If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works) revievv and approval
a Planning Depaftment review or Health Department review, and a review by the Building Department, the
estimated time for a total review will take as long as three (3) weeks.
All commercial (large or small) and all multFfamily permits will have to follow the above mertioned maximum
requirements, Residential and small projects should take a lesser amount of time. However, if residential or
smaller projects impact the various above mentioned departments with regard to necessary review, these
projects may also take three (3) weeks to review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

Dear Sirs,
Thank you for submitting revisions to the building permit for the Purchase residence referenced above. The
Planning Department has approved the building permit drawings since all conditions of Design Review Board
approval have been satisfied.
Please note that per the conversation that occurred on Monday, July 24'n between us (including Chris Gunion,
Plans Examiner), at the time of Temporary Certificate of Occupancy all crawl spaces existing with a head
height five feet (5') or greater will be required to be backfilled to an appropriate level as determined by Staff.
No crawl spaces proposed on the plans or otherwise, will be allowed to be converted to Gross Residential
Floor Area (GRFA) at any point throughout the duration of the structure.
Staff will reference the following sheets within the building permiUDRB set of plans when reviewing the
structure for Temporary Ceftificate of Occupancy requirements: Sheets SF1 - SF8, which clearly show the
originally approved amount of GRFA in detail.

First, I would like to thank you for your assistance in guiding me in the procedure
to have my Father-in-Law's residence re-roofed. I came by July 2l't to drop offreview
and permit applications, but did not have all pertinent information at that time. The kind
lady at the front desk stamped what I did have and advised me to mail it all up once I had
everything. I believe I do have it now. Enclosed please find the l) Application for Design
Review along with a picture of the existing roof, 2) Application for a permit, 3)
Contractor's bid noting size and cost, and 4) Permit issuance time frame and checklist
acknowledgement. You notified me that Mr. Zachaiah, the co-owner of the duplex, did
mail in his approval of the work. My roofing contractor notified me that he has sent in his
application for registering as a special contractor with payment being mailed to you. If
you could enter his pertinent information on the permit application I would appreciate it.

Dear Steve,
Per our conversation yesterday, I am writing to clarify the items needed by the Town before building permit
approval of the Purchase Residence. These are the outstanding conditions of approval which have not yel
been satisfied.
1. At the time of buitding permit submiltat, the appticant shall have futfitled the
requirements of the site specific geologic investigation pursuant to Secfion 12-21-15-
B, Vail Town Code.
2. At the time of building permit submiftal, the applicant shall submit to the Town of
Vail professionally-engineered and stamped dnwings of all walls on the site that are
tiered and/or over four feet (4) in height.
3. Prior to the time of building permit submittal, the applicant shall return to the
Design Review Board with a rcvised landscape plan and a revised site plan.
-Thank you submitting a revised landscape and site plan this morning, per condition number 3. I have placed
the item on the Design Review Board's May 17'n, 2006 agenda. However, the Town has yet to receive the
site specific geologic investigation and drawings of the professionally-engineered retaining walls. Please note
that no building permit will be issued by the Town until these items have been submitted.
Finally, the drawings must comply with the Fire Department conditions from DR8050372 at the time of
building permit release as well. The Town's files reflect that these conditions are as follows:
1. Fire sprinkler sysfem required and shall comply with NFPA 13(2002).
2. Monitored fire alarm system required and shatt compty with NFPA 72 (2002).

On Friday May 13, 2005 a geologic reoonnaiseanoe survey of the property
locst€d af.441B Cofumbine Drive was perfomed. lt was detemined that the 0.71 acre
sib ls underlaln by Glactul Dffi that uas deposiEd as part ol a muclr larger Labral
Moraine up the Bighom Cr*k Dralnage. The maJbrity of the site elopee to lhe nortfrwest
at a grade of betrreen 15 and 30 percent, some of the slopes higher up and outside of
the buildlng boprlnt cor*ain grades in orcess of 30 percent A portion of lhesE higher
slope areas has baan identified as a geologically sensillve area, heving a moderfr
roclfall hazard, as shown In Figure 1. Dufing rhis and a subsequent visit on Friday the
13b of May, no slgns of recent-roclcfall were encountered. The Glaclal Drift is comiosed
of very lgfge lg -sma[, rounded- to uell-rounded, boulder and mbble sizEd clasE of
Precambrian aged granitic rccK tn a silty sand matrix as shown in Figure 2, these granitic
rocks cropout higher up the Bighorn Drainage and in the Gore Range, thg pfngfpC

