GENERAL INFORMATION
This application is for any project requiring Design Review approval. Any project requiring design review must
receive Design Review approval prior to submitting for a building permit. For specific information, see the submittal
requirements for the particular approval that is requested. The application cannot be accepted until all the required
information is submitted. The project may also need to be reviewed by the Town Council and/or the Planning and
Environmental Commission. Design Review Board approval expires one year after final approval unless a

Employee Housing Unit

We are requesting additional square footage (250 SF per unit) in order to include an employee
housing unit in our primary/secondary project.
Our proposal will have minimal impact concerning light, air quality, distribution of population,
transportation facilities, utilities, schools, parks and recreation facilities and any other public
facilities in the Town of Vail.
This project will have sufficient parking on -site including an additional 300 SF of garage space for
the employee housing unit. In addition, adequate snow storage will be provided on site. We feel
that there will be minimal impact concerning traffic and pedestrian patterns as well as
maneuverability and access through the neighborhood.
The residence we are proposing fits well within the existing neighborhood. The massing of the
building is articulated in such a way as to be less imposing from the street.
We appreciate your consideration and request your approval for the employee housing unit and its
additional square footage.

EXCLUSIONS FROM COVERAGE
The following matters are expressly excluded from the coverage of this policy and the Company will not pay loss or damage, costs, attorneys" fees or expenses
which arise by reason of:
1 (a) Any law, ordinance or governmental regulation (including, but not limited to, building and zoning laws, ordinances, or regulations) restricting, regulating,
prohibiting or relating to (i) the occupancy, use, or enjoyment of the land; (ii) the character, dimensions or location of any improvement now or hereafter
erected on the land; (iii) a separation in ownership or a change in the dimensions or area of the land or any parcel of which the land is or was a part; or (iv)
environmental protection, or the effect of any violation of these laws, ordinances or governmental regulations, except to the extent that a notice of the
enforcement thereof or a notice of a defect, lien or encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the
public records at Date of Policy.
(b) Any governmental police power not excluded by (a) above, except to the extent that a notice of the exercise thereof or a notice of a defect, lien or
encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the public records at Date of Policy.
2. Rights of eminent domain unless notice of the exercise thereof has been recorded in the public records at Date of Policy, but not excluding from coverage any
taking which has occurred prior to Date of Policy which would be binding on the rights of a purchaser for value without knowledge.
3. Defects, liens, encumbrances, adverse claims, or other matters:
(a) created, suffered, assumed or agreed to by the insured claimant;
(b) not known to the Company, not recorded in the public records at Date of Policy, but known to the insured claimant and not disclosed in writing to the
Company by the insured claimant prior to the date the insured claimant became an insured under this policy;
(c) resulting in no loss or damage to the insured claimant;
(d) attaching or creating subsequent to Date of Policy; or
(e) resulting in loss or damage whicn would rot have been sustained if the insured claimant had paid value for the estate or interest insured by this policy.
4 Any claim, which arises out of the transaction vesting in the insured the estate or interest insured by this policy, by reason of the operation of federal
bankruptcy, state insolvency, or similar creditors' rights laws, that is based on:
(a) the transaction creating the estate or interest insured by this policy being deemed a fraudulent conveyance or fraudulent transfer; or
(b) the transaction creating the estate or interest insured by this policy being deemed a preferential transfer except where the preferential transfer results
from the failure.

(ii) of such recordation to impart notice to a purchaser for value or a judgment or Iien creditor.

remedies against any person or property necessary in order to perfect this right of
subrogation. The insured claimant shall permit the Company to sue, compromise
or settle in the name of the insured claimant and to use the name of the insured
claimant in any transaction or litigation involving these rights or remedies.
If a payment on account of a claim does not fully cover the loss of the
insured claimant, the Company shall be subrogated to these rights and
remedies in the proportion which the Company's payment bears to the whole
amount of the loss.
If loss should result from any act of the insured claimant, as stated above,
that act shall not void this policy, but the Company, in that event, shall be
required to pay only that part of any losses insured against by this policy which
shall exceed the amount, if any, lost to the Company by reason of the
impairment by the insured claimant of the Company's right of subrogation.
(b) The Company's Rights Against Non- insured Obligors.
The Company's right of subrogation against non - insured obligors shall
exist and shall include, without limitation, the rights of the insured to
indemnities, guaranties, other policies of insurance or bonds, notwithstanding
any terms or conditions contained in those instruments which provide for
subrogation rights by reason of this policy.
14. Arbitration.
Unless prohibited by applicable law, either the Company or the insured
may demand arbitration pursuant to the Title Insurance Arbitration Rules of the
American Arbitration Association. Arbitrable matters may include, but are not
limited to, any controversy or claim between the Company and the insured
arising out of or relating to this policy, any service of the Company in connection
with its issuance or the breach of a policy provision or other obligation. All
arbitrable matters when the Amount of Insurance is $1,000,000 or less shall be
arbitrated at the option of either the Company or the insured. All arbitrable
matters when the Amount of Insurance is in excess of $1,000,000 shall be
arbitrated only when agreed to by both the Company and the insured.
Arbitration pursuant to this policy and under the Rules in effect on the date the
demand for arbitration is made or, at the option of the insured, the Rules in
effect at Date of Policy shall be binding upon the parties. The award may
include attorneys' fees only if the laws of the state in which the land is located
permit a court to award attorneys' fees to a prevailing party. Judgment upon the
award rendered by the Arbitrator(s) may be entered in any court having
jurisdiction thereof.
The law of the situs of the land shall apply to an arbitration under the Title
Insurance Arbitration Rules. A copy of the Rules may be obtained from the
Company upon request.
15 Liability Limited to this Policy, Policy Entire Contract.
(a) This policy together with all endorsements, if any, attached hereto
by the Company is the entire policy and contract between the insured and the
Company. in interpreting any provision of this policy, this policy shall be
construed as a whole.

