Dear Diane,
As
per our earlier discussion, I am notifying you and the association the Town of Vail is not going to require abatement of items of concern addressed by the fire department that is not
part of the remedial work caused by the structural fire. It has been determined per section 3401.2 of the International Building Code that as long as the building is maintained in a
safe and sanitary manner as required at the time of original construction these items need not be upgraded to current code. Please be aware that any future improvements in regards to
these elements of the building will require a permit and will be required to be brought up to current code.
I would recommend that the stairs and emergency egress windows be installed
per current building codes. It has been found, since your building was built, that a substantial reduction in loss of life and injury has occurred when these improvements are made and
is considered a standard safety requirement within the industry today.
As for the lofts being used for sleeping purposes; the building code has never allowed this use as currently
constructed. By this letter, I am informing you that this is a violation of the building codes and must discontinue. If not, the Town of Vail will be required to take further action
in this regard.
