taking over another commercial /retail space (Secret Garden) and relocating a kitchen on the second floor to the first floor and putting seating in the place of the old kitchen. The application is required as they are requesting a minor alteration of the adopt Special Development District zoning to add approximately 80 square feet of building area on the rear of the building. Submitted with the application was a letter, dated March 30, 2006, from the President of your Homeowners Association stating that the expansion and lease of additional space for the restroom was approved. The letter further states that issue and concerns raised by your membership were addressed satisfactorily by Mr. Viron. It is because of concerns of the Town that we require Homeowners Associations, like yours, to also submit with an application of this type permission to proceed forward. Throughout Town there are numerous mixed use developments which must learn ways to co -exist and this is why when either retail or residential uses in a building are applying to change a situation we require all associations in a building to agree prior to submitting. I appreciate your concerns and realize there may be times were noise can be heard from the restaurant below, however, I read in the letter from your Association dated March 30, 2006, that your Association reviewed the plans, identified concerns, gave those concerns to Mr. Viron, and he addressed them satisfactorily which is why your president provided the letter for the application. If you have specific concerns which you feel were not address by your Association this is an issue to raise with them. I would also encourage you to open a dialogue with Mr. Viron and the architect. With a remodel going on, this is the perfect time to try and address noise issues. In regards to requirements of the Town to have your units to be in a rental pool I must go and perform some research. If indeed you are required to have your residential units in a rental pool, which would not be out of line with requirements of other projects, there is a process by which you can ask the Town to change the requirement. It would require submittal of an application, review by staff, the Planning and Environmental Commission, and possibly Town Council. The requirement for rental, if associated with your adopted zoning is not something I can wave or release you from. If your Association is interested in pursuing a release from this requirement I will be happy to meet with you and other members of your Association to discuss application cost, process, time, etc. Again, I appreciate you expressing your concerns to me and I encourage you to contact your Association, Mr. Viron, or the architect, to try and address your concerns more specifically. The letter from your Association dated March 30, 2006, submitted with the application has satisfied the Town's requirement to have approval from all the other affected associations in the building accompany an application.
