Dear Tom,
Sorry about any confusion around our conversation yesterday in our office.
Mr. Affa recently submitted a duplex subdivision application, with a draft duplex plat, to the
Town of Vail for review for the property located at 4049 Lupine Drive. In conversations with Mr.
Affa at the time of submittal, he indicated that he did not possess a signed "joint property owner"
approval form from you for the application. However, Mr. Affa did indicate to me that you and
he were finalizing your negations concerning the plat.
Since you and I have spoken about the Affa remodel project on several occasions, I was
already aware that you and the Affas have been engaged in negotiations to update the duplex
plat and that you intended to be a joint applicant. While I have Mr. Affa's written approval for the
duplex subdivision application and your verbal approval, as a formality of the Town's design
review process, your written signature should be submitted for the Town's files. Please
complete the attached joint property owner approval form and return it to me via fax at (970)
479-2452.
It is my understanding that both you and the Affas are aware that the duplex subdivision can not
be finalized until both ownership parties agree to sign the final mylar version of the duplex plat.

Dear Roger,
The Town of Vail Staff has reviewed the proposed duplex plat application for the AffaMinters property at
4049 Lupine Drive. The following is a summary of the comments from that review:
1. The following note must be added to the plat: "For zoning purposes, the two lots created by
this subdivision are to be treated as one entity with no more than one two-family residence
allowed on the combined area of the two lots."
2. An Administrator's Certificate must be added.
Please make the above listed conections and then submit two signed mylar copies of the plat with all
certificates completed, except the Administrator Certificate and the Clerk and Recorder Certificate.
Additionally, please submit any declaration and/or covenants to be recorded plus a check paid to the
order of the Eagle County Clerk and Recorder in the amount of the recordation fees for the mylars and
any accompanying documents. Once these items have been submitted to the Town of Vail, the Town
Clerk will record the approved plat with lhe Eagle County Clerk and Recorder.

Dear Tom:
This letter is confirmation of the approval for the following improvements to your property located at
4094 B Lupine Drive, Vail, Colorado.
l. Painting: You are allowed to paint your property to natch the adjoining duplex. Painting must
match the existing paint on the A-ffa property and must be completed no later than July 1, 2007
2. Patio: You are allowed to install up to a 14' x 14' patio on the south of the existing sunroonl
provided that said patio does not encroach within 10' of the property line on the west side ofyour
home. Material used will be natural rock.
3. You are allowed to plant additional trees, nafive species and other plants on your proPerty,
without limit.
4. You are allowed to replace the vertical log wall installed by Mr. Affa along your driveway with a
rock wall. Rockwork will match as closely as reasonable the existing rock work on the Affa
residence. The wall will be installed in the same general shape and location as the original wall as
illushated in the landscaping plans presented to the Town by Mr. Affa and approved by the
Town's Design Review Board.
These improvements/changes to the property have been approved by the Town and will not need permits
or additionai review by the town's Design Review Board. As you are aware, changes to the exterior of
your property may be further regulated by private contracts, such as a parfy wall agreement, which the
Town of Vail is not party to. The Town of Vail does not interpret, nor enforce, any provision of any such
private agreements.

Point Four (4): Clarification of construction timing
In a joint meeting today in JMP Architects, lnc. office we, the undersigned, have
agreed to build the consistent architectural revisions to our commonly held
duplex structure of the above address as approved by the Town of Vail Design
Review Board.
We have agreed upon the construction beginning on tlre east half (Affa) this
spring (May of 2005) and construction beginning on the west half (Winter) in the

