Sk41.4 FIL E Memorandum To: Legal File for 4267 Nugget Lane / Lot 9. Bighom Estates From: Bill Gibson, Planner I Date: May 18, 2001 Subject: Determination that an existing duplex structure was la*firlly established within the required 50- foot stream setback. An inquiry was made to determine if an existing duplex sfucture was lar, rdrlly established at its current location at 4267 Nugget Lane / Lot 9, Bighom Estates. The existing duplex structure encroaches into the required 50-foot stream setback. Staff researched the history of this property to determine if the existing duplex smrcture was lawfully established in its currenl location. A Design Review Board application was submitted for the HilliVAiken Duplex located at 4267 Nugget Lane / Lot 9, Bighorn Estates on March 12, 1979 to allow for the construction ofa new duplex, one car garage, and carport. Staff denied this application on March 20, 1979 due to a proposed 25-foot deviation from the required 50-foot stream setback. This DRB application was tabled from the Marcb,22, 1979 DRB meeting agenda pending Planning and Environmental Commission action on a variance from the stream setback requirements. OnMarch 22, 1979 a variance application was submitted for this property to allow the proposed construction within the required 50-foot stream setback. At their Aprrl24, 1979 meeting the Planning and Environmental Commission denied the applicants' request for a stream setback variance and recommended that the applicants "...meet with stalf to work on afront setback as an alternative to the stream setback. " The PEC also informed the applicants that they had l0 days to file an appeal of their decision to the Town Council. There are no records of an appeal to the Town Council of the PEC'sApril 24, 1979 variance denial. An unsigned and undated note in the Community Development Department's legal hle indicates that after the PEC's April24, 1979 meeting the applicants' architect revised the proposed plans and resubmitted to the Design Review Board. According to Design Review Board records, the DRB approved the Hillis/Aiken Duplex application at their May 2, 1979 meeting. A zone check sheet, from the Community Development Department's legal file, dated May 2, 1979 identifies the Hillis/Aiken proposal as approved with a proposed 15-foot front yard setback and 50-foot stream setback. The proposed 50-foot stream setback complied with the Town's development standards; however. the proposed l5-foot front yard setback did not conform to the required 20-foot front yard setback. The 2O-foot front yard setback requirement was stricken on the May 2, 1919 zone check sheet and a requirement of 1S-foot was written in its place; however, there are no records ofany PEC review or approval ofa front yard setback variance for this property. The only plans on file for this project include preliminary plans dated May | , 1979 and plans dated June 6, 1979. Both sets ofplans show the proposed garage struchrre encroaching 5 feet into the required front yard setback and the duplex structure encroaching into the 50-foot stream setback: horvever, neither set ofplars are stamped or signed with Town of Vail approvals. On June 6, 1979 building, electrical, mechanical, and plumbing construction permits were issued for the Hillis Duplex at 4267 Nugget Lane / Lot 9, Bighorn Estates to allow for the construction of a new duplex rvith garage and carport. A Temporary Certificate of Occupancy for the Hillis Duplex was approved on June 11, 1980. On July 10, 1980 a pennanent Certificate ofOccupancy was approved for the Hillis Duplex. c0Py o o o The original construction of this property included a new duplex, garage, and carport. At some point since its original construction, the carport has been converted into a garage. There are no records of Design Review Board, Planning and Environmental Commission, or Building Department approvals for this conversion. The Community Development Deparfnent's legal file contahs a building permit issued on November 1, 1988 for the installation ofa new garage entrance at 4267 Nugget Lane / Lot 9, Bighom Estates; however, this permit lacked approval ofa final inspection and expired on February 28, 1990. FINDING: The existing duplex structure located at 4267 Nugget Lane / Lot 9, Bighom Estates does not conform to the required sO-foot stream setback requirement prescribed by Section l2-14-17 of the Town Code. However, staff has determined that the existing duplex structure was lawfully established at its current location within the required so-foot stream setback. Q..,,, f.$ 't I l-.-.r \ o -r t Memorandum To: Legal File for 4261 Nugget Lane / Lot 9, Bighorn Estates From: Bill Gibson. Planner I Date: May 16. 