PARTY I{ALL AGREEMENT
WHEREAS, Burlews Vail Associates, a New Jersey general partnership (nDeclarantn) is the owner in fee simple of the following described real estate (rsubject property") situate in
the County of Eagle, State of Colorado, to wit:
. A resubdivision of Lot 3r Bighorn Subdivision,' according to the recorded [rlat thereof in the Offices of the Clerk E Recorder of Eagle County
WHEREAS, such Declarant has constructed on said premises a
building consisting of two townhouse units, known as Northwest
Unit and Southeast Unit, which townhouse units are connected by a
common wall;
WHEREAS, Declarant has divided such lot into parcels as follows:
Parcel A (containing the portion of such
building known as Northwest Unit)
Parcel B (containing the portion of such
building known as Soubheast Unit)
Parcel C (whlch is the common parcel)
Al1 of whlch parcels are more particularly described in
Exhibit 'An, attached hereto and made a part hereof.
WHEREAS, DeclaranL wishes to create easements relating to the party wall (placed equally divided on the Conmon boundary
separating Northwest UniL and Southeast Unit) the footings
underlying such party wall and the roof over such party wall (such
wall, footings and roof being hereinafter designated as the nparty
waII" );
NOW, TIIEREFORE, Declarant hereby provides the following
easernents and restrictions which shall hereafter run with the land
and be binding upon and inure to the benefit of Declarant, its
successors and assigns forever:
1. The subject property is hereby divided into those parcels, each separately described in Exhlbit 'A', and designated
as follows:

2. Parcel A and Parcel B sha1l each constitute a separaLe
fee sinple estate to which shall be appurtenant egual undivided
one-half interests in and to Parcel C (common area).
3. The above described parcels and inprovements thereon may
be conveyed and described for all purposes as NorthwesL Unit, a
resubdivision of Lot 3, Bighorn Subdivision (rePresenting Parcel A
and the appurtenant undivided one-half interest ln and bo Parcel C
(common area), together with the improvenents on such land and the
easements and rights appurtenant Lhereto), and SoutheasL Unit, a
resubdivision of Lot 3, Bighorn Subdivision (representlng Parcel B
and the appurtenant undivlded one-half interest in and to tbe
Parcel C ( conmon area), together with the improvements on such
land and the easements and rights appurtenant thereto).
4. No owner of either parceL shall make or suffer any structural or design change ( including a color scheme change) ,either permanent or inpermanent and of whatever type or nature, to the exterior of his townhouse without first obtaining the prior
nritten consent thereto fron the owner of the other townhouse,which consent shall not unreasonably be withheld or delayed. In
case of damage to or destruction of either townhouser the owner of the other townhouse may demand repair or reconstruction of the
damaged townhouse to a condition comparable to that prior to the
damage and if the owner of such damaged townhouse does not
colnmence such repair or reconstruction within 30 days, the ovrner of the other townhouse may do so. Costs of any such repair or reconstruction shall be paid for by insurance applicable to the
darnaged townhouse. If the cost of repair or reconstruction
exceeds such insurance, the excess sha1l be paid for by the owner of the damaged townhouse and in the event he fails to so pay; the
owner of the other townhouse may rnake payment and charge such other owner, imposing a lien on his townhouse in the amount of his payments plus interest at 18t per annum, costs and reasonable attorneyst fees.
5. The said party wall shall be a party wal1 between such
townhouses.
6. The owners of either townhouse shall have a perpetual
easenent in and to that part of tbe other townhouse on which said party wall is located, for party wall purposes, including
maintenance, repair and inspection.
7. The cost of naintaining the party wall, all roofs and the exterior walls of Lhe building shall be borne equally by the
ovrners of both townhouses.
8. In the event of danage to or destruction of said parLy
wall fron any cause, the then owners of the townhouse shall, aL joint expense, repair or rebuild said party wal-l, and each such
owner, his heirs, personal representatives, successors and
assigns, shall have the right to the full use of said party wall
repaired and rebuilt. If the negligence of any owner shall cause
damage bo or destruction of said party wall, such negligent party
shall bear the entire costs of repair or reconstruction.
9. If the owner at any time oi either townhouse shall neglect or refuse to pay his share, as herein provided, of any
expense, the o$rner at such tine of the other townhouse nay
undertake the work reasonably required hereunder for repair,restoration or maintenance and shall be entihled to have a llen in the nature of a nechanicrs lien on the townhouse of the owner so failing to pay, for the cost of sucb defaulting ordnerrs share of
such work, interest at 18t per annutn, costs and reasonable attorneys'fees.
10. Each owner of a townhouse shall obtain and naintain at all tines insurance against loss or damage by fire and such other
hazards as are generally covered in the area under standard
extended coverage provisions for at least the full insurable
replacement cost of the townhouse which he owns. Proof of such
insurance shall be supplled by each owner upon the request of the
other owner. Upon request of any owner, the insurance of the
other or,rner shall be amended to provide to the requesting owner, a
ten day notice prior to cancellation for any reason. Any or,tner nay, at any tine two years or longer after the last appraisal ,
demand of the other owner an appraisal for insurance purposes of
each townhouse, or may have such appraisal made, charging the
owners of each townhouse egually wlth the costs thereof.