I'd like to remind you that until I give final approval to your remodeling project
at 4094 A Lupine Drive construction may not conunence.
To ensure that final approval is given by me per the Town of Vail building codes
governing your remodel, several issues surrounding the improvements on your
half of the duplex at 4094 Lupine Drive must be resolved. At this point I would
appreciate it if you could review the list below and take action to promptly
resolve these items so that I may give final approval to your remodel and so
construction on your unit is not delayed.
The following items MUST be provided to me at our meeting scheduled for July
15. 2005.
1.
Compleie survey records of Parcel C, as well as all information regarding the
division of this parcel between Unit A (your unit) and Unit B (my unit). These
will be reviewed by me at our meeting and must be filled by you with Eagle
County, the Town of Vail and all relevant legal entities as required by law no
later than July 20.
2.
A signed copy of your final approval per the Town of Vail codes for the
renovations that will be taking place during the spring of 2006 on my half of the
duplex. I will provide you with the form at our meeting on July 15, and you can
sign it at that time.

Parcel C/Driveway. It has come to my attention that your plans include
removing pavement and narrowing the existing driveway in addition to
removing the pavement comprising the parking area for your unit (#A) in front
of your garage. AII pavement must be removed from the NORTH side of the
driveway and no pavement shall be removed under any circumstances
whatsoever from ihe SOUTH side of the driveway. ln addition, it is imperative
that I retain the right to plant or landscape along an area 3 feet wide on the north
side of the existing driveway. You must provide a signed document to this effect
before final approval will be given to your remodel.

Concrete Pan. The town of Vail has stipulated that as part of your remodel a
concrete pan must be installed at the end of the current driveway between the
street and the start of the driveway in Parcel C. You will handle all arrangements
for this p?"l"to be installed and you will be responsible for all costs incurred by
said installation. You must provide a signed document agreeing to this before
final approval will be given to your remodel.
Damage to Unit B. Any damage to my unit during construction must be repaired
within 3 working days, and you will be responsible for all costs associated with
said repairs. You must provide a signed document to this effect before final
approval will be given to your remodel.
Contingent to all of the above being resolved to my satisfaction prior to the
meeting we have scheduled for ]uly 75,2005, please be prepared to discuss the
following subjects:
1.
Roof materials. At this point I have no plans to change the roofing materials on
my duplex. You and your architect should plan on matching your new roof to
duplicate the existing roof to meet Town of Vail codes. I will expect to review
your proposed roofing materials at our meeting on July 15. Should I find these
suitable, we can discuss changes in the roofing plans at that time. I will approve
any changes in the roofing materials as quickly as possible.

Faint. At this time I have no plans to re-paint my unit a new or different color.
You and your builder shall plan to match the existing paint to meet Town of Vail
codes. I will expect to review new painting schemes at our meeting on July i5.
Should I find these suitable, we can discuss changes in the roofing plans at that
time. I will approve any changes in the roofing materials as quickly as possible.
Landscaping. I have yet to review your final landscaping plans. Please provide
me with a complete and final set of plans at our meeting on July 15. I will be
unable to give final approval to your remodel without reviewing these plans.
Once again, Roger, I look forward to working with you to achieve your
renovation goals, provided that you address these issues prior to moving
forward with any part of your construction project

Dear Roger:
This letter will address two new changes to your building plans that you have
submitted to me for my approval. Please keep in mind that I have been
exceptionally easy to work with during your remodel and have approved every
single one of your requests to date. However, I am unable to approve your two
most recent requests. Details as to why are listed below.
1. Custom Garage Door
Unfortunately the Town of Vail has informed me that per their regulations
governing duplex homes, both garage doors must match. Because of this, at this
time I am unable to approve the installation of a custom door on your unit
because I am unwilling to assume the cost of duplicating that door for my unit.
Should you wish to assume the costs associated with installing a matching door
on my unit, I will consider this change. Final approval will be contingent upon
your submitting to my builder a check for the total amount in advance and
signing an agreement to assume all costs associated with said installation,
including the costs associated with my attorney to draw up this agreement.
If you are not willing to assume these costs, please plan on matching my garage
door, per the agreement you signed on April 18,2005, where you agreed to,
"build the consistent architectural revisions to our commonly held duplex
structure."
2. Trees
While I appreciate the fact that you have worked to save small stands of
lodgepole pines on your property, given the virulence of the beetle infestation in
the state of Colorado and the aggressive removal of trees on your property
during your remodel, I am unable to give approval to your request to be relieved
of your current obligation to plant trees on your property. In fulfilling this
obligation, you might appreciate that Paulino Gardens in Denver is currently
selling trees for 40% off their normal price, a substantial savings that you may
wish to take advantage of.

