Dear Mr. Toepfer:
fn your letter of December 5, 1990, you expressed a desj_re to add parking on your lot at 4074 Bighorn Road.
You present two alternatives. You have your choice as to which proposal would would like to submit. Generally the Design Review Board encourages applicants to protect landscapj-ng, minirnize asphalt and reduce road cuts.
Although this is a ninor request, it must go to Desj_gn Review Board because of the visibility of the proposed parking lot. Enclosed is a Design Review Board application, along with a list of submj-ttal dead1ine dates and neeting dates. please subrnit an
irnprovement survey with topography in the project area, a grading and drainage plan as well as a landscape p1an. If your projec!requires retainage (it looks as though there would have to be some retainage), please show this along with a cross section of the retainage. It is also irnportant to submit a title report so we can check for easements if you require retainage.

In talking with Mark 0 t Rellly, a f riend of nine and an "tqr-rJttt"tt""of yours, Mark suggested I write you and pass a proposal by you
for your approval .
I have a half of a duplex in east Vail on Bighorn Rd. Earl-ier this
year I completed an addition to my unit. Because of a need for
additional parking, I would like to put in sone addi-tional parking
area in the approximate locati.on as secforth on the attached
plans (sketches ) . I prefer the top sketch since providing a
circular drive area wdruld elininate lawn area just to the
front of the house. The home to the west of us has recenEly been
finished and has parking in the same general area.
If the above is acceptable t.o the city I would appreciate your
indicating so on the sketch and returning same to me so I can
start planning for the work in the spring.

I^le teceived your letter regarding the approval of our plans for an add*tion
on our home at 4074 Bighorn Rd. We very much appreciate your r^rords of advice
and will take every precaution rre can to see that we dontt have freezing problems If there was another approach we could use we would have done so"
but to salvage Ehe views that \.re currently have we think the plan we have is in the long run the best.
Regarding the landscaping and berm, ve will follow your advi_ce and use service beery where suggested as well as plant many evergreen and aspen in the berm area.
For your information we have our current place fixed with temperature alarms. when the tempurature fal1s below 40 degrees lights come on which
can be seen from the street. Our manager also checks the place at least evry other day during the winter months. Naturally nothing is fool-proof but
we try to do nhat is logical and saEe-guarding.

Dear James and Sue:
Yesterday, the Design Review Board gave approval for the addition
to a residence at the above property. fn doing so, they wanted to
strongly dj-scourage you from building in this way because of the
very cold weather experienced in Vail. Two of the rnembers of the
Board are architects, and they stated that the pipes from both the
bathtub and toilet will freeze during a Vail winter.
As a personal aside, I l-ive in a condominium complex, and our
managing office asserts that they will not be responsible for
frozen pipes if our thermostats are set below 55 degrees. (And
these pipes are not even on an outside wall.) As you may be aware,
the temperature in Vail may reach 30 degrees below zero
For your sake, I hope that you wil-l consider this before
construction. one option would be to change the present garage
into the proposed addition and add a garage. of course, there are
many more options, and we hope you will consider one of them.
Two other iterns were included in the approval. The Design Review
Board requested that planting below the Iarge exlsting trees consist of shrubs rather than other trees, and suggested service
berry as a hearty shrub. Further, they asked that the trees in the
berm that is planned for this summer i.nclude many evergreens as well as aspen.
If you have any concerns about this approval and these suggestions,

I further und.erstand that you bave continued the action on

I am sorry that I camot personally nake it to that sessiou
since I will be out of town, however I believe there are
certain mitigating circumst€urces that should be brought to
your attention prior to your taking actlon on By proposal .
First, my wife and I have owned property in Vail for alnost
13 years. Ue have never rented. our properties sinee lr€ co[-
sider VaiI our second home. Feeling thls waf, anything that
we do in the way of improvenents witb our Vail property
must be done in good taste since we share your concerns
about community ippearance and architectural appropriateness.
Secondly, since purcirasi.ng the Bilhorn property about tr*o
years &go I we and our duplex neighbors have ma$e. substantial
ianOscape inprovements. This sumner we added substantial
lawn areas to our backyards, put in paths, benches and
added trees and neny floseri. This coming spring we are reatly
to l:uild up the striet property line area with bermst
aspen treel and green spruce trees. hlelve also added roeks
and boulders along Gore creek to cut down on erosion.
Thirdly, regarding the proposed addition, tbe architect was
instrucied to match all window types, siclingt roofingr colors,
etc. with existing materials.
Forrtirly, If you have visited tlre site you would see that
the dupiix siis way below the grade of Bighorn Rd. Irve
asked my contractor to furnish you a cross-section of the
existing aJrd proposed structure to polnt this out. The
floor oi tne new farnily room etc.. will be below the elev-
vation of the roadway above. Add to this the landscape
improvements we $lan on making this coning springr will
make any addition even rtore inconspicuous. I could not agree
with yoir more tbat if the structure was gt:urding out in the
open it would not be as desireable as we are proposing be-
cause of the surrounding woods and terrain.
In arriving at the design that we tlid, wg tried several other
locations on the lot but each one resulted in a severe loss
of view fron the inside of the hone as well as voided nice
landscaping that we have developed

Fifth, it has been suggested that we place the addition over
the garage. We tried this too but in doing so we would block
the large windows that provide the light to our master bed-
room.
Sixth, and perhaps one of the most presslng, ne have a lot
of granchildren plus daughters and son-in-Iaws lvho all like
to fish and ski together. Ife sinply need the space as you
nlght imagine.
Tn conclusion, I would like to appeal to you to understand
not just the need, but nore lnportantly the improvements
we make will be in synpathy with the gaals aJld obiectlves
that each of you have set for the Town. We would do nothing
that would take away from the aesthetic quality of the com-
munity.
