RE: Four Seasons Resorts: Holy Cross Utility Permit
Dear-Mike:
On behalf of Holy ,Cross- Electric, we are requesting a MOT Utility Permit to relocate an
existing Holy Cross electric line, which currently crosses.the Four Seasons Resort site.
The relocated electric line will be a buried, longitudinal installation primarily paralleling
the South Frontage Road and within the MOT right -of -way.
The 2 -4inch conduits will contain 30 /24.9 Yl14.4 KV primary electric cable to serve the
Four Seasons Resort. Along with the application we have included a traffic control plan,
the necessary insurance and a site plan depicting the relocation.

3. TRAFFIC CONTROL PLAN (required on all operations) that conforms to the "Manual on Traffic Control

4. INSURANCE REQUIREMENTS:
a. A permittee shall ensure that all permitted operations, whether performed by the permittee or by
subcontractors, are adequately and continuously covered by liability insurance. The types and minimum
amounts of insurance acceptable to CDOT are as follows:
1. Workers Compensation Insurance in accordance with prevailing laws.
2. Comprehensive General Public Liability and Property Damage Insurance:
Combined Bodily Injury and Property Damage
$150,000 per person
$600,000 each occurrence
3. Comprehensive Auto Liability and Property Damage Insurance:

issuance of a Utility /Special Use Permit. Exampfes of such clearances include Colorado Discharge Permit System
permits or Corps of Engineers 404 Discharge of Dredged or Fill Material permits. The letter of request for a
Utility /Special Use Permit should include a discussion of the status of any required clearances.

UNDERGROUND RIGlfr-OF=WAY EASEIMENT
KNOW ALL MEN BY THESE PRESENTS. that the undersigned,
SCORPIO CONDOMINIUM ASSOCIATION
(hereinafter called 'Grantor'), for a good and valuable consideration, the receipt whereof Is hereby acknowledged, does hereby
grant unto Holy Cross Energy, a Colorado corporation whose post office address Is P. 0. !ox 2150, Glenwood Springs, Colorado
(hereinafter called'Grantatl and to its successors and assigns, the right of Ingress and egress across lands of Grantor, situate In
the County of Eagle. State of Colorado, described as follows;
A parcel of land situated In Sections 6 and 7, Township 5 South, Range 80 West of the r P.M., more particularly
described on the Condominium Map For Scorpio Condominiums at Reception No. 231790 In the office of the Eagle
County Clark and Recorder, Eagle, Colorado.
And, to construct, reconstruct, repair, change, enlarge, re- ohaso, operate, and maintain an underground electric transmission or
distribution line, or both, with the underground vaults, conduit, fixtures and equipment used or useable In connection therewith,
togetherwith associated equipment required above ground, within the above , mooned lands, upon an easement described as
follows:
An Easement containing underground power lines with above ground pad mmated equipment as constructed, the location of said
Easement upon the above described property Is shown on Exhibit A attached hereto and made a part hereof by reference.
The rights herein granted specifically allow Grantee to install additional underground and /or pad-mounted facilities within the
easement described 'herein.
It shall be the Grantors responsibility to ensure that splice vaults, switchgear vaults and tra isformar vaults installed hereunder on
said real property are accessible by Grantee's boom trucks and other necessary egWpment and personnel at all times. The use of
such access by Grantee shall not require removal or alteration of arty Improvements, landsca ping, or other obstructions. The
ground surface grade shall not be ahered within ten (10) feet of said splice, swkchgear and transformer vaults, nor along the
power line route between the vaults. The ground surface grade at said transformer and switchgear vaults shall be six (6) inches
below the top of the pad. The ground surface grade at said splice vaults shall he even with the top of the pad. The manhole
opening of said splice vaults shall be uncovered (excluding snow) and accessible at all times. Improvements, landscaping or any
other objects placed In the vicinity of said transformers and switchgear shall be located so as not to hinder complete opening of
the equipment doors. The ground surface within ten (10) feet of said transformer and switchgear doors shall be flat, level and
free of improvements, landscaping. and other obstructions. Improvements, landscaping and other objects will be kept a
minimum of four (4) feet from non-opening sides and backs of said transformers and switchgear: Grantor hereby agrees to
maintaih the requirements of this paragraph and further agrees to correct any violations which may occur as soon as notified by
Grantee. Saki corrections will be made at the sole cost and expense of Grantor.
Together with the right to remove any and all trees, brush. vegetation and obstructions within said easement and the right to pile
spoils outside said easement during construction and maintenance, when such Is ressonabfy necessary for the implementation
and use of the rights hereinabove granted. In areas. where vegetation is disturbed by the above described use of the easement,
the ground surface shall be seeded using a standard native mix by Grantee. Grantor agrees that landscaping or other surface
improvements added on said easement after the date of execution hereof will be minimized and that Grantee will not be
responsible for damage to said additional landscaping or surface improvements caused by exercise of Its rights granted by this
easement
Grantor agrees that all facilities Installed by Grantee on the above described lands, shall remain the property of Grantee, and shall
be removable at the option of Grantee.
Grantor covenants that it Is the owner of the above described lands and that the said lands are free and clear of encumbrances
and (lens whatever character, except those held by the following: As recorded in the real property
records.

3. TRAFFIC CONTROL PLAN (required on all operations) that conforms to the "Manual on Traffic Control
Devices for Streets and Highways” (Part VI).
4. INSURANCE REQUIREMENTS:
a. A permittee shall ensure that all permitted operations, whether performed by the permittee or by
subcontractors, are adequately and continuously covered by liability insurance. The types and minimum
amounts of insurance acceptable to CDOT are as follows:
1. Workers Compensation Insurance in accordance with prevailing laws.
2. Comprehensive General Public Liability and Property Damage Insurance:

$600,000 each occurrence
3. Comprehensive Auto Liability and Property Damage Insurance:

b. Certificate(s) of Insurance from permittee and /or subcontractors' insurance carrier(s), naming Colorado

5. ENVIRONMENTAL, ECOLOGICAL, ARCHAEOLOGICAL, AND HISTORICAL CLEARANCES: The Utility /Special
Use Permit applicant must satisfactorily address these items, in accordance with applicable law, as a condition to
issuance of a Utility /Special Use Permit. Examples of such clearances include Colorado Discharge Permit System
permits or Corps of Engineers 404 Discharge of Dredged or Fill Material permits. The letter of request for a
Utility/Special Use Permit should include a discussion of the status of any required clearances.