We have reviewed the drawings that you sent us concerning the regrad'ing of Lot #3, Filing No. 1, in the Bighorn Subdivision located in Vail. The proposed grading plan would place fill material in the 100-year f1 oodplain limits.
The enclosed Figure L shows a typical cross-section depicting existing and future grading conditions. The shaded area shbws the
amount of fill actually being placed in the 100-year floodptain.Basically, this.represents a volume of water now being displaced by the proposed regrading. This volume is compensated by an increase in -eleva-
tion of the water surface and an associated change in stream
vel ocities.
t^/e feel that both the change .in stream ve'l ocity and increase in rvater surface elevation will be negligible to nonexistant. This conclusion is based on the geometry of the affected creek reach.
Through this,area, the 100-year floodplain is large in comparison to the amount of fill being placed. A1so, it appears that oniy B0 feet of creek reach will be impacted. Based on this information, wL do not foresee any impact to Gore Creek by the proposed grading plan.

SCOPE
This report presents the results of a Soils and Foundation
Investigation for fhe proposed duplex on Lot 3, Bighorn Subdi-
vision, Vail, Colorado, The Investigation was prepared by
means of test p i ts and laboratory testi ng of samp les obta ined
from these test p its.
This inves*i gation p resents a description of surface
and subsurface conditions encountered at the s ite, recommended
foundation systems, al lowab le design pressures, and groundwater
conditions as well as design and cons+ruction criteria influenced
by the subsoils.

The siie is located in a part of the Norfhwest one-quarter
of Section 12, Township 5 South, Range B0 West of the Sixth
Principal Meri.dian, Eagle County, Colorado.
The lof drains into Gore Creek at the rear of the lot.

The field invesfigation performed on May 13, 1981,
consisted of excavating, logging, and sampling two test pi-is.
The locations of the test pits are shown on Drawing No. l.
Summaries of the test pit logs are detai led on Figures No.
I and 2.
The test 0 its were excavated with a con vent i ona I backhoe.
Hand-drive samp lres of the soil could no+ be faken due to
the nature of the soi ls.
SUBSURFACE AND GROUNDWATER COND IT IONS

2. Subsurface conditions are fairly uni form with topsoil to
a depth of one foot; underlain by sand, gravel, cobbles and
boulders, brown fo gray brown.

