General Information: This application is required for all proposals involving minor changes to buildings and site improve-
ments, such as roofing, painting, window additions, landscaping, fences, retaining walls, etc. Applicable Vail Town
Code sections can be found at www.vailgov.com under Vail Information — Town Code Online. All projects requiring de-
sign review must receive approval prior to submitting a building permit application. An application for Design Review
cannot be accepted until all required information is received by the Community Development Department, as outlined in
the submittal requirements. The project may also need to be reviewed by the Town Council and/or the Planning and
Environmental Commission. Design review approval expires one year from the date of approval, unless a building per-
mit is issued and construction commences.

Dear Steve and Elizabetta --
In mid- to late - December of 2011, Village Inn Plaza Phase V
Condominium Association filed a complaint with the Town of Vail
claiming that your remodel of your legally tenanted space, Unit
3, had failed to receive proper authorization from the
Association.
It should be noted that the complaint with the Town did not
result in a stop work order of the legally permitted project
It should also be noted that in the history of the Association,
no interior remodel has ever been reviewed or required
Association approval.
However, out of consideration for your neighbors and'a desire to
address their concerns, you halted your project. We,.jointly,
through meetings and.correspondence with the Association, have
endeavored.to address the Association's concerns.
After extensive correspondence with the Association and after
thorough review of this correspondence and thorough review of
both the Bylaws and the Declarations of phase V, I can find no
basis for the Association's complaint nor any basis in fact as
to why your remodel project should not continue.
I cite the following areas-of the Declaration:
1. 2(f -) Condominium units I through 7, inclusive, and 19 shall
be used and occupied solely for office or,commercial purposes

2. 21 (c) No Noxious, Offensive, Hazardous or Annoying
Activities. No noxious or offensive activity shall be carried on
upon any part of the condominium project nor shall anything be
done or placed on or in any part of the condominium project
which is or may become an unreasonable nuisance, disturbance or
annoyance to others. no activity shall be conducted on any part
of the condominium project and no improvements shall be made or
constructed on any part of the condominium project which are or
might be unsafe or hazardous to any person or property. The
owners acknowledge and agree that business and commercial
activities including, without limitations, restaurant and bar
operations shall be conducted in and on units numbered l through
7, inclusive, and in and on unit 19 and the general common
elements and that some annoyance and inconvenience is to be
expected and tolerated. The owners acknowledge and agree that
the units 8 through 18, inclusive, are to be used for
residential purposes and that excessive noise, unsightly
displays, excessive and unpleasant odors and all other excessive
nuisances are to be avoided. Noise, smoke, odors or light
specifically permitted by the Town of Vail ordinances, rules or
regulations adopted from time to time, shall not be subject to
complaint by any owner. (emphasis added)
3. 6(b) The Association and its members shall adopt no rule,
resolution or decision nor take action in any manner
whatsoever that would interfere with the reasonable and normal
activities to be carried on, in and around condominium units
number 1 -7.
4. 4(b) Each owner shall be entitled to use the general common
elements in accordance with the purpose for which they are
intended, without hindering, impeding or imposing upon the
rights of the other owners and in accordance with the rules
and regulations duly establish from time to time by the
Association and subject to the provisions of Paragraphs 24 and
21, herein.
5. 4(c) There is hereby created an easement, upon, across, over
and under all of the general common elements for ingress and
egress, installation, replacement, repair and maintenance of
all utilities, including but not limited to water, sewers,
gas, telephones and electricity.
6. l(a) "Unit" means an individual air space unit contained
within the perimeter walls, floors, ceilings, windows and
doors of a unit in a building constructed on real property...
Please remember that I am not an attorney and I would recommend
that you consult with yours before proceeding. However, I
believe that we have given the Association more than ample time
to come up with a coherent basis for complaint in fact and that,
as they have failed to do so, you should proceed until such a
time as they can find a basis in fact to compel you to not
proceed.