Dear John,
The Town of Vail Staff has reviewed the Design Review application for a proposed addition to
the Affa Residence at 4094 Lupine Drive. The following is a summary of that review:
. Submit written approval for the proposed landscaping improvements from all who are
party to the utility easement along Bighorn Road.
. The proposed addition is subject to Town of Vail Fire Department approval.. The fire hydrant must be relocated to meet Eagle River Water and Sanitation District
standards (i.e. minimum separation distance from the proposed driveway).
. Clarify the timing for the construction of improvements to the Winter Residence (west
side of duplex). Pursuant to the Vail Town Code, the west and east units must have a
consistent architectural design. Therefore, the issuance of building permits for the east
unit (Affa) will be contingent upon DRB approval and building permit application for the
west unit (Winters).
. At the time of building permit application, submit a Revocable Right-of-Way Permit, for
Town of Vail review and approval, for all existing and proposed improvements within the
Lupine Drive rightof-way.
. Submit "red lined" floor plans showing how the GRFA was calculated based upon the
whole of Lot 5 (i.e. both west and east units). Crawlspaces not counted as GRFA must
be labeled, and constructed, five feet (5') or less in height.
. Submit an exterior lighting plan, including fixture cut-sheets and luminance calculations,
for the entire Lot 5 (i.e. both west and east units).. The site olan must be revised as follows:
o Show all setback lines for Lot 5.
o Label all proposed roof ridge elevations.
o Show the proposed limits of disturbance fence south of the new driveway.
o Show the erosion control methods.
o ldentify the driveway surface materials and if the driveways are snowmelt heated.
o Install a four-foot (4') concrete pan between the existing south driveway and
Lupine Drive.

I am writing in response to your letter dated April 15, 2005 regarding the review
of the Design Review application for a proposed additions to the AffaAl/inter
Duolex.
Point One (1): Utility Easement Signoffs
Communication in progress with Xcel Energy (gas) and Eagle Valley Water and
Sanrtation (water and sewer) for signoffs. Applicant will submit standard TOV
Utility signoff forms to all utility providers. Landscaping may be removed from
utility area should any provider object. See letter from John Rosenfeld.
Point Two (2): Vail Fire Department Approval
Applicant fully understands all proposed improvements are subject to
TOVFD approval.
Point Three (3): Fire Hydrant
Applicant intends to relocate fire hydrant per all ERWSD specifications.
Arrangements currently being made with James B. Boyd, Jr.,construction
manager ERWSD. See attached correspondence.

This letter is affirm that it is assumed that any planting or landscaping that is located in
any utility easement is done so at the owners risk. It is always accepted that any trees,
plants, etc that are located within the utility easement could potentially be removed at the
discretion of the utility company.
Regarding the residence located at 4094 Lupine Drive, in East Vail, it is hereby noted
that no tlees or plantings shall be located directly on top ofthe piping for water and gas,
rvhich is present in the easement. Furthermore, it is understood that any plantings located
in the easement are done so at the owners risk. Upon the return of the proper authorities
with the utility companies, they will be notified of the plans for the easements. At that
time, the sign-offs will be taken care of and forwarded to the Torvn of Vail for approval.

In a joint meeting today in JMP Architects, lnc. office we, the undersigned, have
agreed to build the consistent architectural revisions to our commonly held
duplex structure of the above address as approved by the Town of Vail Design
Review Board.
We have agreed upon the construction beginning on the east half (Affa) this
spring (May of 2005) and construction beginning on the west half (Winter) in the