PROPOSED CONSTRUCT ION
No specific design data has been provided, but for the
purpose of th is ana lys i s, it has been presumed fhat fhe proposed
duplex wi ll consist of two f loors without a basement, and
that loads will be light. lf the proposed project differs
significantly from lhis understanding, a review should be
made after the p lans are more comp lefe.
FOUNDAT ION RECOMMENDAT I ONS
Very low to non-conso I idat ing sands will be encountered
in the excavation. The proposed duplex should be founded
on conven-f ional type spread foofings designed for a maximum
s9i I bearing .pressure of 2000 psf (dead load plus one-half
live load). At ihis pressure, foundat ion seft lements will
be tolerable.' lt would be advisable fo proportion footings
so as to minimize differential settlements. The bottom of
the footing should be placed a minimum of 48 inches below
f ina I grade for t rost protect ion.

of the soils supporting interior slabs, the slabs should be
separafed from all bearing members and uti lity lines to allow
thei r i ndependent movements. S labs shou I d be scored i nto
maximum 200 square foot areas to localize and control any
crack ing and heaving.
GROUNDWATER AND DRAIN SYSTEM
Beca use of the re lati ve ly h igh groundwater leve | , some
difficulty during excavation and construction of the proposed
shallow foundations is anticipated. However, since these
foundafion materia ls genera I ly tend to soften when exposed
io free water, every effort should be made fo keep the excavat-ions
dry if water is encountered. A gravi+y drainage system, sump -_
pumps, or ofher conventiona I mi nor dewatering procedures should
be suff lc ient for this purpose.
A peripheral drain system as defailed on Figure No. 4
should be installed.

When moist soils are encountered in the excavation, the
ground surface in crawl space areas should be covered with

an impervious moisture barrier sealed against the footings.
This will help to reduce humidify in the crawl space area
and will also prevenf the moist foundation soi ls from drying
and shri nking, wh i ch cou I d poss i b ly cause the sfructure to

BACKF I LL AND SURFACE DRA INAGE
The potential ly consol idating foundation soi ls encountered
in portions of fhe site should be prevented from being wefted
after construction. Generally, fhis can be accomplished by
ins ur i ng that the backf ill p laced around the foundat i on walls
wi|| not setfle afte. ":rOlefion of cons+rucfion and that
the backfill material is relatively impervious. Wafer should
be added to backfi ll material to allow proper compaction --
do not DUddle.
Surface wafer runn i ng toward the structure from ups lope
areas should be diverted around and away from fhe bui lding

The f inal grade should have a positive slope away from
the foundation walls on all sides. A minimum of l2 inches
in the first ten feet is recommended. Downspouts and sill

Do not install sprinkler systerns next to foundation walls,
porches or patio slabs. lt sprinkler systems are installed,
the sprinkler heads should be placed so that the spray from
the heads, under full pressure, does not fall within five
feet of foun dat ion walls, porches or patio slabs. Lawn irri-
gat ion must be contro I led.
I f the fufure owners des ire fo p lant next to foundation
walls, porches or patio slabs, and are willing to assume the
risk of structural damage, etc., then it is advisable fo plant
only flowers and shrubbery (no lawn) of varieties tha-l- require

Our experience has shown that damage due to swelling or con-
solidaiing soils usually results from saturation of the founda-
t ion soils ca use d by imp rope r d ra i nage, excess ive irrigation,
and poorly consolidated backfills. The elimination of fhe
potential sources of excessive water will greatly minimize
the risks of construction of this sife.
This report has been p rep a red for the exclusive use of
CDS Enterprises for the specific applica-tion fo the proposed
dup lex located on Lot 3, Bighorn Subdivision, Vai l, Colorado.