2001 Subject: Determination that a portion of an existing garage structure uas lanfirlly established. An inquiry was made to determine if an existing underground storage iuea located below the existing garage at 4267 Nugget Lane / Lot 9, Bighorn Estates can be converted to Gross Residential Floor Area for future use as a bedroom. The existing garage structure. including the underground storage area, encroaches 5 feet into the required 20-foot front yard setback. Staff researched the history of this propert_v to determine if the existing garage structure rvas laufirlly established in its current location. A Design Review Board application rvas submitted for the HilliVAiken Duplex located at 4267 Nugget Lane / Lot 9, Bighorn Estates on March 12. 1979 to allorv for the constnrction ofa nerv duplex. one car garage, and carport. Staffdenied this application on March 20. 1979 due to a proposed 25-foot deviation from the required sO-foot stream setback. This DRB application ras tabled from lhe March 22, 1979 DRB meeting agenda pending Planning and Environmental Commission action on a variance from the stream setback requirements. On March 22. 1979 a variance application \4as submitted for this propertv to allow the proposed construction within the required 50-foot stream setback. At their April 24. 1979 meeting the Planning and Environmental Commission denied the applicants' request for a stream setback variance and recommended that the applicants " ..- meet vith staff to work on a front setback as an alternative to the stream setback. " The PEC also informed the applicants thal they had l0 days to file an appeal oftheir decision lo the Tolrr Council. There are no records of an appeal to the Torvn Council ofthe PEC's April 24. 1979 variance denial. An unsigned and undatcd note in the Communig Development Dcpartment's legal file indicates that after the PEC's April 24. 1979 meeting the applicants' architect revised the proposed plans and resubmitted to the Design Review Board. According to Design Review Board records. the DRB approved the Hillis/Aiken Duplex application at their May 2. 1979 meeting. A zone check sheel. from the Community Development Departrnent's legal file. dated May 2, 1979 identifies the HilliVAiken proposal as approved rvith a proposed l5-foot front yard setback and 5O-foot stream setback. The proposed 50-foot stream setback complied u'ith the Torn's development standards: horvever. the proposed l5-foot front yard selback did nol conform lo the required 20-foot front yard setback. The 20-foot front yard setback requirement was stricken on the May 2, 1979 zone check sheet and a requiremenl of ls-foot was written in its place: however, lhere are no records of any PEC review or approval ofa front yard setback !'ariance for this prop€rty. The only plans on file for this project include preliminary plans dated May I . 1979 and plans dated June 6, 1979. Both sets of plans show the proposed garage structure. including the underground storage area, encroaching 5 feet into the required front yard setback: horvever. neither set ofplans are stamped or signed with Town of Vail approvals. On June 6, 1979 building. electrical, mechanical. and plumbing construction permits rvere issued for the Hillis Duplex at 4267 Nugget Lane / Lot 9, Bighorn Estates to allow for the construction ofa new duplex with garage and carport. A Temporary Certihcate of Occupancy for the Hillis Duplex was approred on June I 1. 1980. On July 10, 1980 a p€rmanent Certificate of Occupanct was approved for the Hillis Duplex. The original construction of this prop€rty included a new duplex, garage, and carport. At some point since its original construction, the carport has been converted into a garage. There are no records of Design Rwiew Board, Planning and Environmental Commission, or Building Department approvals for this conversion. The Community Dwelopment Department's legal file contains a building permit issued on November l, 1988 for the installation ofa new garage entrance at 4267 Nugget Lane lLot9, Bighorn Estates; howwer, this permit lacked approval ofa final inspection and expired on February 28, 1990. X'INDING: The existing garage structure, including the underground storage area, located at 4267 Nugget Lane /Lot 9, Bighorn Estates does not conform to the front yard setback requirements prescribed by Section l2-6C4 of the Town Code. Staff has determined that the original one car garage and underground storage portions of the existing garage stnrcture were laufirlly established. As a la*firlly established strucnrc, it may be possible to covert the existing underground storage area to GRFA as an "interior conversion ' subject to Design Review and Building Permit approval. Staff has determined that the original carport portion of the garage structure was not lawfully converted into a garage and shall not be considered a legal non-conforming structure. o o z (n -{F c C) -{o z !rn 7 ={ '- -- 6 @ m Ig l-o t-'.h E l<x f IHE :19s r lri g lqP o l4i in O l= -r I l=F =!5 o.<4o-de -o Ed ctt >l 7E .t1 _! m = 5 l.p-t -r rX 6ltlt-xl {-al !z ot- ?z=;j z2 - Fo r!tr =pF Xm=ii=gP" m t-m o --{n r- z -l n O-p z. t- 3<o= Q6) o 2e -l rrl vz >m OI]-{> v o .1. =m 7J z Fl a z =ll F tri E- H |n r{F c) |n .F'.