Dear Bill,
Both owners of units A (Affa) and B (Winter) of the above referenced East Vail
duplex agree to the following five points:
1. To manipulate the minor subdivision property line to allow 3' (three feet)
of relief at the two northwest garage corners on unit A and to allow privacy
landscaping on a berm to drain northwest between units A and B.
Property line to be located 4' (four feet) away from the north existing wall
of unit and 4' (four feet) from the new stair well and south new garage
wall per exhibit A. The new duplex party wall agreement to be revised to
of the above and exhibit A.
2. Unit B proposes the following improvements all of which are subject to
final drawing approvals from the Town of Vail and unit A:
a. Enlarged master bedroom above the existing garage with a south
facing deck at which all privacy sight lines are to be maintained
between unit A and unit B. Drip line and snow fall management to
, be designed to minimize any migration from unit B onto unit A.

and of approximately 90 sq. ft. (GRFA)
Three trees to be downsized to 6', to 7', in height instead of the approved
8' to 10' trees.
Landscape retaining wall along unit B driveway may be replaced in.the
future wlifr dry stacked stone to match existing stone work on the structure
(Colorado Moss Rock) by owner of unit B'
