Dear Tim.
Thank you for submitting for design review revised plans ot the hot tub enclosure proposal to match the set of plans
which were submitted to the Building Department lor release of a building permit. Staff presented lhe changes lo
the Design Review Board yesterday at their bi-weekly meeting, who lhen approved lhe revised application on the
following conditions:
1. Prior to temporary cenificate of occupancy, the awlicant shall ensurc that the enclosure and rclated
construction be painted to match the residence.
2. The applicant shall ensure that the railing style match either the railing style ot the existing deck
and rciling (but up to cwrent building code standards) OR be sided horizontally to match the siding
style applied to the residence.
Please let me know il clarification is needed regarding the Board's requests. You may now submit for your building
permit, with those two changes noted on the plans. Of course, if anything changes on the set of plans which you
submit to the building department which was not a result of the conditions stated above, it will b€ necessary to go
through the design review process once again. I have enclosed a copy ot the Design Review Board Action Form,
which you will need in order to apply for your building permit again.

Dear Bobby,
I have had a chance to preliminarily review the application that was recently submitted for an expansion to the deck at the
Gagner residence al the above address. The application has been scheduled lar the Design Review Board public
hearing on December 1"', 2004.
I was unable to find plans or information within the file regarding this lot's available site coverage, which would be atfected
through the proposal. Per the Vail Town Code, site coverage within the Two Family Residential district is limited to 20% o1
the total site area. According to the ILC which was submitted, the total lot area is 12,414 square leet. According to my
calculations, total site coverage (on parcels B, C, and D) is currently 2,246 square feet, or about 18% of the total site area.
Therefore, the proposed addition of 80 square teet of site coverage should allow the site coverage to remain under the 20%
restriction, at 2,326 square feet.
Please be aware that the enclosure will count as Gross Residential Floor Area (GRFA) unless it can comply with Ordinance
No.l4, Series of 2004, Vail Town Code, Section 13:8:
Rooled or covered decks, porches, terraces, patios or similar leatures or spaces with no more than three (3)
exterior walls and a minimum opening of not less than twenty live percent (25%) of the lineal perimeter of
the area of said deck, porch, terrace, patio, or similar feature or space, provided the opening is contiguous
and lully open f rom floor to ceiling, with an allowance for a railing ol up to fotty lour inches (44") in height
and suppoft posts with a diameter ol eighteen inches (18") or less which are spaced no closer than ten feet
(10') apan. The space between the posts shall be measured lrom the outer surface of the post.
Please submit a set of four different elevations so that I can accurately measure the proposed enclosure and
ensure that it will not qualify as GRFA.
Additionally, please submit cut sheets or samples-of the smoked glass and the Brazilian redwood materials to be
used for the enclosure by Monday, November 22"".

application wilh Stalf, which lwill be able to do upon my return to Town, during the middle ol next week. I will

Dear Bobby,
Thank you lor attending today's Design Review Board hearing of the proposal to erect a hot tub gazebo/enclosure
at the above address. The Design Review Board tabled the proposal, at your request, until the December 1 5"',
2004 hearing after expressing the following concerns:
1 ) For aesthetic reasons, the smoked glass should be eliminated entirely (not just on one side) from lhe
proposal, leaving only the cedar railing for privacy purposes.
2) Some attention should be paid to concealing the lower portion ol the north side of the structure. The
Board was particularly concerned about the visual aspects of the structure from Bighorn road. One
suggestion was to amend the plans to show a continuance of the eastern wall ol the home at the ground
level on the northern side ol the proposed rectangle, while leaving open to the air the southern, western, and
eastern oortions underneath the hot tub.
3) Additionally, landscaping must be proposed for the northern side of the enclosure, which will mitigate the
views both to and from Bighorn road and the hot tub enclosure.
4) Please redesign the roof of the gazebo to more appropriately match the roofing forms that exlst on the
residoncc. One suggestion was to create a shed style roof that sloped lrom the south side to the north side,
maintaining excellent and open views to the south while creating more privacy on the north side.
As you know, the Design Review Board maintains very high standards for each and every proposal that it reviews.
Therefore, requests that seem as simple as the current proposal are sometimes in the review process for months.
The Board has made the aforementioned suggestions in order to continue the high quality construction which helps
to make the Town a unique and beautiful place lor visitors and residents alike.
Please submit amended plans to Staff by Friday, Decembe lO'n in preparation for the Wednesday, December 1Sth
Design Review Board hearing. lf more time is needed lo prepare amended drawings, simply contact me and lwill
table the application until the lirst meeting in January.

This application is required for proposals involving minor exterior alterations andlor site improvements.
Proposals to add landscaping do not require DRB approval unless they involve the addition of patios,
water features, grading, or the addition of retaining walls.