{ I ! s' c) =o lfr n m o _f z z --t o i 7 I D |n c) trt ,{ F I (Jl ul ls lo |.n t< t>l-ll l6 tz l{to l€ lz le t<t> lF til lo 12 -.{ t--r mlo Fl= ll t>l- lm 16,,lz le I I I I I I l{to l€ lz lo lll t<t> IF lr tm lF' c,z tq mt lr lH'lzo l=1 190 I,Fm oo! r-f 3+NO @ m x m !-{ o z (-o @ @ -{m :E )F P \-r a) // rt :E fll FU (:) -qr o -;E3d ' o9o Sdgg lg il sE; 3 =: E; ==BF (,'o=f A-.osr == =-F:.=E P=91 ti 5 0R O^'srX c!? q.- = *o f (o9+o *O ii o)O-=E e,9=F ot a 9.6 5s3'1 s,3l= ue4 & i'=99 6+;1 6 ==.F tJa= E= ilq <o-f s: d.P o'3;E i Bd *g .,ER6 ar;€ o { 0) t t. 3 (D 5 s f (o o o =o = r) :(D J o -.1 o €f I'9. 5'!t 6- o o o z { i o _rt =a m r 'n g to i-I-_ r I I'D 7)x 2 ]" I I I I l_f- I z TI _l z r- .E m : CN z m m m l< ' lz l= t; Ir- la.t; l= t_ t- I I fio<>'n! DESCRIPTION OF VARIANCE REQUESTED This varlance reguest is ftom the 5o-foot strean setback from the niddle of Gore Creek. The proposed duplex encroaches on this setback by 25 feet. Thls leaves aPproxinately 25 feex from the rnid<l1-e of the creek to the Dearest polnt of the st ruc ture . On thls 1ot' the rear lot llne is l-n approximately the same location as the niddle cf Gore Creek. With the rear setback, therefore' becoml-ng 50 feet and a front setback of 2O feet, there is only 50 feet renaining for the proposed duplex and garage. CRITERIA AND FINDINGS Upoo review of CriterJ'a and Findings, Sectlon 18.62.060 of the Munlcipal Code, the DepartDent of Conmunlty DeveloPmeDt recommends approval of the requested Variance based uPon the fo]-lowing factors: Consideration of Fac tor s The relationship of the requested variance to oEher existLng or potentiaL uses and structures in the vlcinitY. This Stream Setback Variance should not have any impact on other existing' or potential structures in thls area. The duplex as deslgned, sti11 conplies with the 15-foot rear setback requirement. The degree to which relief from the strict or literal interpretation and enforeement of a specified regulation ls necessary to achieve compatibillty and uniformity of treatment among sites 1n the vlcinity, or to attain the obJect- ives of thls titLe without grant of special privilege. We feel that there Ls a hardshlp ln this situation . Dre to the conflguratlon of the' lot and the location of Gore '!f- o 4-20-7 9 Pg.2 UEl.tO-PEC Creek, the appllcant would be severely 1funlte'l ln hls abtlity to bulld a reaaonable size structure on'thl-s Lot. The structure is totally located outside the 100-year floodplain. The effect of the requested variance on llght and air, distribution of popul-ation, transpor- taElon and trafflc facilities' public facil- Itles and utilities, and public safety. I{e foresee no adverse 5-mpacts on these factors' Such other factors and criteria as the Commlsslon deems applicable to the proposed var ianc e . There are no other factors deemed applicabl'e Iind ings The Plannlng & Environmental Commission shall make the following findings befote granting a variance: That the granting of the variance will not constitute a grant of special privilege ioconsistent with the limitations on other ProPerties classified in the same distri.ct. That the granting of the variance will not be detrimental to the public health, safetyr or welfare, or materially injurious to Properties or lmprovements in the vicinity. That the variance is warranted for one or lore of the followiog reasons! The strict or l-iteral interPre- tation and enforcement of the specified regulation would re sul t lu practical difficulty or unneces- sary phys ic a1 hardship inconsistent wlth the objectives of this titl-e. There are excePtions or extra- ordinary circumstanc es or conditions applicable to the site of the varianee that do not apply generally to other proPertles ln the same zone. The strlct or literal lnterpretation Pg. 3 MEMO-PEC o and enforcement of the speclfled regulation would deprlve the appLlcant of prLvtleges enJoyed by the olroers of other ProPerties ln the same dlst rict. The staff recomrnends approval of this varlance request. Thls proposal represents a major redesign of a prevlous submictal , and has addtessed many of our inltial con c ern s The 5O foot stream setback is meant to preserve stream tract 1and, and ls an lmporlaut devel-oPment restrlctlon. In this case, however, this lot was ereated in such a way (while this area was still in Eagle County) that our Present regulations would severely restrict the size and type of atructure that could be placed on lt. The design' as Presented' seeDs to be appropriate for the l-ot anil does not seem to impact the actual bank of the stream. W€, therefore, feel chat this variance ls warrant ed. 4-20-79 t PUBLIC NOTICE NOTICE IS I{EREBY GMN that Hil1is Akin is requesting a Variance from the provisj-ons of Section 18.12.060 Setbacks of the Municipal Code for the Town of Vail in order construet a residence which is above the loo-year flood pIain, but within the 5O foot setback from Gore Creek.