WHEREAS, the Licensee desires to route
LICENSE .{GREEMENT
THIS LICENSE, execured ttus /2 day ot :,,/ anrE
WESTERN SLOPE CAS COIvIPANY. a Colorado corporation. hereinafter called "Licensor" to the
hereinafter cailed the licensed facilitv over and across portions of said
easements and desires to obtain permission therefor;
IT IS, THEREFORE, agreed as follows:
(l) ln consideration of the payment of One Dollar (Sl.00) and other valuable consideration, the receipt whereof
is hereby acknowledged, Licensor hereby grants to Licensee, its successors and assigns, with respect to such title and interest as
Licensor may have in the premises, and upon the terms and conditions hereinafter stated, rhe permission and right to lay,
maintain, operate, repair, inspect, remove and replace the licensed facility in, across and under certain easements owned by
Licensor, said installation and construction to be located as shown on the sketch attached hereto and made a part hereoi b1'
reference. The description of the route of said licensed facility is as follows (See otrached map):
(2) Licensee shall remole, at its own expense, the licensed facility from the premises or my part thereof or move
the same to a different location on Licensor's right of way, as requested by Licensor, if said licensed faciliry should interfere
with the operation or maintenance of Licensor's transmission pipelines and related facilities as now or hereafter constructed.
The new location shall be fumished by Licensor at no cost to Licensee.
(3) The Licensor reserves the righi to grant to others the use of the premises for any purposes, provided that sanre
shali not interfere unreasonably with the licensed facility herein authorized.
(4) Licensee shall not do or permit ro be done any blasting above, underneath or near the transmission pipeline
of Licensor without first having received written permission of office of the IVlanager of Engineering of Licensor. Any said
blasting shall be done in the presence of a representative of said office and in accord with directions he may give for the pro-
tection or safety of Licensor's facilities in the area.
(5) Licensee agrees that it shall not begin construction upon and along the rights of way of the Licensor ercept
after having first provided tire Licensor with plans and specifications and until said plans and specifications have been approved
and until twenty-four hours notice of t}te commencement of construction shall have been given to the Licensor. It is further
agreed and covenanted that said constructi.on shall be made only when a representative of the Licensor is present at the time
and place of construction and that the instructions of said representative relating to the safety of Licensor's pipeline will be
followed by the Licensee, its agents and employees. It is further agreed that any damage done to Licensor's faciiities during the
above consiruction shall be paid for or repaired at the expense of rhe Licensee.
(6) Licensee fuither agrees that any fuiure rvork involving the construction, maintenance, reconstruction or re.
location of its licensed facility on the premises sliall be done under the terms of Paragraph 5 above.
(7) It is understood and agreed that Licensee has been fully advised by Licensor that the natural gas transmission
iine(s) of Licensor now transport and will continue to transport natural gas at pressures exceeding 400 psi. Licensee shall advise
all of its employees. agents. contractors ald other persons who enter upon the premises pursuant to the provisions of this
I icense of the dangers involved.
(8) It is further understood and agreed that Ucensee has been fully advised by Licensor that the transmission liles
of Licensor will be subject to cathodic protection by rectifier, and related anode beds. Licensor shall not be liable for stray
cufient, or interfering signals induced into Licensee's licensed facility as a result of the operating of Licensor's cathodic pro-
tectlon system.
(9) Licensee covenants and agrees to at all times protect, indemnify, to hold harmless, and defend Licensor, its
officers, agents or employees, from all claims, actions or damages whatsoever, to any person or persons and property including
but not limited to employees of the licensee or its contractors or subcontractors or their employees, arising from or growing
out of the construction, existence, maintenance, operation or removal of the facilities of Licensee permitted hereunder.
(10) Licensor shall use care not to damage Licensee's licensed facility in the maintenance, relocation or reconstruc-
tion of its pipeline facilities, ald Licensor if at all possible, shall give reasonable notice to Licensee of any of its activities in
the immediate vicinity of Licensee's facilities.
(11) Licensee sha1l install its licensed facility so as to maintain the maximum distance between such licensed
facility and Licensor's pipeline that the easement width and terrain will permit, but in no event shall such licensed facility be
instailed closer than l0 feet to Licensor's pipeline. When Licensee is required to cross said pipeline the crossing shall be under
said line ifcover is under 52 inches. A 12-inch separation shall be maintained on ai1 crossings.

Licensor may remove the same at the expense of the Licensee,
(15) Licensee further agrees to provide and keep in full force and effect Workmen's Compensation insurance
pursuant to the laws of Colorado or any state having comity with Colorado on ail employees entering upon the property of
Western Slope which is the subject of this general l.icense, or any application made a part hereof, as referred to in this agree-
ment for the purpose of providing services pursuant to any license or use contemplated by this agreement.
Licensee further agrees to require any contractor or subcontractor to provide and keep in full force and effect
Workmen's Compensation insurance pursuant to the laws of Colorado or any other state having comity with Colorado on any
employees of said contractor or subcontractor entering upon the property of Westem Slope which is the subject of this general
license, or any application made a part hereof, as referred to in this agreement for the purpose of providing services pursuant
to any license or use contemplated by this agreement.
(16) This License shall inure to the benefit of and be binding upon the successors and assigns of the parties hereto.