The Town of Vail Planning Division and Public Works Department recently reviewed the Design Review
application for the proposed new residence and employee housing unit (EHU) at 1290 Westhaven Circle. The
following is a summary of the comments from that review:
A topographic survey that is stamped by a licensed surveyor must be submitted. Ties to existing
benchmarks, either USGS landmark or sewer invert, must be clearly stated on the survey so that all
measurements are based on the same commencement point.
The topographic survey must identify any portions of the lot with a slope of 40% or more.
3. Spot elevations at the edge of asphalt, along the street frontage of the property at 25 foot intervals, and a
minimum of one spot elevation on either side of the lot must be identified on the topographic survey.
4. The proposed layout of buildings and other structures including decks, patios, fences, and walls must be
identified on the site plan by showing the foundation with a dashed line and the roof edge with a solid line.
5. Any disturbed grading must be returned to a grade of 2:1 or less (i.e. west side of the lot).
6. The driveway must be located within the property boundaries in the Westhaven Circle right -of -way area.
The driveway must be relocated 5 feet to the west.
7. Identify on the site plan if the driveway is heated or unheated.
8. The required 20 foot front yard setback must be labeled on the site plan.
9. A guardrail may be required along the proposed driveway in the location of the proposed boulder wall.
10. An 18 CMP is required, and at least one foot of cover is required on top of the culvert.
11. Elevations of the drainage ditch at flow line level must be identified on the site plan.
12. The drainage Swale on the east side of the lot must be designed to flow to the right -of -way without crossing
Lot 27.

13. Erosion controls using Best Management Practices must be identified on the site plan and landscape plan
(especially in the Westhaven Circle right -of -way).
14. All required parking spaces must be identified on the plans with a 9'X 18' box for any enclosed parking
space and a 9'X19' box for any surface parking space. All required parking spaces must be identified on
the site plan. The proposed parking space located within the turnaround area does not conform to Town of
Vail standards. The turnaround area must be 21 feet in addition to any parking spaces.
15. The proposed top and bottom elevations of all retaining walls must be identified on the site plan. A detailed
cross - section and elevation drawing of the walls must be provided on the site plan or separate sheet. A
stamped, approved drawing from a licensed PE is required for all retaining walls between 4 to 6 ft. in
height and all double or triple tiered walls.
16. The bench space between retaining walls is determined by the height of the combined wall divided in half,
with a minimum bench width of 4 feet. The plans must be revised to meet this requirement.
17. A revocable right -of -way permit is required for any retaining walls, portions of the driveway, and concrete
pan located within the Westhaven Circle right -of -way.
18. A minimum functional snow storage area equaling 10% of the proposed paved areas must be provided
within the lot boundaries and delineated on the site plan.
19. The exact location of existing utility sources and proposed service lines from their source to structures must
be identified on the site plan.
20. Fire Department approval is required (the installation of a sprinkler system may be required). The Fire
Department staging area must be identified on the site plan.
21. The landscape plan must identify existing ground cover / shrubs and the location of existing trees 4 inches
or larger in diameter. The plan must identify trees to remain, to be relocated (including new location), and
to be removed. The critical root zones for existing trees located in close proximity to site grading and
construction must be identified on the landscape plan. Large stands of trees NOT affected by the proposed
improvements and grading may be identified as a bubble on the landscape plan.
22. The floor plans must be labeled to identify the proposed floor area use (i.e. EHU, "open to below ", "height
less than 5 feet ", etc.).
23. The architectural floor plans must provide the dimensions of all roof eaves and overhangs (preferably on a
separate roof plan drawing).
24. All elevations must be drawn to scale and fully dimensioned.
25. Roof and building drainage systems (i.e. gutters and downspouts) must be identified on the elevations.
26. All exterior materials and colors must be specified on the elevations. Exterior color and material samples
shall be submitted to staff and presented at the Design Review Board meeting.

27. All proposed exterior lighting fixtures on the building must be shown on the elevations.
28. An exterior lighting plan must be submitted.
29. The Employee Housing Unit (EHU) shall have its own entrance, and there shall be no interior access from
the EHU to any other dwelling unit.
30. Please note that this property is located within the Cascade Village Special Development District and may
be subject to additional development regulations; please refer to Town of Vail Ordinance No. 23, Series of
1998. Type H employee housing units are identified as a permitted use for this property by the Cascade
Village Special Development District, therefore Planning and Environmental Commission approval of a
conditional use permit is not required.
31. Based upon our preliminary calculations, the proposed primary residence exceeds the maximum 6,143
square feet of GRFA allowed for this property. Please refer to Title 12, Chapter 15 of the Town of Vail
Code for information related to the regulation of GRFA.
32. Please note that portions of this lot have slopes of 30% or greater and development on this lot is subject to
the requirements of Section 12 -21 -14 of the Town of Vail Code.
